AN ORDINANCE ratifying and confirming a contract with A. W. Saum & Sons for the construction
of certain improvements in the City of Salina, Kansas, and providing for the issuance of
temporary notes to pay the cost thereof, pending the issuance and sale of bonds.

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

Section 1. That the acceptance by the City of Salina, Kansas, of the proposal

of A. W. Saum & Sons, hereafter referred to as the ''Contractor'' as submitted to the Board
of Commissioners on January 5, 1970, which is hereby found to be the lowest and best bid
for such work, and the contract awarded by the Board of Commissioners of the City of Salina,
to said contractor and signed on behalf of the City by its Mayor on January 19, 1970, for
the construction of certain public improvements in the City of Salina, Kansas, to -wit:
A concrete sidewalk on the north side of Ralph Avenue, and
adjacent to Lots 10, 11, 12, 13, 14, 15, 16, 17, and 18,
Block 3, Southern View Addition to the City of Salina,
Saline County, Kansas.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of such improvements
as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk,
which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with
the plans and specifications therefor prepared by the City Engineer on file in the Office
of the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk
be issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $2,456.00, plus change orders as
approved by the Board of Commissioners, and necessary expenses connected with the project,
to mature not later than December 1, 1970, and to be issued in such amounts and at such times
as money for the payment of the cost of such notes being issued to said contractor and to be
redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
