AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering,
paving and grading of Diamond Drive with concrete (Thirty-three (33) feet wide from back of
curb to back of curb) from the east line of U. S. 81 Highway east to the City Limits;
curbing, guttering, paving and grading of Eastborough Road with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the south line of Crestview Drive to the
north line of Seitz Drive, the same being an intervening connecting street; curbing,
guttering, paving and grading of the West side of Ohio Street with asphalt (Thirty-three (33�
feet wide from back of curb to back of curb) from the south line of Bonnie Ridge Addition to
the north line of Bonnie Ridge Addition; paving and grading of Missouri Avenue with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) from the south line of
Gypsum Avenue to the north line of Stack Avenue; curbing, guttering, paving and grading of
the East side of Fourth Street with concrete (Twenty (20) feet wide from back of curb to
edge of pavement) from the south line of Ellsworth Avenue to the north line of Jewell Avenuei;
curbing, guttering, paving and grading of the East side of Fourth Street with concrete
(Twenty-two (22) feet wide from back of curb to back of curb) from the south line of Jewell
Avenue to the north line of Kirwin Avenue, the same being an intervening connecting street;
curbing, guttering, paving and grading of the East side of Fourth Street with concrete
(Twenty-two (22) feet wide from back of curb to back of curb) from the south line of Beloit
Avenue to the north line of Minneapolis Avenue, the same being an intervening connecting
street; curbing, guttering, paving and grading of the East side of Fourth Street with concre e
(Twenty-two (22) feet wide from back of curb to back of curb) from the north line of Bond
Street to the south line of Crawford Avenue, the same being an intervening connecting street;
curbing, guttering, paving and grading of the West side of Fourth Street with concrete
(Twenty-two (22) feet wide from back of curb to back of curb) from the south line of Bond
Street to the north line of Republic Avenue, the same being an intervening connecting street;
paving and grading of Second Street with concrete (Thirty-three (33) feet wide from back of
curb to back of curb) from the north line of Ash Street to the south line of Elm Street;
the same being an intervening connecting street; paving and grading of Tenth Street with
asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the south line
of Franklin Street to the north line of Republic Avenue, the same being an intervening
connecting street; paving and grading of Tenth Street with asphalt (Thirty-three (33) feet
wide from back of curb to back of curb) from the south line of Crawford Avenue to the north
line of Frost Street; the same being an intervening connecting street; curbing, guttering,
paving and grading of Thirteenth Street with concrete (Thirty-three (33) feet wide from
back of curb to back of curb) from the north line of Broadway Boulevard to the south line o,
Woodland Avenue; curbing, guttering, paving and grading of Third Street with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) from the north line of
Forrest Avenue to the south line of Woodland Avenue; and relating to and providing for the
collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of
this ordinance, which is chargeable to the private property in the assessment districts for
each of such improvements, respectively, as set forth in the following sections of this
ordinance with respect to each of such improvements, there is hereby levied and assessed
on the property liable therefor, being all the lots and pieces of land lying on either
side of said streets so improved, respectively, to the middle of the block for the distance
improved with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, 8, 9, 10,
11, 12, 13, 14, 15 of this ordinance, according to the appraised value of such lots and
pieces of ground with respect to each such improvement, without regard to the buildings or
improvements thereon, special assessments covering the cost of such work and improvements,
said special assessments being based on the special valuation and appraisement of said lots
and pieces of ground therefore made by three disinterested appraisers appointed by the Boar
of Commissioners of the City of Salina, Kansas, with respect to each such improvement which
said appraisements are hereby referred to and made a part of this ordinance, and the
several amounts so levied, apportioned and assessed against the lots and pieces of ground

for each such improvement, respectively, for the purpose aforesaid, are hereby found and
determined to be the amounts set forth in the following sections of this ordinance with
respect to each of such improvements.
Section 2. For that part of the cost of curbing, guttering, paving and grading of
Diamond Drive with concrete (Thirty-three (33) feet wide from back of curb to back of curb)
from the east line of U. S. 81 Highway east to the City Limits, which is chargeable against
the private property within the district chargeable therefor, and which cost is hereby
determined to be $10,536.35, there is hereby levied, apportioned and assessed against the
following described lots and pieces of land provided for in Section 1 of this ordinance,

Section 17. There is hereby levied further and assessed against such lots and pieces
of ground described in this ordinance, interest at such rate per annum as shall be borne
by the bonds which may be issued at the end of thirty days as specified in the preceding
sections hereof, as by law provided, to the time of the collection of the installments as
provided by law, which said interest shall be collected annually at the same time and in
the same manner as said installments are collected and after the taking effect of this
ordinance and the fixing of said interest rate when such bonds are authorized and issued,
it shall be the duty of the City Clerk of said City to annually at the same time other
taxes are certified and until all said assessments so apportioned and levied have been
certified to the County Clerk of Saline County, Kansas, a full list of all property liable
to assessment and taxation for such work and improvement, except such property on which
the special assessments aforesaid have been paid in full as hereinbefore provided, together
with the respective amounts due on each of said lots and pieces of ground which amounts
shall include the annual installments of such special assessments with the interest for one
year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of
said assessments, and such amounts so certified as herein provided shall be placed upon the
tax roll by the County Clerk of Saline County, Kansas, and collected as other taxes are

collected.

jSection 18. This ordinance shall take effect and be in full force from and after its
adoption and publication once in the official city paper.
