ORDINANCE NO.
AN ORDINANCE EXEMPTING PROPERTY LOCATED WITHIN THE SCHILLING
SUBDIVISION FROM TAXATION AND LEVYING A TAX ON SUCH PROPERTY IN
LIEU OF THE TAXES EXEMPTED.
WHEREAS, the Surplus Property and Public Airport Authority
Act (K.S.A. 1965 Supp. 27-315 to 27-326), herein referred to as
the "Act", authorizes cities of the first class to acquire, own,
maintain, operate and improve surplus real or personal properties
of the United States or any other political subdivision; and,
WHEREAS, the Department of Defense declared the Schilling
Air Force Base surplus property which property is fully described
in the Certificate of Plat to the Schilling Subdivision which is
filed for record in Plat Book A-4 at Pages 1 to 27 in the Office
of the Register of Deeds of Saline County, Kansas; and,
WHEREAS, pursuant to the above act, the City of Salina,
Kansas, has created the Salina Airport Authority to carry out the
purposes set forth therein; and,
WHEREAS, the Salina Airport Authority, the State of Kansas
and various other political subdivisions of the State of Kansas
have acquired title to various properties located in the Schilling
Subdivision; and,
WHEREAS, the Schilling Subdivision has been duly annexed
within the corporate limits of the City of Salina; and,
WHEREAS, the above act provides that upon annexation of such
surplus property that all real property shall be exempt from any►
bonded indebtedness of the City incurred prior to the date of such
annexation and that the City may exempt any property from any
city taxes which the governing body of the city shall determine.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE
CITY OF SALINA, KANSAS:
Section 1. Purpose of Ordinance: The purpose of this ordin-
ance is to promote, stimulate and develop the general economic
welfare and prosperity of the City of Salina, Kansas, through
the promotion and advancement of the industrial enterprises lo-
cated within the Schilling Subdivision and to encourage and
stimulate location of new industrial enterprises and the expansion

of existing industrial facilities at the Schilling Subdivision,
thus promoting the economic stability of the city and the general
welfare by maintaining and providing present and greater employ-
ment opportunities in industry within the city. This purpose is
to be accomplished by creating a stable city assessment against
property located within the Schilling Subdivision in order that
industry may plan to maintain their present facilities, expand
or construct new facilities in an atmosphere of stable taxing
policy.
Section 2. Taxes Imposed Upon Pro ert S

division: All real and personal property within the Schilling
Subdivision are hereby exempted from any and all taxes that may
be levied by the City of Salina, Kansas, for a period of fifteen
years from and after January 1, 1967; provided, however, that in
lieu of the taxes exempted there is hereby levied by the City of
Salina, Kansas, against all real and personal property (except
that exempt under the laws of the State of Kansas) within the
Schilling Subdivision, the following amounts:
(a). For the taxing years commencing on January
1, 19671, January 1, 1968, January 1, 1969, January 1,
1970, and January 1, 1971, an in lieu of tax payment
in an amount equal to 12.75 mills on the assessed valu-
ation of all property.
(b). For the taxing years commencing on January 1,
1972, January 1, 1973, and January 1, 1974, an in lieu
of tax payment in an amount equal to 15.00 mills on the
assessed valuation of all property.
(c). For the taxing years commencing on January 1,
1975, January 1, 1976, January 1, 1977, January 11
1978, and January 1, 1979, an in lieu of tax payment in
an amount equal to the taxes which would otherwise be
imposed by the City of Salina in those taxing years for
its general operating fund if such property were not
exempt under this ordinance.
Section 3. Certification and Collection of Pavment in Lieu
of Taxes: The City Clerk shall annually, prior to August 25th

of each year, certify to the County Clerk of Saline County,
Kansas, the amount of the payments in lieu of taxes due under
this ordinance and said amount shall be levied against all prop-
erty (except that exempt by the laws of the State of Kansas)
located within the Schilling Subdivision and said payment in
lieu of taxes shall be collected by the County Treasurer in the
same manner as other real and personal taxes.
Section 4. Lien on Property: The payments in lieu of taxes
provided for in this ordinance shall until paid constitute a lien
on all property upon which it is imposed and shall have the same
priority and may be enforced in the same manner as daftM taxes
levied by any political subdivision in the State of Kansas all
as provided by the laws of the State of Kansas.
Section 5. Contractual Provisions:
This ordinance is passed
as an inducement to industry to maintain its present facilities
at the Schilling Subdivision as well as to expand those facilities,
and to induce new industrial enterprises and any person or com-
pany who accepts the benefits of this ordinance and hereafter
installs new industrial facilities within the Schilling Subdivision
shall enjoy the benefits of this ordinance on a contractual basis
for fifteen years from the effective date of this ordinance.
Section 6. Termination: This ordinance will expire and not
be in force and effect after fifteen years from the effective date
of this ordinance.
Section 7. Validity of Ordinance: If any clause, sentence,
or section of this ordinance shall be held to be invalid, it shall
not affect the remaining provisions of this ordinance.
Section 8. Effective Date: This ordinance shall take effect
and be in force from and after its publication in the official
city paper.
Adopted by the Board of Commissioners of the City of Salina,
Kansas, and approved by the Mayor, this day of,��
