8113 Utility ImprovementsCONSOLIDATED-SALINA i 1 1 1 ORDINANCE NUMBER 8113 (Published in The Salina JournalY]Q� a� 1970) AN ORDINANCE ratifying and confirming a contract with Brown e Brown, Inc., for the construction of certain improvements in the City of Salina, Kansas, and providing for the issuance of Temporary Notes to pay the cost thereof, pending the issuance and Sale of Bonds BE IT ORDAINED by the Governing Body of the City of Salina,Kansas: Section 1. That the acceptance by the City of Safina, Kansas, of the proposal I of Brown & Brown, Inc., hereinafter referred to as the ''Contractor'' as submitted to the Board of Commissioners on October 19, 1970, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of the City of Salina, to said contractor and signed on behalf of the City by its Mayor on October 26, 1970, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: The excavation and compacted fill on Upper Mill Heights Drive from the north line of Upper Mill Heights Addition Number 2, to the center line of Crawford Avenue and Upper Mill Terrace Drive from Upper Mill Heights Drive to the Cul-de-sac. The 26 ft. wide asphalt pavement with 6 inch x 12 inch concrete headers, on Upper Mill Heights Drive from the north line of Upper Mill Heights Addition Number 2 to the south line of Upper Mill Terrace, and Upper Mill Terrace from the west line of Upper Mill Heights to the Cul-de-sac. The installation of a 6 inch water main in Upper Mill Drive from the north line of Upper Mill Heights Addition Number 2, to the south line of Upper Mill Terrace, and in Upper Mill Terrace from the center line of Upper Mill Heights Drive to the Cul-de-sac. The installation of sanitary sewer lines to serve Lots 1 - 11 in Upper Mill Heights Addition Number 2. The installation and construction of storm sewers, drainage pipes, wash checks, flumes and ditch) lining to provide adequate drainage for the area. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of such improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk,' which estimates are hereby referred to and made a part of thiis ordinance. Section 2. Said improvements shall be built and constructed in accordance with i the plans and specifications therefor prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposal of said contractor and under the terms 1, I of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk I be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $95,6601.35, plus change orders as i approved by the Board of Commissioners and necessary expenses connected with the project, i such notes to bear interest at not to exceed 6 percent per annum and to mature not later than December 1, 1971, and to be issued in such amounts and at such times as money for the 1 payment of the cost of such notes being issued to said contr ctor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. CONSOLIDATED-SALINA 1 1 Section 4. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official cit newspaper.
