7055 Utility ImprovementsI CONSOLIDATED-SALINA 1 1 ORDINANCE NUMBERgq 7055 (Published (Pub1ished i n The Salina Journal l�l(��� ,1968) AN ORDINANCE creating and defining a certain Lateral Sanitary Sewer District in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 5107, and providing for the construction of a Lateral Sanitary Sewer in said Lateral Sanitary !Sewer District Number II 507, so created and providing for the payment of the cost thereof and ,for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 507. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 507, and which district shall include all the following described property in the City of Salina, Kansas, to -wit: 1. Beginning at the intersection of the north line of Euclid Avenue and the east line of North Fifth Street; 2. Thence north along the east line of North Fifth Street 316.0 feet; 3. Thence west 260.0 feet; 4. Thence north 218.0 feet more or less to Flood Protection right-of-way; 5. Thence east along said right-of-way 200.0 feet; 6. Thence southeasterly on east line of North Fifth Street which line is extension of south right-of-way line of Flood Protection; 7. Thence east along said right-of-way 190.0 feet; 8. Thence south to a point 117.0 feet north of the north line of Euclid Avenue; 9. Thence west 50.0 feet; 10. Thence south 117.0 feet to the north line of Euclid Avenue; 11. Thence west along the north line of Euclid Avenue 138.0 feet to the point of beginning. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 507 as created by Section 1 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole in the intersection of Euclid Avneue and north Fifth Street; thence north in the east parking of said Fifth Street 500.0 feet where a manhole will be built which will be the terminus of Lateral 507. Section 3. That the City Engineer shall on or before the prepare and file in the Office of the City Clerk, plans and specifications for the construction of the Lateral Sanitary Sewer provided for in the preceding sections of this ordinance which shall be of the proper character to serve the property lying within the district for which f CONSOLIDATED-SALINA 1 1 LSI such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That there- after the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such a sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefore, if, there be any whose bids do not exceed the estimated cost 'thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof, as provided by law. Section 4. That for the cost of building and constructing such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after hawing taken oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements shall within five days after having been notified of their appointment proceed to appraise all of the lots and pieces of land withi',n the district liable to assessments and taxation as aforesaid, without regard to the buildings or improvements thereon, after making such appraisement shall return to the Board of Commissioners of the City of said Board shall designate a time for a special meeting of the Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion the same has been appraised too high or too low. Section 6. The special assessments herein provided for may be paid by the person liable therefore in ten approximately equal installments, but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full, and his property so paid on shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in an amount of the cost of such improvements remainingunpaid at the end of thirty days from the time such assessments are fixed. Section 7. For the purpose of paying for the work and improvements in the ordinanc provided for, the Board of Commissioners may and are hereby authorized and directed to issue improvementsbonds of the City of Salina, Kansas, in an amount not to ex�eed the total cost of such improvement, and to run for a period of ten years and be payabl in ten approximately equal annual installments together with interest not to exceed five per cent per annum which bonds shall be issued and payable according to law; and for the purpose of paying the principa r CONSOLIDATED-SALINA and interest on said bonds as they severally become due and payable the Board of Commissioners jshall apportion and assess against the lots and pieces of land within the taxing district for such improvements, special assessments covering the cost of such improvement and apportionment thereon contained shall hold good for all of the installments that are to be collected from the specific property chargeable therefore with such improvements; such assessments and apportionment ordinance shall contain the total amount of tax apportioned to I such tract, piece or parcel of land within the taxing district and shall state the number of i annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective numbered amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taxes are collected. Section 8. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
