AN ORDINANCE creating and defining a certain Lateral Sanitary Sewer District in the City of
Salina, Kansas, designated as Lateral Sanitary Sewer District Number 509, and providing for
the construction of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer District Number
509, so created and providing for the payment of the cost thereof and for the levying of
special assessments against the property in said district for the payment of the cost of
such construction and for the issuing of bonds to pay the colt thereof.
BE IT ORDAINED by the Board of Commissioners of the City of ialina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 509. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District Number 509, and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
One half of benefit district will be said Lots 1
through 11, Block 8, and Lot 1, Block 7, Meadowlark
Acres Addition and one half of benefit distri�t is
tract of ground bounded by Highland Avenue on the west,
Fourth S-1reet on the east, the south lines of said
Lots 1 through 11, Block 8 and line 40 feet south
of the south line of said Lots 1 through 11, dock 8,
Meadowlark Acres Addition, City of Salina, Saltine
County, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch Sanitary
Pipe Sewer with all necessary connections, manholes, flushingltanks and other appurtenances
be constructed and built in and to serve said Lateral Sanitary Sewer District Number 509 as
created by Section 1 of this ordinance along the following course, to -wit:
An 8 inch pipe sewer beginning at an existing manhole
in the intersection -of Wayne Avenue and Fourth Street;
Thence south in Fourth Street to line extended of
south side of Lots 1 through 11, Block 8, Meadowlark
Acres Addition; thence west along the said line of said
lots to a point 10 feet west of the east line 'of said
Lot 1, where a manhole will be built which wild be
terminus of Lateral 509.
Section 3. That the City Engineer shall on or before the 16th day of December,
1968, prepare and file in the Office of the City Clerk, Plansland Specifications for the
construction of the Lateral Sanitary Sewer provided for in th� preceding sections of this
ordinance which shall be of the proper character to serve the property lying within the
district for which such sewer is to be constructed and shall on or before the same date
prepare and submit to the Board of Commissioners a detailed etimate under oath of the cost
thereof. That, thereafter the City Clerk shall advertise for 1hree consecutive days in the
official city paper for sealed proposals for the building and 'construction of such a sewer
according to such plans and specifications, which proposals stjall be filed with the City Clerk
on or before the time fixed in such notice, at which time the'Board of Commissioners may let
a contract for the building and construction of such sewer to 'the lowest and best responsible
bidder or bidders therefor, if, there be any whose bids do not exceed the estimated cost
thereof, but said Board shall reserve the right to reject any or all such proposals, and if
no bid shall be received within such estimate, the Board of Commissioners shall have the
power to do such work and make such improvements within the e timated cost thereof, as provide
by law.
CONSOLIDATED-SALINA
Section 4, That for the cost of building and constructing such sewer, special.
assessments shall be made for the full cost thereof on all lots and pieces of land within
and for which such sewer shall be built, according to the appraised value thereof, without
regard to the buildings or improvements thereon.
Section, 5. After the passage and publication of thus ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, who after having taken oath to
make a true and impartial appraisement of all lots and pieces' of land liable to taxation
for the cost of such improvements shall within five days after having been notified of their
appointment proceed to appraise all of the lots and pieces of land within the district liable
to assessments and taxation as. a foresaid, without regard tol,the buildings or improvements
thereon, after making such appraisement shall return to the Board of Commissioners of the
City and said Board shall designate a time for a special meeting of the Board for the purpose
of hearing any complaints that may be made as to the value of any l-ot or piece of land
appraised as aforesaid of which special aession due notice shall be given in the official
city paper, at which special session said Board may alter any valuation of any lot or piece
of land, if, in their opinion the same has been appraised too high or too low.
Section 6_ The special assessments herein provided for may be paid by the person
liable therfor in ten approximately equal installments, but the owner of any property liable
to such assessment may within thirty days from the date of determining the amount assessed
against the property, pay the same in full, and his property so paid on shall not be liable
for any assessments for the cost of such improvements, and bonds as hereinafter provided for
shall be issued in an amount of the cost of such improvements', remaining unpaid at the end of
thirty days from the time such assessments are fixed,
Section 7. For the purpose of paying for the work and improvements in the ordinance
provided for, the Board of Commissioners may and are hereby aluthorized and directed to issue
improvement bonds of the City of Salina, Kansas, in an amountt,not to exceed the total. cost of
such improvements, and to run for a period of ten years and be payable in ten approximately
equal annual installments together with interest not to exceed five per cent per annum which

bonds shall be issued and payable according to law; and for t�e purpose of paying the principa
and interest on said bonds as they severally become due and pllayable the Board of Commissioners
shall apportion and assess against the lots and pieces of land within the taxing district for
such improvements, special assessments covering the cost of :such improvement and apportionmen
thereon contained shall hold good for all of the installmentslthat are to be collected from

the specific property chargeable therefor with such improvements; such assessments and

apportionment ordinance shall contain the total amount of tax apportioned to each tract,
piece or parcel of land within the taxing district and shall tate the number of annual-
installments
nnualinstallments in which such tax is to be collected; and thereafter the City Clerk shall. annually,
at the same time that other taxes are certified, certify to t�e County Clerk of Saline County,

Kansas a full list of all property liable for such work and limprovement, together with the
respective numbered amounts due on each of said tracts, pieces or parcels of land, which
amounts shall include the annual installments and interest on all unpaid balances for one
year at the rate of not to exceed five per cent per annum on such amounts so certified, which
amounts shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in full force from and after its
adoption and publication once in the official city paper.
