6887 Library BondsCONSOLIDATED-SALINA 1 1 ORDINANCE NUMBER (Published in The Salina Journal t ,�, 1965) AN ORDINANCE authorizing and providing for the issuance of bonds of the City of Salina, Kansas, in the sum of $675,000.00 to pay for the acquiring of a site for and constructing, furnishing and equipping a public library building in and for the City of Salina, Kansas, and all things incidental thereto, to be designated as Series LB -200. WHEREAS, at an election duly called and regularly held in the City of Salina, Kansas, on the 23rd day of February, 1965, there was submitted to the qualified electors of the City the proposition of "Shall the City of Salina, Kansas, issue its general obligation bonds in the amount of $675,000.00 for the purpose of acquiring a site for and constructing, furnishing and equipping a public library building in and for said City?", all pursuant to Ordinance Number 6844 of said City and the laws of the State of Kansas; and WHEREAS, all directives of said Ordinance Number 6844 and the laws of the State of Kansas, relative to such elections, were fully and timely complied with; and WHEREAS, at such election, a majority of the votes cast thereat upon said proposition, were cast in favor of authorizing the said City of Salina, Kansas, to issue its bonds in said sum for such purpose, all as duly and regularly determined by the Board of Commissioners as a Board of Canvassers (ex -officio) in the manner and form required by law; and WHEREAS, a competent engineer, by Resolution Number 2839, duly adopted by the Board of Commissioners of said City, was directed to and did submit unto said Board of Commissioners, under oath, a detailed estimate of the cost of said land to be acquired, and the cost of constructing, furnishing and equipping a public library building, and all things incidental thereto, all in compliance with the directives of said Resolution Number 2839; and WHEREAS, said Board of Commissioners did receive, accept and approve the detailed estimate of the cost thereof; and WHEREAS, the actual cost of said project to the City of Salina, Kansas, is the estimated sum of $675,000.00; and SO NOW, THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles are hereby made a part of this ordinance. That in the opinion of the Board of Commissioners of the City of Salina, Kansas, the public welfare can be advanced by the building of a Public Library, and all things incidental thereto, as heretofore duly authorized by the qualified electors of the City; and that said Board of Commissioners deems it necessary for said land to be so acquired and for said Public Library Building to be constructed, furnished, and equipped and improved for the purposes aforesaid. That for the purpose of paying the cost of land for a Public Library Building to be constructed, furnished, and equipped, and all things incidental thereto it is hereby ordered that Internal Improvement General Obligation Bonds of the City of Salina, Kansas, in the principal sum of $675,000.00 be issued to pay for the cost of said land and improvements, as heretofore duly authorized by the qualified electors of said City. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto and each of said bonds shall have interest coupons attached, which coupons shall be in the form required by law and each thereof shall bear the printed or lithographed facsimile signatures of the Mayor and the City Clerk of said City and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the State Auditor, as required by law. Section 3. Said bonds shall be designated as Series LB -200 and shall be in the form and contain recitals substantially as follows, to -wit: CONSOLIDATED-SALINA 1 1 1 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND No. Series LB -200 $ KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of Dollars in lawful money of the United States of America, on the first day of 19 with interest thereon from the date hereof and at the rate of per cent per annum, payable semiannually on May 1, and November 1, in each year, on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said City are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 135 bonds of like date and tenor, excepting number, interest rate and maturity, aggregating the principal sum of $675,000.00 issued by the City of Salina, Kansas for the purpose of paying the cost of constructing, furnishing and equipping a Public Library Building in said City by the authority of and in full compliance with the provisions, restrictions and 1' itations of the Co s ituty� and laws of the State of Kansas, including �� 10-101 to 10-133. hand amendments thereto, and all other provisions of the laws of said State applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the facsimile signatures of said officers and this bond to be dated the first day of November, 1965. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and when duly executed and registered to deliver said bonds to the purchaser or purchasers thereof. Section 5. The full faith, credit and resources of the City of Salina, Kansas shall be and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest on said bonds as they severally become due by levying taxes and assessments upon the property liable therefor as provided for by law.
