REGULAR MEETING OF THE BOARD OF COMMISSIONERS
February 12, 2024
4:00 p.m.
Li, Mayor Longbine asked the Clerk for verification that notice had been sent for today's City
Commission meeting. The Clerk replied yes.
The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in
Room 107, City-County Building. A roll call was taken followed by the Pledge of
Allegiance and a moment of silence.
Those present and comprising a quorum: Mayor Bill Longbine (presiding), Trent W. Davis,
M.D., Mike Hoppock, Jerry Ivey, and Greg Lenkiewicz.
Also present: Mike Schrage, City Manager; Jacob Wood, Deputy City Manager; Shawn
Henessee, Assistant City Manager; Greg Bengtson, City Attorney; and Nikki Goding, City
Clerk.
AWARDS AND PROCLAMATIONS
(3.1) Recognition of the week of February 18 through February 24, 2024, as Engineers
Week. Libby Lorenson, P.E., President of the Smoky Valley Chapter of Professional
Engineers, read the proclamation and discussed related activities.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(4.1) Salina Baseball Enterprises Agreement Amendment
(4.1a) Conduct a Public Hearing confirming the Naming Initiatives brought forth by
Salina Baseball Enterprises for two (2) facilities located at Berkley Family
Recreational Area.
(4.1b) Consider the approval of Resolution No. 24-8188 ratifying the honorary
naming of the field known as Tower Field as "Roger Wilbur Field" and for
the philanthropic naming of the field currently named Roger Wilbur Field as
"Pestinger Family Stadium" subject to the precondition of the certification of
available funding for Phase One renovations to the current "Roger Wilbur
Field" in accordance with the Municipal Facility Naming Guidelines.
(4.1c) Authorize the Mayor to Execute a First Amendment to the October 9, 2023
Agreement with Salina Baseball Enterprises relating to Wilbur Field and
James Matson Field.
(4.1d) Authorize the City Manager to execute a Facility Use Agreement between the
City of Salina and USD 305 regarding the use of Pestinger Family Stadium.
Mayor Longbine opened the public hearing.
Jeff Hammond, Director of Parks and Recreation, explained the request, fiscal impact, and
action options.
The conversation that followed between the City Commission and City staff focused mainly
on the division and method of payments to contractors between the City and Salina Baseball
Enterprises.

Mark Labus, Salina, Kansas, asked about USD 305's financial involvement.
City Attorney Greg Bengtson recommended revising the wording of the motion to be made
for Item 4.1d since the Facility Use Agreement was being presented to the USD 305 Board

the following day, to allow for any potential updates from them.

execute a First Amendment to the Salina Baseball Enterprises Agreement relating to Wilbur Field

24-0021 Moved by Commissioner Hoppock, seconded by Commissioner Davis, to authorize the City
Manager to execute a Facility Use Agreement as substantially presented subject to final review and
approval by the City Manager. Aye: (5). Nay: (0). Motion carried.
CONSENT AGENDA
(5.1) Approve the minutes of the meeting of January 22, 2024.
(5.2) Approve Resolution No. 24-8189 updating the City of Salina Personnel Manual.
(5.3) Consider change orders no. 2 and 3 totaling $81,478.92 with T&R Construction, Inc.
for Project No. 20029, Centennial ditch water line adjustments and sewer line
protection, increasing the previous project authorization by $27,976.96 to
$1,450,201.17 and authorizing the City Manager to execute the change orders.
(5.4) Consider awarding the bid for Project No. 24005, 2024 Chip Seal, to Circle C
Construction of Goddard, Kansas in the amount of $327,872.88 with a $16,393.64
(5%) construction contingency for a total project authorization not to exceed
$344,266.52 and authorizing the City Manager to execute a contract with Circle C
Construction of Goddard, Kansas upon fulfillment of all prerequisites under the bid
documents.
(5.5) Consider awarding the bid for Project No. 24004, 2024 Pavement Sealing, to Circle
C Construction of Goddard, Kansas in the amount of$498,544.87 with a $49,854.49
(10%) construction contingency for a total project authorization not to exceed
$548,399.36 and authorizing the City Manager to execute a contract with Circle C
Construction of Goddard, Kansas upon fulfillment of all prerequisites under the bid
documents.
(5.6) Approve Resolution No. 24-8190 appointing a member of the Planning Commission
to serve on the Heritage Commission.
(5.7) Authorize rebuild of landfill compactor Unit #1842 through Foley's Equipment
(Salina) for an amount not to exceed $595,000.00.
(5.8) Approve Resolution No. 24-8182 authorizing the Mayor to sign a First Addendum to
the Memorandum of Understanding among the City of Salina, Saline County, and
Central Kansas Mental Health Center relating to the Mental Health Co-Responder
Program.

City Manager Mike Schrage clarified that the City Commission was provided a clean
version of the Mental Health Co-Responder MOU Addendum to approve prior to the
meeting.

agenda as presented. Aye: (5).Nay: (0). Motion carried.
ADMINISTRATION
(6.1) Approve Ordinance No. 24-11194 or No. 24-11195 modifying existing City of
Salina code sections regarding keeping of chickens within City limits. Ordinance No.
24-11194 incorporates directions from the City Commission. Ordinance No. 24-
11195 incorporates further recommendations by the Animal Control Advisory and
Appeals Board.
Shawn Henessee, Assistant City Manager, explained the request, fiscal impact, and action
options.
Much of the ensuing discussion related to who would enforce the more restrictive
regulations in the proposed Ordinance 24-11194 and how; who determines what a
"reasonable person of ordinary sensibilities" is; the specifics of the proposed 10' setback;
and determining what constitutes a rear yard on a corner lot when City zoning code defines
that those lots only have side yards.
Bryan Metzger, Salina, Kansas, encouraged the adoption of the Animal Control Board's
version of the ordinance and explained methods of cleaning up after chickens.
Rosemary Mai, Salina, Kansas, commended Mr. Henessee for his work and shared her
disappointment with the way the Animal Control Board's special meeting on this topic was
handled.
LaNay Meier, Salina, Kansas, agreed with Ms. Mai regarding the Animal Control Board
special meeting. She also asked about ways to document that City-required liming is done
by chicken owners and what happens if a coop is not large enough.
Anton Frobenius, Salina, Kansas, asked if a chicken owner with a vacant lot could keep the
chickens there. Mr. Henessee stated that the proposed ordinance does require chickens to be
located at the owner's primary residence.
Mark Labus, Salina, Kansas, wondered about the "reasonable person" language and how
you legally judge what an offensive smell is.
Norman Mannel, Salina, Kansas, asked if the City would have to start surveying property
lines more while sharing his concerns with access rights and airspace.
Dawn Miller, Salina, Kansas, spoke on her illness from her extended exposure to her
neighbor's chickens and urged the City Commission to show compassion for her situation.

7 (6.2) Authorize the purchase of fire apparatus from Pierce Manufacturing through Conrad

Fire Equipment in the amount of$8,939,831.13 with a 5% contingency.
Tony Sneidar, Jr., Salina Fire Chief, explained the request, fiscal impact, and action options.
Derrick Herzog, Salina Fire Department Battalion Chief, provided extra details about the
schedule of replacement of apparatus and the considerations used when selecting a vendor.
Norman Mannel, Salina, asked if operators will need to be recertified on the new equipment.
Debbie Pack, Director of Finance, added information on the bond financing for the
apparatus.
24-0024 Moved by Commissioner Lenkiewicz, seconded by Commissioner Davis, to authorize the City
Manager to enter into a Purchasing Agreement with Conrad Fire Equipment for the specified fire
apparatus in the amount of $8,939,831.13 with a 5% contingency to purchase seven new fire
apparatus. Aye: (5).Nay: (0). Motion carried.
DEVELOPMENT BUSINESS
None.
OTHER BUSINESS
Commissioner Hoppock reminded everyone about the City Commission orientation at
Tony's Pizza Event Center upstairs on Wednesday, February 14, 2024 and Tuesday,
February 20, 2024.
Commissioner Davis followed up on block parties from citizen questions and comments.
Mayor Longbine asked if anyone noticed the unusual amount of fireworks the previous
night, due to the Kansas City Chiefs' Super Bowl win.
CITIZENS FORUM
Mark Labus, Salina, Kansas, gave comments on the lack of population growth versus
housing development and ownership of pit bulls by those who have them as service animals.
Laura Deckart, Salina, Kansas, shared her concerns with the dilapidated Ambassador Hotel
next to her home.
Richard Humphrey, Salina, Kansas, gave his thoughts on Project Pollination and garden
beds.
