AN ORDINANCE RELATING TO NON-DISCRIMINATION IN EMPLOYMENT BY ANY HEAD
OF A DEPARTMENT, OFFICIAL AGENT, OR EMPLOYEE OF THE CITY OF SALINA, ESTABLISHING
PROCEDURE BY WHICH THE INTENT OF THE ORDINANCE SHALL BE IMPLEMENTED.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. The Salina Code is hereby amended by adding a new Article
to be designated as Article II of Chapter 16.5 which Article shall read as
follows:
ARTICLE II
"Section 16.5-25. Discrimination prohibited
It shall be unlawful for the head of any
department, official agent, or employee of the City
of Salina, Kansas, or of any department thereof
acting for or on behalf of said City in any manner
involving employment by said city to discriminate
against any person otherwise qualified in employment
or in tenure, terms or conditions of employment, or
to discriminate in promotion or increase in compensation;
or to publish offers of or to offer employment based
upon such discrimination; or to adopt or enforce any
rule or employment policy which discriminates between
employees or prospective employees; or to seek
information relating to race, creed, color, sex,
national origin or ancestry for any person or
employee, as a condition of employment tenure, term
or in connection with conditions of employment,
promotion or increase in compensation; or to
discriminate in the selection or personnel training.
"Section 16.5-26. Notice of .job vacancies
In order to insure non-discrimination in employment
opportunities, any department head of the City of Salina
having authority to recommend to the City Manager the
employment of City personnel shall be required to list
promptly with the office of the Human Relations Commission
any job vacancy or vacancies occurring within the area
or his employment authority. The Director of the Human
Relations Commission shall upon receiving any job
vacancy listing, promptly post notice of such in
public locations in at least three (3) places throughout
the City. The Director of Personnel shall provide a
recommended advertisement setting forth the vacancy
existing which shall be delivered to the Human Relations
Commission at the same time notice is given. The Human
Relations Commission shall be responsible for seeing
that the proposed advertisement is given publication
at least one and not more than three periodical news
agencies with general circulation in the City. The
City shall be responsible for the payment of all
advertising costs. No person shall be employed to
fill any such vacancy within ten (10) days after
listing the vacancy with the Human Relations Commission,
unless in the opinion of the City Manager an emergency
exists. Applications for vacancies listed herein shall
be filed with the Director of Personnel.
"Section 16.5-27. Exceptions
The provisions of this ordinance shall not apply
to part-time, temporary or seasonal employees."
Section 2. That this ordinance shall take effect and be in force
from and after its passage, approval and publication in the official city
newspaper.
