ORDINANCE NUMBER 6894
AN ORDINANCE AUTHORIZING THE USE OF PUBLIC PROPERTY BY ABUTTING
OWNERS FOR AESTHETIC PURPOSES.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA,
KANSAS:
Section 26-1306a. The Board of Commissioners may grant a
permit to any person, firm or corporation to use a portion of any
sidewalk, street, avenue, alley or other public property abutting
upon their property for aesthetic purposes notwithstanding the
provisions of Section 26-1306 of this article. Application for
such permit shall be made to the City Clerk and shall be referred
by him to the Board of Commissioners. The application for such
permit shall be accompanied by a detailed plan and specifications
for the proposed project. If the Board of Commissioners, on con-
sideration of the application, finds that the proposed project
will be beneficial to the appearance of the city and in accordance
with any comprehensively planned development program for the area,
and will not interfere with the use of the sidewalks, street,
avenue or alley for the public purpose for which it was intended,
the Board of Commissioners may grant a permit to the applicant
for such purpose on such terms, conditions and restrictions as it
deems in the public interest: Provided, however, that any permit
granted hereunder shall be subject to revocation by the Board of
Commissioners in the event that said property is required for pub-
lic purposes or if the abutting property owners fail or neglect
to use the same for the purposes for which the permit was granted
or fail or neglect to maintain the same in a good state of repair
and in that event, then the abutting property owner shall be
required to remove any improvements made under said permit.
This ordinance shall take effect and be in force from and
after its adoption and publication in the official city paper.
Adopted by the Governing Body of the City of Salina, Kansas,
and signed by the Mayor this day of December, 1965.
