AN ORDINANCE levying special assessments against certain property to
pay the cost of constructing certain sidewalks in the parking abutting the
following property to -wit:
Lot 1, Block 2, Southern View Addition
The West 68.5 feet of Lot 2, Block 2, Southern
View Addition
The East 60 feet of Lot 2, Block 2, Southern
View Addition
A tract of land beginning at the northwest corner
of Lot 1, Surveyor's Plat 11; thence 185 feet
East along the north line of said lot; thence
297 feet south; thence 185 feet west to the
west line of said Lot 1; thence 297 feet north along
along the west line of said lot to the point
of beginning.
The north half of Lot 1, Surveyor's Plat 11 in the
Northwest Quarter of the Northeast Quarter of
Section 25, Township 14 South, Range 3 West,
except the following tracts:
1. A part of Lot 1, Surveyor's Plat 11,
beginning at a point 33 feet west and
20 feet south of the northeast corner of
the northeast corner of the west half of
the said quarter section; thence south
180 feet; thence west 125 feet; thence
north 180 feet; thence east 125 feet to
point of beginning.
2. A tract of land beginning at the northwest
corner of Lot 1, Surveyor's Plat 11; thence
185 feet east along the north line of said
lot; thence 297 feet south; thence 185 feet
west to the west line of said Lot 1; thence
297 feet north along the west line of said
lot to point of beginning.
3. The west 60 feet of the north 100 feet of the
east 255.9 feet of Lot 1 of Surveyor's Plat 11.

A part of Lot 1, Surveyor's Plat 11, a tract of land
in the Northeast Quarter of Section 25, beginning
at a point 33 feet west and 20 feet south of the
northeast corner of the west half of the said
quarter section; thence south 180 feet; thence
west 125 feet; thence north 180 feet; thence east
125 feet to point of beginning.
Lot 16, Replat of Block 8, ClafIin Addition to the
Grounds of Kansas Wesleyan University.
WHEREAS, the Board of Commissioners have, by Resolution Numbers 3140
amd 3149, caused to be notified the owners of the property hereinafter described,
to cause their respective portion of said sidewalks to be constructed at their
own expense and have fulfilled all conditions precedent to the construction of
said sidewalks,
WHEREAS, the owners of the property hereinafter described did not
within 45 days, and 30 days, as required by Resolution Numbers 3140 and 3149,
cause said sidewalks to be constructed and the City caused said sidewalks to be
constructed pursuant to K. S. A. Chapter 12, Article 18, and the cost thereof
has been ascertained,

WHEREAS, the Board of Commissioners has determined that the total
cost of such improvements is Three Thousand, Two Hundred Thirty-one and 69/100
Dollars ($3,231.69) and that 77.87 percent, in the amount of $2,516.64 be assessed
against the improvement district and 22.13 percent, in the amount of $715.06 be
assessed against the City -at -large, and SO NOW, THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That there be and there is hereby levied and assessed
against the lots hereinafter described, an assessment for the purpose of paying
the cost of constructing said sidewalks, taxable against the following described
lots in the amount set opposite said lots:
Lot 1, Block 2, Southern View Addition - - - - - $308.28
The West 68.5 feet of Lot 2, Block 2,
Southern View Addition = - - - - - - - - - - - - - 214.12
The East 60 feet of Lot 2, Block 2,
Southern View Addition - - - - - - - - - - - - - - 228.36
A tract of land beginning at the northwest corner
of Lot 1, Surveyor's Plat 11; thence 185 east
along the north line of said lot; thence 297 feet
south; thence 185 feet west to the west line of
said Lot 1; thence 2.97 feet north along the west
line of said lot to point of beginning - - - - - - 647.68
The north half of Lot 1 in Surveyor's Plat 11 in
the Northwest Quarter of the Northeast Quarter of
Section 25, Township 14 South, Range 3 West except
the following tracts: - - - - - - - - - - - 138.38
1. A part of Lot 1, Surveyor's Plat 11,
beginning at a point 33 feet west and
20 feet south of the northeast corner
of the west half of the said quarter
section; thence south 180 feet; thence

Section 2. That the owner or owners of the property above described
shall have thirty (30) days after the publication of this ordinance within
which to make full payment.
Section 3. That the City Clerk is directed to mail a notice not less
than fifteen days prior to the end of the thirty (30) days to the owners of the
property as shown on the records of the Office of the Register of Deeds.
Section 4. That if full payment of the assessment made in Section 1
of this ordinance is not made within thirty days after the publication of this
ordinance, the City Clerk is hereby directed and authorized to certify said
assessments to the County Clerk of Saline County, Kansas, to be placed on the
tax roll for collection in four installments, starting with the year 1974, and
subject to the same penalties and collected in like manner as other taxes.
Section 5. That this ordinance shall take effect and be in full force
from and after its adoption and publication once in the official city newspaper.
