23-8169 General Obligation Bonds to Purchase Fire-Fighting Equipment RESOLUTION NO.23-8169 A RESOLUTION DECLARING IT NECESSARY TO ACQUIRE FIRE FIGHTING EQUIPMENT FOR USE BY THE FIRE DEPARTMENT OF THE CITY OF SALINA, KANSAS, AND TO ISSUE GENERAL OBLIGATION BONDS OF SAID CITY TO PAY THE COSTS THEREOF; AND PROVIDING FOR THE GIVING OF NOTICE OF INTENTION TO ACQUIRE SAID EQUIPMENT AND TO ISSUE SAID TT,, GENERAL OBLIGATION BONDS THEREFOR. WHEREAS, K.S.A. 12-110c (the "Act") authorizes any city operating a fire department to acquire fire-fighting equipment for the use of such fire department and to pay the cost thereof by the issuance of general obligation bonds of the city, provided, that, no such bonds shall be issued until the city has first published a notice of its intention to acquire such equipment and to issue its general obligation bonds therefor; and WHEREAS, the City of Salina, Kansas (the "City") operates a fire department (the "Fire Department"), and the governing body of said City hereby finds and determines it to be necessary to acquire fire-fighting equipment for use by the Fire Department and hereby further finds and determines it to be necessary to issue general obligation bonds of the City in order to provide funds to pay all or a portions of the cost thereof; and hereby further finds and determines it to be necessary to provide for the giving of notice of said intention in the manner prescribed by the Act. THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA,KANSAS; Section 1. Declaration of Necessity. It is hereby declared to be necessary to acquire fire- fighting equipment(the"Equipment")for use by the Fire Department, under the provisions of the Act. Section 2. Financing Authority. The estimated cost of acquiring the Equipment is$10,000,000. The costs of the Equipment will be paid from the proceeds of general obligation bonds (the "Bonds") of the City in an amount not to exceed$10,000,000 plus cost of issuance and interest on any temporary financing to be issued by the City for said purpose. Section 3. Reimbursement Authority. The Bonds authorized herein may be issued to reimburse expenditures made on or after the date that is 60 days before the date of this Resolution pursuant to Treasury Regulation §1.150-2. Section 4. Notice of Intent. A notice of the intention to acquire the Equipment and issue the Bonds to pay the costs thereof, interest on interim financing and associated financing costs shall be published once each week for two (2) consecutive weeks in the official City newspaper. If, within sixty (60) days following the date of such last publication,a petition signed by not less than five percent(5%)of the qualified electors of the City is filed with the City Clerk, then no such Bonds shall be issued until the issuance thereof shall have been approved by a majority of the qualified electors of the City voting on the question of such issuance at an election to be called and held for that purpose.
