94-4791 Dangerous Structures(First Published in The Salina Journal September/6, 1994) RESOLUTION NUMBER 94-4791 A RESOLUTION SETTING FORTH THE BOARD OF CITY COMMISSIONERS FINDINGS THAT CERTAIN STRUCTURES ARE UNSAFE OR DANGEROUS, DIRECTING THE STRUCTURES BE REPAIRED OR REMOVED, AND FIXING A REASONABLE TIME WITHIN WHICH THE REPAIR OR REMOVAL OF SUCH STRUCTURES SHALL BE COMMENCED AND COMPLETED. WHEREAS, on August 1, 1994 the City's Chief Building Official filed with the Board of City Commissioners a written statement that certain structures located within the City of Salina were unsafe or dangerous, and WHEREAS, of those structures included in the Chief Building Officials written statement, certain structures have either been repaired or removed. The Chief Building Official has advised the Board of City Commissioners that the following structures located upon the described real estate continue to be unsafe or dangerous: TRACT ID ADDRESS AND LEGAL DESCRIPTION - TYPE OF BUILDING 081-12-0-20-15-013 1. 703 North Second Street House & Sheds Lot 20, Block 6, Woodland Addition 086-13-0-30-11-035 2. 656 South Third Street House Lot 26, Block 1, Van Trines Addition 086-14-0-40-02-003 3. 401 South Tenth Street Garage West 90' of the North 60' of Lot 9, the East 21.45' of the South 15' of the West 90' of Lot 9, and the East 21.45' of the North 4' of the West 90' of Lot 10, Block 1, Morrison's Addition 086-14-0-40-16-011 4. 501 - 503 South Tenth Commercial Building (formerly Ideal Cleaners) Lot 14, the North 2' of Lot 13, and the North 54' of Lot 15, Block 1, Morrison's Addition Replat East 10th 081-11-0-10-14-009 5. 620 North Twelfth House Lot 17, Block 18, Pacific Addition 086-14-0-10-24-005 6. 819 Cedar House Lots 22 and 24, Cedar Street, Phillips Third Addition. 081-12-0-40-03-009 7. 318 North Oakdale Garage Lot 9, Block 1, Riverside Park Addition 086-13-0-10-07-007 8. 121B South Oakdale House East 32.5' of Lot 8 and the East 32.5' of the North 10' of Lot 9, Block 7, Oakdale Addition 086-14-0-10-02-002 9. 509 State House West 50' of Lot 1, Surveyor's Plat B All in the City of Salina, Saline County, Kansas, SO NOW, THEREFORE WHEREAS, on August 1, 1994, the Governing Body of the City of Salina, Kansas, adopted Resolution Number 94-4772, determining 4:00 p.m. on September 12, 1994, in Room 200 of the City -County Building, 300 West Ash, Salina, Kansas, to be the time and place at which the owner, the owner's agent, any lienholders of record, and any occupant of such structure could appear and show cause why such structures should not be condemned and ordered repaired or demolished, and WHEREAS, notice of the time and place of the hearing was given as required by statute; and WHEREAS, upon considering the evidence presented regarding the structures located upon the above described real estate, the Governing Body desires to make its findings and direct certain action in relation to the structures, SO NOW, THEREFORE BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That the following findings are made regarding the I structures located upon the real estate described above: j The structures were found to be structurally unsound and dilapidated and are unsafe or dangerous. Section 2. That the owner or agent is hereby directed to repair or remove the structure or structures described above, and to make the premises safe and secure. Such work shall be commenced by September 20, 1994 on all tracts and shall be diligently prosecuted, which should allow for substantial completion of the work no later than October 31, 1994. Section 3. If the owner or agent fails to commence the repair or the removal as directed within the time stated or fails to diligently prosecute the work until the work is substantially completed within the stated time period, the Governing Body will cause the structure or structures to be razed and removed pursuant to K.S.A. 12-1755 . Section 4. That this resolution shall be in full force and effect' from and after its adoption by the Board of Commissioners and the City Clerk shall cause it to be published once in the official city newspaper as required by K.S.A. 12-1753.
