8180 Local Service DistrictC:ONSOLIDATEF-SALINA ORDINANCE NUMBER 8180 (Published in The Salina Journal g 1971) AN ORDINANCE PROVIDING FOR A ZONING DISTRICT TO BE KNOWN AS "EE, LOCAL SERVICE DISTRICT", AMENDING THE ZONING ORDINANCE OF THE CITY OF SALINA, KANSAS, THE SAME BEING ORDINANCE NUMBER 6613. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the Zoning Ordinance of the City of Salina, Kansas, the same being Ordinance Number 6613, is hereby amended by adding a section to be numbered Section 11-a, which said section shall read as follows: "Section 11-a. District "EE". (Local Service District) Statement of Intent: This district provides an area for location of light automotive -oriented sales businesses, and custom work type business uses, which draw their customers from traffic on major thoroughfares and which find a location on a major trafficway especially useful and necessary to draw business trade. (A). Permitted Uses: 1. Automobile, camping trailers and motor homes sales and service. 2. Automobile wholesale and retail parts sale. 3. Automobile service stations (see Use Limitations). 4. Automobile wash. 5. Assembly halls. 6. Beauty and barber shops. j 7. Bicycle and motorcycle sale and repair. 8. Branch banks and financial institutions. 9. Commercial recreation (all activity must be in an enclosed building such as a bowling alley, billiards room, skating rink, etc.) 10. Convenience food stores and delicatessans. 11. Drug Stores. 12. Equipment rentals (excluding cranes, dozers and similar heavy equipment). 13. Gift and souvenier shops. I 14. Shops and light custom work. 15. Laundry and dry cleaning establishments. 16. Light repair (fix -it shops). (See Use Limitation). 17. Miniature golf courses. i 18. Motels and hotels. j 19. Muffler shops (sale and installation). I 20. Package liquor stores and mixer shops. CONSOLIDATED-SALINA 1 1 21. Pawn shops. 22. Restaurants (including drive-ins). 23. Service clubs. 24. Taverns. 25. Tires (sale and installation). 26. Accessory uses customarily incidental to those listed above. 27. Signs as permitted in adopted regulations. 28. Parking as permitted in off-street parking regulations. (B). Conditional Uses: 1. Private clubs. (C). Lot Size Requirements: Minimum lot width: 100 feet (D). Bulk Regulations: Maximum building height: 40 feet Maximum lot coverage: 50 percent (E). Setback Requirements: Front setback: 20 feet or, with frontage road 20 feet from curb line, whichever is greater. Side setback: None except: 20 feet when abutting upon a residential district. Rear setback: None except: 20 feet when abutting upon a residential district. Minimum street setback: 20 feet. (F). Use Regulations: 1. No structure shall be used for residential purposes except accommodations offered to transient public by motels and hotels. 2. Repair work shall be governed by the following: a. No major exterior repair work shall be visible from the street. b. Storage of parts and inoperable products shall be indoors. C. No salvage shall be allowed. 3. Screening, in accordance with the screening regulations, shall be provided along all property lines which abut upon a residential district. C:ONSOLIDATLD-SALIVA 1 1 4. All lighting shall be so located and directed as to avoid casting direct light upon any property located in a residential district or upon any street, EXCEPT illuminated signs which meet the requirements of the Sign Code. 5. All storage of materials and equipment shall be restricted to rear yards and shall be screened in accordance with screening regulations. EXCEPTIONS: a. A complete and operable product may be displayed not less than 4 feet from the front property line and/or behind any minimum street setback. EXCEPTION: If the display or parking area is surfaced with a durable, all-weather and dustless material a product may be displayed not less than 4 feet from any property line. b. The above restrictions may be temporarily waived by the Building Official, Planning Commission or City Commission for conditions arising from labor strikes, acts of God or similar unforseeable interruptions in normal business performance. 6. Automobile service stations shall be governed by the following: a. All storage tanks for gasoline shall be below the surface of the ground. b. No major repair work shall be performed out of doors. C. All dismantled vehicles and similar articles shall be stored within a building. d. Gasoline pumps, air pumps, water service and other fixtures and/or displays used in connection with the station shall be located not less than 12 feet from the property line of any street or road upon which ithe service station abuts. CONSOLIDATED -SALIVA 1 1 (G). Definitions: Plantings: Any material outlined in the approved materials list adopted by Resolution of the Planning Commission. Storage: To leave or deposit for a period of more than 30 days." Section 2. This ordinance shall take effect and be in force from and after its adoption and publication in the official city newspaper.
