AN ORDINANCE relating to the curbing, guttering, paving and grading of Anderson Avenue
(Thirty-three (33) feet wide from back of curb to back of curb) from a point 25 feet east
of the west line of Lot 11, Block 5, College View Addition to the east line of Third Street,
and the paving with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter)'
from the east line of Fourth Street to a point which is 25 feet east of the west line of
Lot 11, Block 5, College View Addition; the resurfacing of Country Club Road with hot mixed
asphalt (Twenty-nine (29) feet wide from face of curb to edge of pavement) from the west line
of Marymount Road 1,908 feet, more or less, to the west line of Overhill Road; the curbing,
guttering, paving and grading of North Thirteenth Street with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the south line of Pacific Avenue north
335 feet; and relating to and providing for the collection and payment of such assessments.
WHEREAS, the Board of Commissioners has determined that the total cost of such improvements
is Sixty-five Thousand Twenty-six and 46/100 Dollars ($65,026.46) and that 36.59 per cent,
in the amount of $23,795.22, be assessed against the improvement district and 63.41 per cent,'
in the amount of $41,231.24, be paid by the City at Large, and
WHEREAS, the Board of Commissioners has, after due notice, met and determined the amount of
special assessments, SO NOW, THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
lots and pieces of land provided for in Section 1 of this ordinance, the following amounts:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of
this ordinance, which is chargeable to the private property in the assessment districts for
each of such improvements, respectively, as set forth in the following sections of this
ordinance with respect to each of such improvements, there is hereby levied and assessed

on the liable therefor, being all the lots and of land lying on either
property pieces side
of said street so improved, respectively, to the middle of the block for the distance improvedll
with respect to the improvements mentioned in Sections 2, 3, 4 of this ordinance, according
to the appraised value of such lots and pieces of ground with respect to each such improvementll,
without regard to the buildings or improvements thereon, special assessments covering the

I cost of such work and improvements, said special assessments being based on the special
valuation and appraisement of said lots and pieces of ground therefor made by three
disinterested appraisers appointed by the Board of Commissioners of the City of Salina,

Kansas, with respect to each such improvement which said appraisements are hereby referred
to and made a part of this ordinance, and the several amounts so levied, apportioned and
assessed against the lots and pieces of ground for each such improvement, respectively for
the purpose aforesaid, are hereby found and determined to be the amounts set forth in the

following sections of this ordinance with respect to each of such improvements.

Section 2. For that part of the cost of curbing, guttering, paving and grading of

Section 5. Said amounts so levied, apportioned and assessed as aforesaid will be
due and collectible in ten equal installments, the first becoming due with the taxes levied
for the year 1970, and one of said installments falling due each and every year thereafter
until all are paid and all to be collected with interest as in this ordinance provided,
HOWEVER, that the owner of any piece of property liable for any such assessment may redeem
his property from such liability by paying to the City Treasury the entire amount chargeable
against the same, as in this ordinance provided, at any time within thirty days after the
publication of this ordinance and before the issuance of bonds of said City in payment of
the balance of the cost of said improvements, the property so paid on shall not thereafter
be liable for any further assessment for the cost of such improvements nor for any part of

said bonds.
Section 6. There is hereby levied further and assessed against such lots and
pieces of ground described in this ordinance, interest at such rate per annum as shall be
borne by the bonds which may be issued at the end of thirty days as specified in the preceding
sections hereof, as by law provided, to the time of the collection of the installments as
provided by law, which said interest shall be collected annually at the same time and in the
same manner as said installments are collected and after the taking effect of this ordinance
and the fixing of said interest rate when such bonds are authorized and issued, it shall be
the duty of the City Clerk of said City to annually at the same time other taxes are certified',
and until all said assessments so apportioned and levied have been certified to the County
Clerk of Saline County, Kansas, to certify a full list of all property liable to assessment
and taxation for such work and improvements, except such property on which the special
assessments aforesaid have been paid in full as hereinbefore provided, together with the
respective amounts due on each of said lots and pieces of ground which amounts shall include
the annual installments of such special assessments with the interest for one year at the
rate to be fixed as provided for in this ordinance, on all unpaid balances of said assessments,
and such amounts so certified as herein provided shall be placed upon the tax roll by the
County Clerk of Saline County, and collected as other taxes are collected.
Section 7. This ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
