8272 Mobile Home Craftsman11 SALINA 1 11 1 ORDINANCE NUMBER 8272 (Published in The Salina Journal Iq . 1973) AN ORDINANCE PROVIDING FOR THE EXAMINATION AND LICENSING OF MOBILE HOME CRAFTSMEN; PROVIDING FOR THE CREATION OF A BOARD OF EXAMINERS AND PRESCRIBING THEIR DUTIES; PROVIDING FOR THE ISSUANCE, REVOCATION AND COSTS OF MOBILE HOME CRAFTSMEN LICENSES; PROVIDING FOR THE REQUIREMENT OF PERMITS AND INSPECTION OF WORK PERFORMED BY MOBILE HOME CRAFTSMEN AND THE COSTS THEREOF. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That The Salina Code is hereby amended by adding the following article, as follows: "Chapter 9 Article XIV MOBILE HOME CRAFTSMEN "Section 9-411. License required. It shall be unlawful for any person, firm or corporation to labor at the trade of a mobile home craftsman without first securing a Mobile Home Craftsman license, as provided in this article; provided however, nothing contained in this article shall prohibit an electrician, plumber or gas fitter from performing the services for which he is licensed in a mobile home. "Section 9-412. Classes established. There are hereby established the following classes of mobile home craftsmen: Section 9-412 (1). P1obiZe Home Craftsman. A mobile home craftsman shall certify at least one (1) year of practical experience in the field of mobile home repair. Such experience will include plumbing, gas, electrical, mechanical and structural repair to mobile homes. Graduation from an approved trade school or a combination of training and experience may qualify an individual to take an examination for a license. Section 9-412 (2). Apprentice MobiZe Home Craftsman. An apprentice mobile home craftsman is any person earning his livelihood as a mobile home craftsman, but who has not acquired the necessary longevity or experience to qualify as a mobile home craftsman. Except by special written consent issued by the Mobile Home Craftsman Board of Examiners, he shall not work except under the immediate supervision and direction of a licensed mobile home craftsman, properly licensed by the City. No person who has had his license revoked for cause shall be allowed to work as an apprentice mobile home craftsman without the express consent of the Mobile Home Craftsman Board of Examiners. Each qualifying person making application to the City Inspection Department shall be issued an apprentice mobile home craftsman working permit, and it shall be renewed from time to time as shall be required for the mobile home craftsman license as set out elsewhere 41 2sn-SALINA C 1 1 in this article. A person shall be qualified if he is in the employ of a mobile home craftsman. There sha!I be a charge of one dollar ($1.00) for each permit and 'or each renewal thereof. The Mobile Home Craftsman Board of Examiners may suspend or revoke any apprentice mobile home craftsman working permit for just and reasonable cause. "Section 9-413. Mobile Home Craftsman Board of Examiners created; Membership There is hereby created a Mobile Home Craftsman Board of Examiners to consist of three (3) persons, one of which will be appointed by the Mayor, with the approval of the Board of Commissioners, to pass upon the qualifications as elsewhere set forth in this article, of all persons engaged in the repair, installation, or replacement of mobile homes or their components. The membership of the Board shall consist of the City Plumbing and Gas Inspector, the City Electrical Inspector, and a licensed mobile home craftsman. Members shall be appointed for a term of one year. "Section 9-414. Board to hold meetings. It shall be the duty of the members of the Mobile Home Craftsman Board of Examiners, under such rules and regulations as they shall prescribe, to hold meetings as necessary, on days to be announced by the Mobile Home Craftsman Board of Examiners, for the purpose of passing upon the qualifications of parties desiring licenses to perform the duties of mobile home craftsmen. "Section 9-415. Board to conduct examinations. Scope. It shall be the duty of the Mobile Home Craftsman Board of Examiners to conduct examinations of applicants for mobile home craftsmen licenses. The examination shall consist of questions, problems and demonstrations designed to show the extent of the applicant's knowledge concerning the detailed provisions of this article and the applicable City Codes, the practical experience in this type of work which the applicant has had, and the degree of proficiency he has attained. The examinations shall be given on the basis of the current code at the time which the examination is given. "Section 9-416. Issuance of license. After certification by the Mobile Home Craftsman Board of Examiners, licenses may be issued by the City Clerk. Upon issuance of said license, the holder thereof shall be authorized to perform repairs to mobile homes including, without limitation, mechanical and structural repairs, and to make repairs and replacements to the electrical, plumbing and gas systems located within the mobile home and to make the normal exterior connections to existing mobile home park systems if the connection may be made at the lot. The holder of this license shall not be authorized to install or repair any part of the mobile home park electrical, plumbing, or gas systems, "Section 9-417. License fees. Applicants for Mobile Home Craftsman licenses shall pay to the City Clerk five dollars ($5.00) per year. Mobile Home Craftsman apprentice shall pay to the City Clerk one dollar ($1.00) per year. Renewals shall be at the same rate as the original license. 1 1 1 "Section 9-418. Expiration, renewal of licenses. Mobile Home Craftsmen licenses shall be valid until December 31, of the year issued and shall be renewed not later than January 31, of the following year, or said license shall be void and a new application must be made and the applicant must prove himself qualified before a license may be issued. "Section 9-419. Suspension, revocation of license. Any mobile home craftsman and apprentice may be suspended for a definite length of time, or have his license revoked outright by the Mobile Home Craftsman Board of Examiners, for good and sufficient cause. Such decisions are subject to written appeal to the Board of Commissioners and such appeal shall be filed in writing with the Mobile Home Craftsman Board of Examiners within ten (10) days after the decision has been rendered. Any and all such appeals arising from such rulings of the Mobile Home Craftsman Board of Examiners shall be expedited and completed not later than Thirty (30) days after the appeal has been filed with the Mobile Home Craftsman Board of Examiners. "Section 9-420. Permit required. No craftsman shall perform any installation or repair to any mobile home without first obtaining a permit from the Building Inspection Department. "Section 9-421. When permit not required. This article shall not be construed to mean that a permit shall be required before replacing minor defective devices. The installation of new appliances requires a permit in every case. Any direct connection to the gas, water, or electrical supply lines will require a permit in every case. "Section 9-422. Record of permits required. A complete record shall be kept by the Inspection Department of all permits issued. "Section 9-423. Permit fee established. The permit fee for the moving in and connection to the gas, water, or electrical mains of a mobile home shall be three dollars ($3.00). For permits covered under the electrical, gas, or plumbing section of this code the established fee schedule will apply. "Section 9-424. Payment of fee. Failure to pay. All permit fees shall be due and payable to the City Clerk, not later than the tenth of the month following the month in which the permit was issued. Failure of any craftsman to remit payment of permit fees by the specified date will be a violation of this article. "Section 9-425. Inspection Department inspect. It shall be the duty of the Building Inspection Department to inspect or cause to be inspected any work for which permits were required by this Code. "Section 9-426. Inspection, approval required. Any work performed under this Code will require inspection. TED -SAUNA n J 1 "Section 9-427. Concealinq work before inspection. No craftsman shall conceal or cause to be concealed any work performed under this Code prior to inspection and approval. "Section 9-428. Certificate of approval required before setting meters or connecting current. Prior to supplying electrical current, gas, or water to a newly parked mobile home a certificate of approval will be issued by the Building Inspection Department. "Section 9-429. Insurance required. It shall be required of the holder of the mobile home craftsman license as a condition of the issuance thereof, that he shall procure and maintain in full force for the duration of the license, bodily injury liability insurance in the minimum amount of twenty-five thousand dollars ($25,000.00) each person per accident, fifty thousand dollars ($50,000.00) limit per accident, as well as property damage liability insurance in the minimum amount of twenty-five thousand dollars ($25,000.00) per accident. Proof of coverage shall be approved by the City Attorney. "Section 9-430. Bond reauired. Before any craftsman shall be granted a mobile home craftsman license, said craftsman shall execute a good and sufficient surety bond in the sum of five thousand dollars ($5,000.00), the same to be approved by the City Attorney, conditioned upon the good and faithful performance of work done by him, upon any mobile home within the city, the payment of all fees connected therewith, and to hold the City harmless on account of any damage arising from faulty work or neglect of duty in the protection of the public. "Section 9-432. Non-resident mobile home craftsman and apprentice. A non-resident mobile home craftsman and/or apprentice is a person holding a valid license from other than the City of Salina. Such craftsman or apprentice license shall be honored; provided that the issuing city shall have entered into an agreement with the City of Salina, granting reciprocal privileges to the holders of valid Salina mobile home craftsman and apprentice licenses, and further provided that the issuing city shall conduct examinations to determine the qualifications of its licensees, such qualifications shall parallel those of the City of Salina. Any decision as to doubtful qualifications of a licensee shall be determined by the Mobile Home Craftsman Board of Examiners. Nothing in this section shall exempt the non-resident mobile home craftsman and/or apprentice from obtaining the proper licenses from the City of Salina." Section 2. This ordinance shall take effect and be in full force from and after its adoption and publication in the official city newspaper. (SEAL) Attest: D. L.
