8360 Street ImprovementsORDINANCE NUMBER 8360 (Published in The Salina Journal `7 _ 1974) AN ORDINANCE RATIFYING AND CONFIRMING A CONTRACT WITH SMOKY HILL, INC., FOR THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN THE CITY OF SALINA, KANSAS, AND PROVIDING FOR THE ISSUANCE OF TEMPORARY NOTES TO PAY THE COST THEREOF, PENDING THE ISSUANCE AND SALE OF BONDS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of Smoky Hill, Inc., hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on July 29, 1974, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of the City of Salina, Kansas, to said contractor and signed on behalf of the City by its Mayor on August 5, 1974, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Curbing, guttering, paving, and grading of Ray Avenue from the south line of Neal Avenue to the south line of Scott Avenue. Curbing, guttering, paving, and grading of Scott Avenue from the west line of Ray Avenue to the south line of Lot 29, Block 32, Key Acres Addition Number 2. Water main, sanitary sewer, service lines and storm sewer to serve Lots 18 - 29, Block 32; and Lots 2 - 11, Block 35, Key Acres Addition Number 2. Sanitary sewer, service lines, and storm sewer to serve Lots 7 - 17, Block 32; and Lots 12 - 20, Block 35, Key Acres Addition Number 2. Paving, grading and water main on Upper Mill Heights Drive from Upper Mill Terrace to Crawford Avenue. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of such improvements as shown by the sworm estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposal of said Contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $119.008.00 plus change orders as approved by the Board of Commissioners, and necessary expenses connected with the project, to mature not later than December 1, 1975, and to be issued in such amounts and at such times as money for the payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city newspaper. (SEAL) Attest: 1 1 D. L.
