AN ORDINANCE PROVIDING THE PROCEDURE FOR THE REMOVAL OR REPAIR OF UNSAFE OR DANGEROUS
STRUCTURES LOCATED WITHIN THE CITY OF SALINA, KANSAS; AMENDING SECTION 12-63 (2) and
12-63 (3) OF THE SALINA CODE AND REPEALING SAID ORIGINAL SECTIONS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That Sections 12-63 (2) and 12-63 (3) of The Salina Code are hereby
amended to read as follows:
"Section 12-63 (2).
The Board of Commissioners, if it is of the opinion
that the building, wall or other structure should be
rendered safe and secure or removed, shall adopt a
resolution fixing a date, hour and place for a hearing
and giving a description of the land on which the building,
wall or other structure is situated, and such other
description as may be deemed advisable and stating that
the owner, his agent, or lienholder of record and any
occupant of such structure may appear and show cause
why such structure should not be condemned and ordered
repaired or demolished.
Section-
12 63 (3).
The Resolution provided for in Section 12-63 (2)
shall be published once a week for two consecutive weeks
on the same day of each week. At least thirty days shall
elapse between the last publication and the date set for
the hearing. A copy of said Resolution shall be mailed
by certified mail within three days after its first
publication to each such owner, agent, lienholder and
occupant at his or its last known place of residence
and shall be marked "Deliver to Addressee Only';
PROVIDED that if
the owner is a resident of Saline
Count the
County, Resolution shall be personally served within
five days on such order or delivered to their last known
address in lieu of mailing the same, and in this case at
j least one week shall elapse between the service on such
owner and the date
set for the hearing.''
Section 2. That Sections 12-63 (2) and 12-63 (3) of the Salina Code are hereby
repealed.
Section 3. This ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper.
