j ORDINANCE NUMBER 8074

AN ORDINANCE levying special assessments against certain property to pay the cost of
constructing certain sidewalks in the parking abutting the following property, to -wit:
A four foot concrete property line sidewalk on the south
side of Cloud Street beginning at a point 640 feet east
of the east line of Hageman Avenue; thence west to the
east line of Hageman Avenue.
A four foot concrete property line sidewalk on the east
side of Hageman Avenue, beginning at the south line of
Cloud Street; thence south 360 feet, more or less.
WHEREAS, the Board of Commissioners have, by Resolution Number 3016, caused to be notified
the owners of the property hereinafter described to cause their respective portion of said
sidewalks to be constructed at their own expense and have fulfilled all conditions precedent
to the construction of said sidewalks,
WHEREAS, the owners of the property hereinafter described did not within thirty days, as
required by Resolution Number 3016 cause said sidewalks to be constructed and the City caused
said sidewalks to be constructed pursuant to K. S. A. Chapter 12, Article 18, and the cost
thereof has been ascertained,
WHEREAS, the Board of Commissioners has determined that the total cost of such improvements
is Two Thousand One Hundred Twenty-one and 86/100 Dollars ($2,121.86) and that 50.8 percent,
in the amount of $1,078.44 be assessed against the improvement district and 49.2 percent in
the amount of $1,043.42 be paid by the City -at -large, and SO NOW, THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That there be and there is hereby levied and assessed against the lots
hereinafter described, an assessment for the purpose of paying the cost of constructing said
sidewalks, taxable against the following described lots in the amount set opposite said lots:
j The North 200 feet of the West 388 feet of the
NE4 of the NE4 of Section 26, T 14 S, R 3 W - - - - - $805.46
The North 200 feet of the East 252 feet of the
West 640 feet of the NE4 of the NEof Section 26,
T 14 S, R 3 W - - - - - - - - - - - - - - - - - - - - $272.98
A ten foot strip of land on the west line of the
NE4 of the NE4 of Section 26, T 14 S, R 3 W, more
accurately described as follows:
Beginning at the south line of Cloud Street
and the east line of Hageman Street;
Thence south along said east line of Hageman
Avenue 385 feet, more or less to the northeast
right-of-way of Broadway Boulevard;
Thence in a southeasterly direction along said
right-of-way to a point which is 10 feet east
of the east line of said Hageman Avenue;
Thence north along a line 10 feet east of said
east line of Hageman Avenue to the south line
of Cloud Street;
Thence west 10 feet to the point of beginning --$1,043.42

Section 2. That the owner or owners of the property above described shall have
thirty (30) days after the publication of this ordinance within which to make full payment.

Section 3. That the City Clerk is directed to mail a notice not less than fifteen
days prior to the end of the thirty (30) days to the owners of the property as shown on the

records of the Office of the Register of Deeds.
Section 4. That if full payment of the assessment made in Section 1 of this
ordinance is not made within thirty days after the publication of this ordinance, the City
Clerk is hereby directed and authorized to certify said assessments to the County Clerk of
Saline County, Kansas to be placed on the tax roll for collection in four installments,
starting with the year 1970, and subject to the same penalties and collected in like manner
as other taxes.
Section 5. That this ordinance shall take effect and be in full force and effect
from and after its adoption and publication once in the official city newspaper.
