7008 Street ImprovementsCONSOLD)ATED-$ALINA 1 ORDINANCE NUMBER a (Published in The Salina Journal � Z3 1967) AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc., for the construction of certain improvements in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds.', BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of Brown and Brown, Inc., hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on August 14, 1967, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of the City of Salina, to said contractor and signed on behalf of the City by its Mayor on August 21, 1967, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Resurfacing Eleventh Street with hot mixed asphaltic concrete (Thirty (30) feet wide) from the south line of Morrison Street to the north line of Prescott Avenue. Resurfacing Elm Street with hot mixed asphaltic concrete (Thirty-seven (37) feet wide) from the east line of College Street to the west line of Ninth Street. Resurfacing Penn Avenue with hot mixed asphaltic concrete (Thirty-seven (37) feet wide) from the north line of Iron Avenue to the south line of Ash Street. Resurfacing Prescott Avenue with hot mixed asphaltic concrete (Thirty (30) feet wide) from the west line of Ninth Street to the east line of Eleventh Street. Resurfacing Republic Avenue with hot mixed asphaltic concrete (Thirty- seven (37) feet wide) from the east line of Ninth Street to the west line of Fifth Street. Resurfacing Sunset Drive with hot mixed asphaltic concrete (Forty (40) feet wide) from the west line of Ninth Street to the west line of Highland Circle. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $86,044.00, for such work, such notes to bear interest not to exceed 5 per cent per annum and to mature not later than December 1, 1969, and to be issued in such amounts and at such times as money for the payment of the cost of such notes being issued in such amounts and at such times as money for the payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
