24-11199 Amending Future Land Use Map for Windy Creek Addition (Published on the Cit-of Salina website (httpc•//www Galina-ks_gsy) on March 124' 2024) ORDINANCE NUMBER 24-11199 AN ORDINANCE AMENDING THE FUTURE LAND USE MAP OF THE Z COMPREHENSIVE PLAN OF THE CITY OF SALINA, KANSAS. Q BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Findings. In relation to the following described real estate: The South 55.94 acres of a 92.81 acre tract of land located on the north side of Water Well Road between Interstate 135 and West Dry Creek. (the "Property") the Governing Body makes the following findings: 1. All conditions precedent for the amendment of the City's Comprehensive Plan have been timely met; 2. The requested Future Land Use Map amendment is justified by changing conditions in the community because there is interest in this tract of land from interstate oriented commercial business at the northwest corner of Water Well Road and I-135 and limited interchange sites available; and 3. The requested Future Land Use Map amendment advances goals and policies contained in the Plan because it would help provide development opportunities for interstate oriented commercial businesses; and 4. There is a public need to change the Comprehensive Plan map designation for the Property to Commercial because of the proximity of the Water Well Road-I-135 interchange. The close proximity to the Water Well Road-I-135 interchange makes this site conducive to highway oriented commercial uses. The Employment land use classification does not list highway oriented commercial uses as an appropriate land use, but the Commercial land use category does. 5. The public need is best served by changing the land use designation of the Property, as compared with other available property, because the southern portion of this tract has access to existing public utilities in the Yost Addition and is suitable for highway commercial businesses. The proposed change in land use designation would allow Southlands Development to develop a highway oriented convenience store/travel plaza at the northwest corner of 1-135 and Water Well Road. 6. The requested change would not negatively impact the surrounding areas as the subject property is adjacent to existing commercial development on the east and south and is buffered by West Dry Creek on the west. Section 2. Comprehensive Plan Amendment. The Future Land Use Map (Figure 2.1) of the Salina Comprehensive Plan is amended to show the Property as a Future Commercial land use area. Section 3. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance. Section 4. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City's website as the designated official city newspaper. Section 5.
