10-16-2023 Minutes CITY OF SALINA, KANSAS k REGULAR MEETING OF THE BOARD OF COMMISSIONERS October 16,2023 4:00 p.m. Mayor Hoppock asked the Clerk for verification that notice had been sent for today's City Commission meeting. The Clerk replied yes. Taw The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City-County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Michael L. Hoppock (presiding), Trent W. Davis, M.D., Greg Lenkiewicz, Bill Longbine, and Karl Ryan. Also present: Mike Schrage, City Manager; Jacob Wood, Deputy City Manager; Shawn Henessee, Assistant City Manager; Greg Bengtson, City Attorney; and Nikki Goding, City Clerk. AWARDS AND PROCLAMATIONS None. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME 111 None. CONSENT AGENDA (5.1) Approve the minutes of the meeting of October 9, 2023. (5.2) Approve Resolution No. 23-8151 reaffirming the Saline County Solid Waste Management Plan with no changes. (5.3) Authorize adding scope in the amount of$115,000.00 to Project No. 23016 - 2023 Mill and Inlay. 23-0309 Moved by Commissioner Ryan, seconded by Commissioner Davis, to approve the consent agenda as presented. ADMINISTRATION (6.1) Consider awarding the bid for the demolition of the former Oakdale Ice Skating Rink to Diehl Enterprises, Inc. in the amount of $77,750.00 with a $3,887.50 (5%) construction contingency for a total project authorization not to exceed $81,637.50 and authorizing the City Manager to execute a contract with Diehl Enterprises, Inc. upon fulfillment of all prerequisites under the purchasing policy. Jeff Hammond, Director of Parks and Recreation, explained the request, fiscal impact, and action options. A short discussion followed on the use of the space for the short-term future and the depth of the concrete that's currently there. Page 1 I I I Norman Mannel, Salina, KS, asked about what will be done with the old concrete, citing concerns about groundwater contamination. He also wondered about Native American artifacts that could be buried there. N Commissioner Davis asked for clarification on the scope of work, wanting to make sure the W entire rink would be removed, and not just the concrete border around it. 23-0�10 Moved by Commissioner Lenkiewicz, seconded by Commissioner Longbine, to award the bid for demolition of the former Oakdale Ice Skating Rink to Diehl Enterprises, Inc. DEVELOPMENT BUSINESS (7.1) Approve Ordinance No. 23-11178 on first reading, relating to Application #Z23-7, filed by Chief Tony Sneidar, Jr. on behalf of the Salina Fire Department, requesting a change in zoning district classification from A-1 (Agricultural) to P-(PF) [Public Use —Public Facilities] to allow the construction of a new fire station facility. The subject property is a 4.57-acre tract of land at the north end of the Berkley Family Recreational Area. Dean Andrew, Planning and Zoning Administrator, explained the request, fiscal impact, and action options. Commissioner Longbine asked for an update from Fire Department staff. Fire Chief Sneidar provided an update on the current status of design. Jacob Wood, Deputy City Manager, added additional details on the project's timeline. 23-0311 Moved by Commissioner Longbine, seconded by Commissioner Davis, to approve Ordinance No. 23-11178 on first reading. (7.2) Approve Ordinance No. 23-11179 on first reading, relating to Application #06-08A, filed by the Salina City Commission, requesting approval of an amendment to the boundary and effective area of the North Ohio Street Gateway Overlay District to add a 19.80-acre tract of land on the west side of North Ohio Street that was recently annexed into the city to the overlay district area. Mayor Hoppock recused himself, having done so through all previous meeting items relating to the Beck's Hybrid Seeds facility, and turned the meeting over to Vice-Mayor Longbine. Vice-Mayor Longbine noted that he attended the groundbreaking ceremony for the Beck's Hybrid Seeds facility last week and shared that everyone involved is very excited for them to be in Salina. 23-0312 Moved by Commissioner Davis, seconded by Commissioner Ryan, to approve Ordinance No. 23- 11179 on first reading. OTHER BUSINESS U) Commissioner Davis mentioned some issues brought up by citizens during a recent electoral candidate forum, such as the eventual plans for the tennis courts at Sunset Park and a follow- up on possibly extending hours of OCCK transportation for overnight workers. Commissioner Ryan highlighted that improvements currently being done to Magnolia Road are greatly appreciated, especially by motorcyclists. Mayor Hoppock asked about an update on the Former Schilling Air Force Base clean-up on behalf of a citizen. City Manager Mike Schrage advised that Mayor Hoppock provide the citizen with the video from the September 25, 2023 City Commission meeting, where Director of Utilities Martha Tasker provided an updated timeline of the work being done. CITIZENS FORUM Danette Toone, Mentor, Kansas, asked some questions relating to the battery energy storage system (BESS) site turned down by the Saline County Planning and Zoning Commission recently, and expressed concerns over tax dollars and fire hazards relating to such a facility. Debbie Corrales, Salina, Kansas, asked why citizen board commissioners are not alerted that their terms are ending, why the citizen boards and commissions have term limits, and why they don't receive a letter of recognition at the end of their terms. Rose Base, Salina, Kansas, thanked the City Commission for the open hours at the Animal Shelter while highlighting new employee Andi's good work there. She was also concerned about the number of pit bulls at the shelter. Norman Mannel, Salina, Kansas, brought forward his concerns on surveillance and radar drones. Ricky Miller, Salina, Kansas, followed up on his continuing concerns about his neighbor's chickens. The City Commission and City Manager decided a study session would be in order to look at the language in the City Code relating to chickens to see if it needs to be tightened up. Ben Windholz, Salina, Kansas, asked about fees charged to USD 305 for a recent special event at TPEC where the application had been submitted very close to the date of the event. EXECUTIVE SESSION (10.1) Request for Executive Session—Attorney/Client Privileged 23-0313 Moved by Commissioner Lenkiewicz, seconded by Commissioner Longbine, that the City Commission recess into executive session for 25 minutes following a 7 minute break to discuss with special legal counsel the subject of confidential legal considerations relating to points of negotiation with Salina Destination Development, LLC, regarding the City's multi-family housing project, based upon the need for consultation with an attorney for the public body which would be deemed Page 3 I I I privileged in the attorney-client relationship pursuant to K.S.A. 75-4319(b)(2).
