A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LICENSE
AGREEMENT BETWEEN THE CITY OF SALINA, KANSAS AND LEONARD DAHL
FOR THE INSTALLATION OF A PRIVATE WATER LINE IN PUBLIC
RIGHT-OF-WAY.
WHEREAS, Leonard Dahl wishes to install a private waterline under
and across Johnstown Avenue between Ohio Street and Kansas Avenue; and
WHEREAS, the City wishes to grant permission to Leonard Dahl to
install and maintain the waterline in the public right-of-way subject to certain
conditions, SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the Mayor is hereby authorized to execute the
License Agreement between the City of Salina, Kansas and Leonard Dahl for the
installation of a private waterline in public right-of-way subject to the
following conditions:
A. Grantee shall maintain the waterline in good working condition
and hold the City harmless from any liability that might arise
from the use and maintenance of the waterline.
B. Materials and plans shall be approved by, or as directed by the
City Engineer.
C. Grantee shall relocate the waterline at any time the City
determines such relocation to be necessary, at Grantee's expense,
D. Grantee's access to the waterline following initial installation
for whatever purpose shall be subject to the Salina Code
provisions relating to excavations in public right-of-way.
Section 2. That this resolution shall remain in full force and effect
until repealed or amended by the Governing Body of the City of Salina, Kansas.
Adopted by the Board of Commissioners and signed by the Mayor this
17th day of October, 1994.
