7003 Utility ImprovementsIIA. CONSOLIDATED -SALIVA II ORDINANCE NUMBER `T ! (Published in The Salina Journal , 1967) AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc., for the construction of certain improvements in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds. I BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: I � IIISection 1. That the acceptance by the City of Salina, Kansas, of the proposal of Brown and Brown, Inc., hereinafter referred to as the "Contractor" as submitted to the I i Board of Commissioners on July 10, 1967, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of the City of Salina, to said contractor and signed on behalf of the City by its Mayor on July 17, 1967, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole in east parking of Westport Boulevard and on center line of easement extended east; thence in a northerly and northeasterly direction following a line 5 feet westerly from east property line of said j Westport Boulevard to a point 200 feet north of the point of tangent of first curve on Westport Boulevard north of St. Louis, where a manhole will be constructed which will be terminus of Lateral 506. Paving and grading of the Alley First EAst of Chicago Street with concrete (Sixteen (16) feet wide) from the north line of South Street j to the south line of Spruce Street. Paving of Fourth Street with concrete, (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north side of Pacific Avenue to the north side of Harsh Avenue, the same being an intervening connecting street. i Paving of Fourth Street with concrete, (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north side of Harsh Avenue to the south side of Hamilton Avenue, the same being an intervening connecting street. Paving of Fourth Street with concrete, (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north side of Hamilton Avenue to the south line of Antrim Avenue, the same being an intervening connecting street. Curbing, guttering, paving and grading of Hamilton Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west line of Fourth Street to the East line of Fifth Street, the same being an intervening connecting street. Curbing, guttering, paving and grading of Hamilton Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west line of Fifth Street to the east line of Santa Fe Avenue, the same being an intervening connecting street. Curbing, guttering, paving and grading of Westport Boulevard with concrete (Fifty-one (51) feet wide from back of curb to back of curb) from a point 328 feet north of St. Louis Street to a point 1185 feet north of St. Louis Street. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. CONSOLMATED-SALIVA 1 1 11 Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $154,913.90, for such work, such notes to bear interest not to exceed 5 per cent per annum and to mature not later than December 1, 1969, and to be issued in such amounts and at such times as money for the payment of the cost of such notes being issued in such amounts and at such times as money for the payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
