10-09-2023 Minutes CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS October 9,2023 4:00 p.m. Vice-Mayor Longbine asked the Clerk for verification that notice had been sent for today's City Commission meeting. The Clerk replied yes. R The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City-County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Vice-Mayor Bill Longbine (presiding), Greg Lenkiewicz, and Karl Ryan. Mayor Michael L. Hoppock and Trent W. Davis, M.D. were absent. Also present: Mike Schrage, City Manager; Jacob Wood, Deputy City Manager; Shawn Henessee, Assistant City Manager; Greg Bengtson, City Attorney; and Nikki Goding, City Clerk. AWARDS AND PROCLAMATIONS (3.1) Recognition of the week of October 15-21, 2023, as National Friends of the Library Week. Gretta Kontas, President of the Friends of the Library, read the proclamation and discussed related activities. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (4.1) Municipal Naming—Tower Field and Wilbur Field (4.1a) Conduct a public hearing for naming initiatives brought forth by Salina Baseball Enterprises, Inc. for two facilities located at Berkley Family Recreational Area. (4.Ib) Approve Resolution No. 23-8156 for the honorary naming of the field known as Tower Field as "Roger Wilbur Field" and for the philanthropic naming of the field currently named Roger Wilbur Field as "Pestinger Family Stadium" subject to the precondition of the certification of available funding for renovations to the current "Roger Wilbur Field" in accordance with the Municipal Facility Naming Guidelines. Vice-Mayor Longbine opened the public hearing. Jeff Hammond, Director of Parks and Recreation, explained the request, fiscal impact, and action options. Byron Tomlins, Board Member of Salina Baseball Enterprises, Inc., provided additional background on the work leading up to the request and the desire to change the names of the fields to aid in fundraising. • Vice-Mayor Longbine asked if Salina Baseball Enterprises' work and fundraising schedule is still on track to play baseball in the spring. Kenny Hancock, Board Member of Salina Baseball Enterprises, elaborated that work will hopefully start in November 2023, weather permitting, and be done before May 31, 2024. CONSENT AGENDA (5.1) Approve the minutes of the meeting of October 2, 2023. (5.2) Approve Resolution No. 23-8154 authorizing City staff to prepare and submit a grant application to the Kansas Department of Commerce (KDOC) for the 2023 Community Development Block Grant - Housing Rehabilitation, Demolition or Neighborhood Development Grant (CDBG — Housing); and authorize the City Manager to accept a grant award, execute the grant agreement, direct any administrative actions, and execute any documents necessary to implement the terms of the agreement. (5.3) Award the bid for Project Number 23003, Cedar Ridge Drive, for$403,310.17 with a $20,200.00 (5%) construction contingency for a total project authorization not to exceed $423,510.17 and authorizing the City Manager to execute a contract with T&M Concrete Construction Company of Junction City upon fulfillment of all prerequisites under the bid documents. (5.4) Authorize the Mayor to execute an agreement between the City and Salina Baseball Enterprises, Inc. relating to Wilbur Field and James Matson Field with clarifications identified after the Governing Body previously authorized execution of the agreement. 23-0302 Moved by Commissioner Lenkiewicz, seconded by Commissioner Ryan, to approve the consent agenda as presented. ADMINISTRATION (6.1) Approve Ordinance No. 23-11177, on second reading, amending the City of Salina Municipal Code sections 6-333, 6-361, and 6-379, to define parades and rolling parades, identify the permit level applicable to block parties and rolling parades, and establish how an event is determined to be a rolling parade, and repealing the existing sections. Vice-Mayor Longbine stated Ordinance No. 23-11177 was passed on first reading on October 2, 2023. Since that time, no comments have been received. 23-0303 Moved by Commissioner Lenkiewicz, seconded by Commissioner Ryan, to approve Ordinance No. 23-11177 on second reading. (6.2) Approve Ordinance No. 23-11166, on second reading, amending Chapter 38, Article I of the City of Salina Municipal Code by adopting the 2023 Standard Traffic Ordinance for Kansas Cities published by the League of Kansas Municipalities and repealing existing section 38-1. (6.3) Approve Ordinance No. 23-11167, on second reading, amending Chapter 25, Article I of the City of Salina Municipal Code by adopting the 2023 Uniform Public Offense Code for Kansas Cities published by the League of Kansas Municipalities and repealing existing section 25-1. Vice-Mayor Longbine stated Ordinance No. 23-11167 was passed on first reading on October 2, 2023. Since that time, no comments have been received. 23-0305 Moved by Commissioner Lenkiewicz, seconded by Commissioner Ryan, to approve Ordinance No. 23-11167 on second reading. DEVELOPMENT BUSINESS (7.1) Augustine Addition (7.1a) Accept the offered easement and restricted access dedications from the Mark Augustine Trust (Mark Augustine) to serve the proposed Augustine Addition, a 4 lot subdivision of a 25.91 acre tract of land located at the southwest corner of Water Well Road and South 9th Street(Old US Highway 81). (7.1b) Approve Ordinance No. 22-11105, on second reading, requesting a change in zoning district classification from A-1 (Agricultural) to PC-5 (Planning Service Commercial) zoning district on a 25.91 acre tract of land located at the southwest corner of 9th Street and Water Well Road. Dean Andrew, Planning and Zoning Administrator, explained the request, fiscal impact, and action options. 23-0306 Moved by Commissioner Ryan, seconded by Commissioner Lenkiewicz, to concur with the recommendations of the Planning Commission and accept the offered easement and restricted access dedications from the Mark Augustine Trust to serve the proposed Augustine Addition. OTHER BUSINESS Commissioner Ryan asked about procedural differences between the County Planning Commission and the Salina City Commission regarding defeated motions and appeals. City Manager Mike Schrage elaborated on the processes. Vice-Mayor Longbine thanked everyone involved in the Boom Salina mural event. Page 3 I I I CITIZENS FORUM Debbie Corrales, Salina, Kansas, shared information in honor of Pitbull Education Month and provided supplementary printed material. Michelle Timson, Minneapolis, Kansas, highlighted her experiences visiting the Animal Shelter now that it is reopened to the public for walk-ins. 77 Sydney Soderburg, Salina, Kansas, expressed disappointment that paintings by local artist Birger Sandzen were sent away by the Salina Public Library for auction and wondered if 0 they could be recalled and kept in Salina somehow.
