95-4928 Dangerous Structuresconwraaim5aona (First Published in The Salina Journal September ^2?, 1995) RESOLUTION NUMBER 95-4928 A RESOLUTION SETTING FORTH THE BOARD OF CITY COMMISSIONERS FINDINGS THAT CERTAIN STRUCTURES ARE UNSAFE OR DANGEROUS, DIRECTING THE STRUCTURES BE REPAIRED OR REMOVED, AND FIXING A REASONABLE TIME WITHIN WHICH THE REPAIR OR REMOVAL OF SUCH STRUCTURES SHALL BE COMMENCED AND COMPLETED. WHEREAS, on August 7, 1995 the City's Building Official filed with the Board of City Commissioners a written statement that certain structures located within the City of Salina were unsafe or dangerous, and WHEREAS, of those structures included in the Building Official's written statement, certain structures have either been repaired or removed. Delaware Garage Lot 21, Block 3, Stack Place Addition 094-18-0-20-20-015.00-0-01 20. 1301 Greeley Avenue House Lots 25, 26 & 27, Block 7, Stack Place Addition 094-18-0-20-16-022.00-0-01 21. 318 Missouri Avenue Shed Lot 12 & N. 5' Lot 14, Block 3, Stack Place Addition 094-18-0-20-13-002.00-0-01 22. 1106 Stapler Ave. Outbuilding & Garage Lot 1 & W 50' Lot 2, Block 4, and vacated 20' alley west of Lot 2, Block 4, Phillips Addition All in the City of Salina, Saline County, Kansas, SO NOW, THEREFORE WHEREAS, on August 7, 1995, the Governing Body of the City of Salina, Kansas, adopted Resolution Number 95-4901, determining 4:00 p.m. on September 18, 1995, which was subsequently changed to September 25, 1995, in Room 103 of the City -County Building, 300 West Ash, Salina, Kansas, to be the time and place at which the owner, the owner's agent, any lienholders of record, and any occupant of such structure could appear and show cause why such structures should not be condemned and ordered repaired or demolished, and WHEREAS, notice of the time and place of the hearing was given as required by law; and WHEREAS, upon considering the evidence presented regarding the structures located upon the above described real estate, the Governing Body desires to make its findings and direct certain action in relation to the structures, SO NOW, THEREFORE Kansas: BE IT RESOLVED by the Governing Body of the City of Salina, Section 1. That the following findings are made regarding the structures located upon the real estate described above: The buildings and structures were found to be dangerous and that such conditions or defects exist to the extent that the life, health, property or safety of the public or the occupants are endangered. Section 2. That the owner or agent is hereby directed to repair or remove the buildings or structures described above, and to make the premises safe and secure. Such work shall be commenced by October 2, 1995 on all tracts and shall be diligently prosecuted so as to allow for substantial completion of the work no later than October 31, 1995. Section 3. If the owner or agent fails to commence the repair or the removal as directed within the time stated or fails to diligently prosecute the work until the work is substantially completed within the stated time period, the Governing Body will cause the buildings or structures to be repaired razed and removed pursuant to K.S.A. 12-1755. Section 4. That this resolution shall be in full force and effect from and after its adoption by the Board of Commissioners and the City Clerk shall cause it to be published once in the official city newspaper as required by K.S.A. 12-1753.
