BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Findings. The following findings support the annexation of the property described in Section 2 by the City of Salina: 1. The property is the site of a proposed hybrid seed business and the prospective property owner wishes to receive City utilities and services. 2. Annexation is being requested by the prospective property owner in order to allow the property to connect to existing City water and sewer lines and to receive City police and fire protection. 3. The property is located in the City's Urban Service Area and is contiguous to the existing city limits on the west and south. 4. The annexation request area is an addition to an island annexation area and the Saline County Commission has made the requisite findings and determinations as required by K.S.A. 12-520c. Section 2. Annexation. The following legally described tract, meeting one or more of the classifications of annexation prescribed by K. S .A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas: That portion of Section 36, Township 13 South, Range 3 West of the 61h Principal Meridian, located in the City of Salina, Saline County, Kansas, being described by John E. Pratt, PS 1722 on May 10, 2023 as follows: Commencing at the Point of Beginning said point being the North sixteenth comer of said Southeast quarter, said point also being the Southeast comer of said Replat of Foley Addition; thence on the West line of the East half of the Southeast quarter of said Section 36, S 00°06'51" E 149 .17 feet; thence continuing on said West line, S 00°06'51" E 367.78 feet; thence N 89°43'43" W 834.33 feet; thence N 89°43'43" W 564.71 feet; thence N 60°33'42" W 100.33 feet; thence N 51°40'22" W 122.95 feet to a point on the southerly right-of-way line of Interstate Highway 70; thence on said southerly right-of-way line, N 61°34'06" E 75.00 feet to a point of curvature; thence continuing on said southerly right-of-way line, northeasterly on the arc of a non-tangent curve to the left having a radius of 3970.08 feet, an arc length of 663.91 feet, and being subtended by a chord which bears N 63°11'59"E663.13 feet; thence continuing on said southerly right-of-way line, N 58°34'51" E 752.04 feet; thence on continuing on said southerly right-of-way line, N 64°18'27" E 24 7.41 feet; thence continuing on said southerly right-of-way line, N 59°53'46" E 68.56 feet; thence S 05°08'34" W 12.40 feet to the Northwest comer of the Replat of Foley Addition; thence on the West line of said Foley Addition, S 00°07'35" E 475.28 feet to the Point of Beginning . The above described tract contains 19.80 acres more or less. Section 3. Zoning. All property described in Section 2. shall be classified as lying in an A-1 (Agricultural) zoning district upon annexation. Section 4. Repealer. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 5. Summary of ordinance for publication. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. Ordinance No. 23-11161 Summary On July 24, 2023, the City of Salina, Kansas passed Ordinance No. 23-11161. The ordinance annexes a 19.80 acre tract ofland on the south side ofl-70 between North Ohio Street and North 5th Street into the city limits in order to obtain City utilities and services.
