SPECIAL MEETING OF THE BOARD OF COMMISSIONERS

N 9:00 a.m.
w Mayor Longbine asked the Clerk for verification that notice had been sent for today's City
Commission meeting. The Clerk replied yes.
The Special Meeting of the Board of Commissioners was called to order at 9:00 a.m. in Room 107,
City-County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of
' silence.
Those present and comprising a quorum: Mayor Bill Longbine (presiding), Trent W. Davis, M.D.,
Mike Hoppock, Jerry Ivey, and Greg Lenkiewicz.
Also present: Mike Schrage, City Manager; Jacob Wood, Deputy City Manager; Shawn Henessee,
Assistant City Manager; Greg Bengtson, City Attorney; and Nikki Goding, City Clerk.
ADMINISTRATION
(3.1) Request for Executive Session—Attorney/Client Privileged
24-0036 Moved by Commissioner Hoppock, seconded by Commissioner Lenkiewicz, that the City
Commission recess into executive session for 30 minutes to discuss the subject of legal
iii considerations relating to defense of the Cozy Inn vs. City of Salina case including identification of
special legal counsel based upon the need for consultation with an attorney for the public body
which would be deemed privileged in the attorney-client relationship pursuant to K.S.A. 75-
4319(b)(2). The open meeting will resume in this room at 9:35 a.m. Aye: (5) Nay: (0). Motion
carried.
The meeting adjourned at 9:05 a.m. and reconvened at 9:35 a.m.
Also present in the executive session were City Manager Mike Schrage, Deputy City
Manager Jacob Wood, Assistant City Manager Shawn Henessee, City Attorney Greg
Bengtson, and Director of Community and Development Services Lauren Driscoll.
The City Commission and City staff required more time for discussion.
24-0037 Moved by Commissioner Hoppock, seconded by Commissioner Davis, that the City Commission
recess into executive session for 20 minutes to discuss the subject of legal considerations relating to
defense of the Cozy Inn vs. City of Salina case including identification of special legal counsel
based upon the need for consultation with an attorney for the public body which would be deemed
privileged in the attorney-client relationship pursuant to K.S.A. 75-4319(b)(2). The open meeting
will resume in this room at 9:57 a.m. Aye: (5)Nay: (0). Motion carried.
The meeting adjourned at 9:37 a.m. and reconvened at 9:57 a.m.

City Manager Mike Schrage spoke on the discussion had and the selection of the lawyers to
defend the City in relation to this case.
24-4)38 Moved by Commissioner Hoppock, seconded by Commissioner Lenkiewicz, that the City engage
the law firm of Fairfield and Woods, P.C., Denver, Colorado, as legal counsel in defense of the case

of Cozy Inn, Incorporated, d/b/a The Cozy Inn; Stephen Howard vs City of Salina, Kansas and for
sign code consultation; and that the City Manager be authorized to execute an engagement letter
with the law firm. Aye: (5). Nay: (0). Motion carried.
