6830 Levy AssessmentsCONSOLIDATED-$ALINA ORDINANCE NUMBER (Published in The Salina Journal1964) AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering paving and grading of Antrim Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Third Street to the west line of Front Street; the curbing, guttering, paving and grading of Antrim Avenue with concrete (Thirty-three (33)! feet wide from back of curb to back of curb) from the east line of Fourth Street to the east line of Third Street; curbing, guttering, paving and grading of Eleventh 'Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Hamilton Avenue to the south line of Antrim Avenue; curbing, guttering, paving and grading of Fourth Street on the east side of Railroad tracks with concrete (Thirty-one (31) feet wide from back of curb to edge of slab) from the south line of Minneapolis Avenue to the north line of Ellsworth Avenue; paving of Greeley Avenue with concrete (E[Lghteen (18) feet wide from edge of pavement to edge of pavement) from the west line of West Upper Mill Heights Drive to the east line of East Upper Mill Heights Drive; paving and grading of Seventh Street with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) fromthe north side of Pacific Avenue to the south line of Harsh Avenue, the same being an intervening connecting street; paving and grading of Seventh Street with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north side of Antrim Avenue to the south side of Otis Avenue, the same being an intervening connecting street; curbing, guttering, paving and grading of Stack Avenue with concrete (Twenty-two (2 } feet wide from back of curb to back of curb) from the east line of Indiana Avenue to the wes line of Wisconsin Avenue, the same being an intervening connecting street; and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. For the purpose of paying for that part of the cost of improvements in each of such improvements, respectively, as set forth in the following sections of this ordinance with respect to each of such improvements, there is hereby levied and assessed on the property liable therefore, being all the lots and pieces of land lying on either side of said streets so improved, respectively, to the middle of the block for the distance improved with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, 8 of this ordinance, according to the appraised value of such lots and pieces of ground with respect to each such improvement, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements, said special assessments being based on the special valuation and appraisement of said lots and pieces of ground therefore made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to each such improvement which said appraisements are hereby referred to and made a part of this ordinance, and the several amounts so levied, apportione and assessed against the lots and pieces of ground for each such improvement, respectively, for the purpose aforesaid, are hereby found and determined to be the amounts set forth in the following sections of this ordinance with respect to each of such improvements. Section 2. For that part of the cost of curbing, guttering, paving and grading of Antrim Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Third Street to the west line of Front 'Street; and for that part of cost of curbing, guttering, paving and grading of Antrim Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Fourth Street to the east line of Third 'Street, which is chargeable against the private property within the certain portions of certain streets i as hereinafter set forth in the following sections of this ordinance, which is chargeable to the private property in the assessment districts for each of such improvements, respectively, as set forth in the following sections of this ordinance with respect to each of such improvements, there is hereby levied and assessed on the property liable therefore, being all the lots and pieces of land lying on either side of said streets so improved, respectively, to the middle of the block for the distance improved with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, 8 of this ordinance, according to the appraised value of such lots and pieces of ground with respect to each such improvement, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements, said special assessments being based on the special valuation and appraisement of said lots and pieces of ground therefore made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to each such improvement which said appraisements are hereby referred to and made a part of this ordinance, and the several amounts so levied, apportione and assessed against the lots and pieces of ground for each such improvement, respectively, for the purpose aforesaid, are hereby found and determined to be the amounts set forth in the following sections of this ordinance with respect to each of such improvements. For that part of the cost of curbing, guttering, paving and grading of Stack Avenue with concrete (Twenty-two (22) feet wide from back of curb to back of curb) from the east line of Indiana Avenue to the west line of Wisconsin Avenue, the same being an intervening connecting street, which is chargeable against the private property within the district chargeable therefore, and which cost is hereby determined to be $9,072.36, there is hereby levied, apportioned and assessed against the following described lots and pieces of land as provided for in Section 1 of this ordinance, the following amounts: Indian Rock Addition - - - - - - - - - - - - -$9,072.36 Section 9. Said amounts so levied, apportioned and assessed as aforesaid will be due and collectible in ten equal installments, the first becoming due with the taxes levied for the year 1965, and one of said installments falling due each and every year thereafter unti all are paid and all to be collected with interest as in this ordinance provided, HOWEVER, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by paying to the City Treasury the entire amount chargeable against the same, as in this ordinance provided, at any time within thirty days after the publication of this ordinance and before the issuance of bonds of said City in payment of the balance of the cost of said improvements, the property so paid on shall not thereafter be liable for any further assessment for the cost of such improvements nor for any part of said bonds. Section 10. There is hereby levied further and assessed against such lots and pieces of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds which may be issued at the end of thirty days as specified in the preceding sections hereof, as by law provided, to the time of the collection of the installments as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified and until all said assessments so apportioned and levied have been certified to the County Clerk of 'Saline County, Kansas a full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of said lots and pieces of ground which amounts shall include the annual installments of such special assessments with the interest for one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of said assessments, and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as other taxes are collected.
