11-30-2023 Special Meeting Minutes CITY OF SALINA, KANSAS SPECIAL MEETING OF THE BOARD OF COMMISSIONERS November 30, 2023 2:30 p.m. Vice-Mayor Longbine asked the Clerk for verification that notice had been sent for today's City Commission meeting. The Clerk replied yes. The Special Meeting of the Board of Commissioners was called to order at 1:00 p.m. in Room 105, City-County Building. A roll call was taken. Those present and comprising a quorum: Vice-Mayor Bill Longbine (presiding), Trent W. Davis, M.D., Greg Lenkiewicz, and Karl Ryan. Mayor Michael L. Hoppock attended via Zoom. Also present: Mike Schrage, City Manager (via Zoom); Jacob Wood, Deputy City Manager (via Zoom); Shawn Henessee, Assistant City Manager (via Zoom); Greg Bengtson, City Attorney; Scott Gardner, Director of Computer Technology; and Nikki Goding, City Clerk. ADMINISTRATION (3.1) Approve Resolution No. 23-8176 authorizing the election of the City of Salina to opt out of the settlement class in both the Dupont and 3M Aqueous Film-Forming Foams Product Liability Litigation cases and authorizing the Vice-Mayor, City staff, and legal counsel to sign and deliver any documentation necessary to complete the prescribed opt out process. City Manager Mike Schrage explained the request, fiscal impact, and action options. Greg Bengtson, City Attorney, went into further detail on the specific context and legal considerations of the request. Commissioner Ryan asked if the decision lay solely with the City Commission or if other interested City entities had been consulted. Mr. Bengtson said that, as the facilitators and providers of the City's water supply, this item should be strictly within the City Commission's discretion to decide. The discussion that followed mainly covered the relatively as-yet-unknown effects of PFAS, the City's unique position on contaminants due to ongoing environmental remediation at the Former Schilling Air Force Base, the financial costs related to any potential future suits brought against the companies in question if the City elects to opt out of the class action suit now, and the differences in testing in 2014 versus the stricter testing limits of contaminants in water in use today. 22-0361 Moved by Commissioner Davis, seconded by Commissioner Ryan, to approve Resolution No. 23- 8176 authorizing the election of the City of Salina to opt out of the settlement class in both the Dupont and 3M Aqueous Film-Forming Foams Product Liability Litigation cases and authorizing the Vice-Mayor, City staff, and legal counsel to sign and deliver any documentation necessary to complete the prescribed opt out process.
