8179 GO Bonds P-214R C.QNSOLIDATEI:• SAUNA ORDINANCE NUMBER 8179 (Published in The Salina Journal '9 , 1971) AN ORDINANCE authorizing the issuance of Internal Improvement Bonds,of the City of Salina, Kansas, in the sum of $245,861.00, to pay the cost of sanitary sewer, sanitary sewer pumping station and force main, water main, storm sewers, and street improvements in the City to be designated as Series P-214. WHEREAS, the cost of sanitary sewer improvements, as per Ordinance Numbers 8018, 8022, 8112, has been determined to be $3,808.86, and WHEREAS, the cost of sanitary sewer pumping station and force main improvements, as per Resolution Numbers 3054, 3057, 3060, and Ordinance Numbers 8089 and 8131 has been determined to be $24,676.03, and WHEREAS, the cost of water main improvements as per Resolution Numbers 3061, 3062, 3063, and Ordinance Numbers 8097, 8144 has been determined to be $11,092.29, and WHEREAS, the cost of street improvements, water and sanitary sewers and storm sewers, as per Resolution Numbers 3070, 3072, and Ordinance Numbers 8113, 8165 has been determined to be $97,185.36, and WHEREAS, the cost of street improvements, as per Resolution Numbers 3015, 3058, 3059, 3076, and Ordinance Numbers 8142, 8145, 8171 has been determined to be $112,089.94, and WHEREAS, the cost of sanitary sewer improvements, as per Ordinance Numbers 8121, 8137, 8162, has been determined to be $3,039.85, and WHEREAS, the total cost of said sanitary sewer, sanitary sewer pumping station and force main, water main, storm sewers, and street improvements, which are to be paid by special assessments and to be levied upon lots and pieces of ground for the payment of said streets and grading in said streets, and sewers, has been ascertained and has been hereby found and determined to be the sum of $150,246.28, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in the Ordinances of the City of Salina, Kansas, relating thereto, duly passed and approved, of which amount the sum of $4,632.13 has been duly paid by the property owners liable therefor, leaving a balance of $145,614.15, for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $245,861.00 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby adopted as a part of this ordinance and that for the purpose of providing funds to pay the cost of improvements) hereinabove referred to and described in the ordinances and resolutions of said City and hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $245,861.00 which shall consist of 246 bonds numbered 1 to 246 inclusive, all dated December 1, 1971, shall bear interest as follows: Bonds Numbered 1 to 121, inclusive, shall bear interest at the rate of 3-5/8 percent per annum, Bonds Numbered 122 to 171, inclusive, shall bear interest at the rate of 3-1/2 percent per ani �um, Bonds Numbered 172 to 221, inclusive, shall bear interest at the rate of 3.60 percent per annum, Bonds Numbered 222 to 246, inclusive, shall bear interest at the rate of 3-5/8 percent per aninum, I j WHEREAS, the total cost of sanitary sewer, sanitary sewer pumping station and 1 force main, water main, storm sewers, and street improvements has been ascertained and the portion thereof, in the amount of $101,646.05, of which the Water and Sewerage Department paid $1,399.20, leaving a balance of $100,246.85, to be apportioned to the City -at -large to be paid by general taxes to be levied upon all taxable property within the said City for the improvement of squares and areas formed by the crossing of streets and alleys for the improvement of any of said streets, where the same is through or adjacent to property of the City, for which the City is liable, for which bonds are to be issued; and WHEREAS, the total cost of said sanitary sewer, sanitary sewer pumping station and force main, water main, storm sewers, and street improvements, which are to be paid by special assessments and to be levied upon lots and pieces of ground for the payment of said streets and grading in said streets, and sewers, has been ascertained and has been hereby found and determined to be the sum of $150,246.28, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in the Ordinances of the City of Salina, Kansas, relating thereto, duly passed and approved, of which amount the sum of $4,632.13 has been duly paid by the property owners liable therefor, leaving a balance of $145,614.15, for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $245,861.00 are to be issued to pay the actual cost thereof. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, I which coupons shall be in the form provided by law and shall bear the printed or lithographedi facsimile signatures of the Mayor and City Clerk of said City and said bonds and interest coupons shall be registered in the Office of the City Clerk and in the Office of the Auditor j I of State, as required by law. Section 3. Said bonds shall be designated as Series P-214 and shall be in the form and shall contain recitals substantially as follows, to -wit: CONSOLIDATED-SALINA 1 u UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND No. Series P-214 $ KNOW ALL MEN BY THESE PRESENTS: That the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of Dollars in lawful money of the United States of America, on the first day of 19 , with interest thereon from the date hereof and at the rate of percent per annum, payable semiannually on June 1 and December 1, in each year, on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said City are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 246 bonds of like date and tenor, excepting number, denomination, interest rate and maturity, aggregating the principal sum of $245,861.00, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain sanitary sewer, sanitary sewer pumping station and force main, water main, storm sewer, and street improvements in said City by the authority of and in full compliance with the provisions, restrictions and limitations of the Constitution and laws of the State of Kansas, including K. S. A. 10-101 to 10-127; 12-601 to 12-608; 12-617 to 12-620; 12-626 to 12-629; 13-1011 and 13-1011a; 13-1013 to 13-1018; and 12-6a01 to 12-6a18 and amendments thereto, and all other provis;ons of the laws of said State applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest on said bonds as they severally become due by levying taxes and assessments upon property liable therefor, as provided for by law. Section 6. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city newspaper.
