05-10256 Annex Lee Ind Park(Published in the Salina Journal on February A 2005) ORDINANCE NUMBER 05-10256 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF THREE TRACTS OF LAND ON THE WEST SIDE OF NORTH MARYMOUNT ROAD, IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the following described tracts of land, to -wit: Tract 1: All that part of The Lee Industrial Park, according to the plat thereof recorded in the office of the Register of Deeds of Saline County, Kansas, on April 1, 1964, in Book A-3 of Plats at Page 36, lying in the Northeast Quarter (NE'/4) and the East Half (EI/2) of the Northwest Quarter (NWI/4 ) of Section Seven (7), Township Fourteen (14) South, Range Two (2) West of the 6th P.M., in Saline County, Kansas, which tract is more particularly described as follows: Beginning at a stone found at the N'/4 corner of said Section 7; thence westerly along the north line of the NW'/4 of said Section a distance of 210.9 feet to a point on the east line of the Missouri Pacific Railroad right-of-way; thence southwesterly along the east R/W line of the Missouri Pacific Railroad, a distance of 315.0 feet; thence southerly along the east R/W line of the Missouri Pacific Railroad a distance of 1,022.32 feet to a point on the south line of the NE'/4 of the NW'/4 of said Section 7; thence westerly along the south line of the NE'/4 of the NW'/4 of said Section 7 a distance of 33.0 feet; thence southerly along the east R/W line of the Missouri Pacific Railroad a distance of 74.4 feet to a point on the curve of the north R/W line of the main line of the Missouri Pacific Railroad; thence northeasterly along the arc of a curve having a radius of 2,914.93 feet, said arc being the north R/W line of the Missouri Pacific Railroad main line a distance of 289.0 feet; thence easterly along the north R/W line of the Missouri Pacific Railroad main line a distance of 2,677.8 feet to a point on the east line of the NEI/4 of said Section 7; thence northerly along the east line of the NEI/4 of Section 7 a distance of 1,346.66 feet more or less to the northeast corner of said Section 7; thence westerly along the north line of said Section 7 to the point of beginning, containing 91.1 acres more or less. Tract 2 A fee simple interest in a tract of land in Lee Industrial Park, according to the plat thereof recorded in the office of the Register of Deeds of Saline County, Kansas, on April 1, 1964, in Book A-3 of Plats at Page 36, lying South and West of the City of Salina Flood Control right of way, situated in the South Half (S/2) of the Southeast Quater (SE/4) of Section Six (6), Township Fourteen (14) South, Range Two (2) West of the 6th P.M. in Saline County, Kansas, and more particularly described as follows: Beginning at the Southeast comer of said Southeast Quarter; Thence Northerly along the East line of said Southeast Quarter, on an assumed bearing of N 00°15'01" W, a distance of897.59 feet; Thence S 89°44'59" W, along the South line of said Flood Control right of way line, a distance of 233.28 feet; Thence N 24°24'23" W, along said right of way line, a distance of 305.81 feet to a point on the existing southerly Union Pacific Railroad right of way line; Thence S 68°20'28" W, along said right of way line, a distance of 872.12 feet; Thence Southeasterly along a 658.16 -foot radius non -tangent curve to the right, an arc length of 827.82 feet and having a chord which bears S 34°37'32" E, a distance of 774.32 feet; Thence S 01'24'26" W, a distance of 98.51 feet; Thence S 07°46'01" W, a distance of 123.41 feet to a point on South line of said Southeast Quarter; Thence N 89°38'14" E, along said South line, a distance of753.25 feet to the POINT OF BEGINNING. Said tract contains 19.87 acres, more or less, including existing road light of way. Tract 3 A fee simple interest in a tract of land in Lee Industrial Park, according to the plat thereof recorded in the office of the Register of Deeds of Saline County, Kansas, on April 1, 1964, in Book A-3 of Plats at Page 36, lying South and West of the City of Salina Flood Control right of way, situated in the South Half (S/2) of the Southeast Quarter (SE/4) of Section Six (6), Township Fourteen (14) South, Range Two (2) West of the 6th P.M. in Saline County, Kansas, and more particularly described as follows: Commencing at the Southeast comer of said Southeast Quarter; Thence Northerly along the East line of said Southeast Quarter, on an assumed bearing of N 00°15'01" W, a distance of 897.59 feet; Thence -S 89°44'59" W, along the South line of said Flood Control right of way line, a distance of 233.28 feet; Thence N 24°24'23" W, along said right of way line, a distance of 305.81 feet to a point on the existing southerly Union Pacific Railroad right of way line; Thence S 68°20'28" W, along said right of way line, a distance of 1027.93 feet; Thence N 00'13'46" W, along said right of way line, a distance of90.61 feet to the Point of Beginning; Thence N 00'13'46" W, along said right of way line, a distance of 27.56 feet; Thence S 68°20'28" W, along said right of way line, a distance of 64.07 feet; Thence Southeasterly along a 658.16- foot radius non -tangent curve to the right, an arc length of 59.81 feet and having a chord which bears S 86°15'06" E, a distance of 59.79 feet to the POINT OF BEGINNING; Said tract contains 0.02 acres, (794 square feet), more or less. meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas. Section 2. That the tract of land described in Section 1 above shall be zoned "I-3" HEAVY INDUSTRIAL DISTRICT upon annexation into the city. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
