8058 Parking of VehiclesCONSOLIDATED-SALINA 1 1 ORDINANCE NUMBER 8058 (Published 1n The Salina Journal huuner- c:12�Q , 1969) AN ORDINANCE REGULATING THE PARKING OF VEHICLES IN THE CITY OF SALINA, KANSAS; PROVIDING FOR THE METHOD OF DESIGNATING PARKING ZONES AND TIME LIMITATIONS THEREFOR; PROVIDING PENALTIES FOR VIOLATION THEREOF; AMENDING ARTICLE VI OF CHAPTER 22 OF THE SALINA CODE AND REPEALING SAID ORIGINAL SECTION. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Article VI of Chapter 22 of The Salina Code is hereby amended i. to read as follows: "ARTICLE VI. PARKING Section 22-169. Definitions. For the purpose of this article the following words and phrases shall have their meaning respectfully ascribed to them as follows: Vehicle. Any device by which any person or property may be transported upon a public highway, except those operated upon rails or permanent tracks. Operator. Every individual who shall operate a vehicle as the owner thereof, or as the agent, employee or permittee of the owner, or is in physical control of a vehicle. Park or Parking. The standing of a vehicle, whether occupied or not, upon a street or public parking lot otherwise than temporarily for the purpose of, and while engaging in, receiving or discharging passengers or loading or unloading merchandise or in the obedience to traffic regulations, signs or signals or an involuntary stopping of the vehicle by reason of causes beyond the control of the operator. Parking Space. Any space duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the street adjacent to or adjoining the parking space. Parking Zone. Any restricted street or municipal parking lot designated by the Board of Commissioners limiting parking to a specified period of time. Section 22-170. Application of Article. The provisions of this article shall apply at all times or at those times or places herein specified or as indicated on official signs; Provided that the provisions of this article imposing a time limit on parking shall not relieve any person from the duty to observe other or more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles in specified places or during specified times. Section 22-171. Authority of Board of Commissioners; Parking Zones. The Board of Commissioners may, by resolution, prohibit, limit or otherwise regulate the stopping, standing or parking of vehicles on all streets, city property, parks and other public places where deemed necessary and in so doing may designate zones or places where the drivers of vehicles shall not park, stand or stop any vehicle at any time or during specified times, and may limit the length of time which any vehicle may park within any specified parking zone. CONSOLIDATED-SALINA 1 Section 22-172. Manager to Sign and Mark Parking Zones. The City Manager shall sign, mark and post all parking zones as directed by resolution of the Board of Commissioners and shall indicate by appropriate signs the time limitations for parking within the respective parking zones. Section 22-173. Designation of stalls; duty to park within. The City Manager shall have markings painted or placed upon the curb and/or upon the street for the purpose of designating the parking space and each vehicle parking therein shall park within the lines or markings so established. It shall be unlawful and a violation of this article to park any vehicle across any such line or marking or to park said vehicle in such position that the same shall not be entirely within the area so designated by such lines or markings. Section 22-174. Penalty for improper parking. It shall be the duty of the police officers of the City, acting in accordance with instructions issued by the City Manager, to report any vehicle which shall be parked in violation of Section 22-173 by showing the license number of such vehicle and the time and place where such vehicle was parked in violation of the provisions of this article. Each such owner or operator may, within twenty-four (24) hours of the time when such notice was attached to such vehicle, enclose said notice with one dollar ($1.00) and deposit the same in the courtesy fine collection box attached to certain parking meter posts or pay the same to the desk sergeant at the police station as a penalty for and in full satisfaction of such violation. If said penalty is not paid within twenty-four (24) hours of the time when such notice was attached to such vehicle, the penalty for such violation shall be two dollars ($2.00) payable to the desk sergeant at the police station, and the failure of such owner or operator to make such providions within said twenty-four (24) hours shall render said owner or operator subject to the penalties hereinafter provided for violations of the provisions of this article. Section 22-175. Front wheel to be against curb. All vehicles parked in a prescribed parking space shall be parked so that the right or left front wheel of the vehicle is resting against the curb. Section 22-176. Overtime parking prohibited. It shall be unlawful and a violation of the provisions of this article for any person to cause, allow, permit, or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking zone as herein described or to permit a vehicle to remain or be placed in any parking space beyond the period of time prescribed for such parking space. In parking zones created under this article, each maximum period of time indicated for such zone in which a vehicle is permitted to remain illegally parked shall constitute a separate and distinct offense and it shall be the duty of the Police officer to place a violation ticket thereon for each such violation. Section 22-177. Erasing mark placed on parked vehicle by City Officer. No person shall erase or cause to be erased a chalk mark or other mark placed on or about a vehicle or a time of a vehicle by an officer of the City, which mark has been placed thereon for the purpose of parking regulations while vehicle is standing or parked in a designated parking zone. Section 22-178. Length of vehicles in municipal lots. No vehicle shall be parked within any municipal parking lot if the vehicle shall be of an overall length in excess of twenty (20) feet. CONSOLIDATED-SALINA Section 22-179. Police to report violations. It shall be the duty of police officers of the City, acting in accordance with instructions issued by the City Manager to report any vehicle occupying a parking space in a parking zone in violation of any of the provisions of this article, and to indicate the state license number of such vehicle, the time during which such vehicle is parking in violation of any of the provisions of this article, and any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. Section 22-180. Notice of violation; payment in lieu of penalty. Each police officer shall attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parked in violation of the provisions of this article. Each such owner or operator may, within twenty-four (24) hours of the time when such notice was attached to such vehicle enclose said notice with one dollar ($1.00) and deposit the same in the courtesy fine collection box attached to certain parking meter posts or pay the same to the desk sergeant at the Police station as a penalty for and in full satisfaction of such violation. Section 22-181. Penalty. Any person who shall violate any of the provisions of this article and any person who aids, abets or assists therein, shall, upon conviction thereof, be subject to a fine of not exceeding fifty dollars ($50.00) for each offense or violation or be imprisoned for not exceeding fifteen (15) days." Section 2. This ordinance shall be in full force and effect from and after February 1, 1970 and its publication in the official city newspaper. Section 3.
