8203 Fire Equipment PurchaseTti L' SALINA 1 1 _ ORDINANCE NUMBER 8203 (Published in The Salina Journal LzdP� , 1972) AN ORDINANCE DECLARING AN EMERGENCY TO EXIST IN REGARD TO NECESSARY FIRE DEPARTMENT EQUIPMENT; PROVIDING FOR THE PURCHASE OF CERTAIN EQUIPMENT FOR THE CITY OF SALINA, KANSAS, AND PROVIDING FOR THE PAYMENT THEREFOR. WHEREAS, the City of Salina, Kansas, in order to properly protect and service the city and the public, has imposed upon it by law the duty of maintaining a properly equipped, modern fire department; and WHEREAS, the said fire department is lacking in certain equipment necessary to the efficient operation of said fire department; and WHEREAS, the said city is without funds for the purchase of said necessary and essential equipment; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. That an emergency within the meaning of K.S.A. 1971 Supp. 12-110a exists which makes it necessary in order to properly protect and service the city and the public, to purchase certain fire department equipment consisting of one (1) Aerial Quint equipped with 1,250 GPM Centrifugal Class "A" fire pump, a one hundred foot (100'), all steel, hydraulic, midship mounted aerial ladder and a three hundred (300) gallon water tank, and one (1) triple combination pumper equipped with a 1,250 GPM Centrifugal Class "A" fire pump and a 500 gallon water tank and miscellaneous equipment to be used in maintaining the necessary efficiency for the proper fighting of fires. Section 2. That said equipment shall be purchased in accordance with the recommendations of the Fire Chief with the approval of the Governing Body, and that the amount to be expended for such purpose shall not in any event exceed the sum of $150,000.00 Section 3. That on passage and publication of this ordinance the City Clerk shall file an application with the State Board of Tax Appeals, State of Kansas, pursuant to K.S.A. 1971 Supp. 12-110a requesting permission to make such an expenditure. Said application shall be in writing and contain a copy of this ordinance, together with the recommendation of the Chief of the Fire Department of said city. Section 4. That, if upon hearing being had, the said State Board of Tax Appeals shall determine that such expenditure is necessary to properly protect said city, the City Clerk is hereby authorized to advertise for bids for the purchase of such equipment as shall be indicated by the Governing Body; and where bids are required by law to be taken, the contract therefor shall be let to the lowest responsible bidder as determined by said Governing Body, the right being reserved to reject any and all bids; and as to any such equipment for the purchase of which bids are not required, the Governing Body shall let contract of purchase as provided by law. Section 5. That by the statutory provisions of law and more particularly under the authority of K.S.A. 1971 Supp. 12-110a, the Governing Body shall for the purpose of defraying the cost and expense of said purchase of one (1) Aerial Quint equipped with 1,250 GPM Centrifugal Class "A" fire pump, a one hundred foot (100'), all steel, hydraulic, midship mounted aerial ladder and a three hundred (300) gallon water tank, and one (1) triple combination pumper equipped with a 1,250 GPM Centrifugal Class "A" fire pump and a 500 gallon water tank and miscellaneous equipment issue no -fund warrants of the City of Salina, Kansas, in an amount or amounts not to exceed the contract price thereof, and in no event in an amount greater than $150,000.00. Said warrants shall draw interest at the rate of not to exceed eight percent (8%) per annum, and shall mature serially at such yearly dates as to be payable by not more than five (5) tax levies as provided in K.S.A. 1971 Supp. 12-110a. The Governing Body shall levy and assess general assessments MD-JALINA 1 1 1 in an amount sufficient to retire said warrants, and the City Clerk shall certify the assessments to the County Clerk of Saline County, Kansas, in said amount and in the same manner and subject to the same penalty as other city taxes; and the tax levy in accordance herewith shall not fall within or be counted in the total of taxes levied by the City of Salina for ascertaining its total aggregate levy. Section 6. This ordinance shall take effect and be in force from and after its passage and publication once in the official city newspaper.
