AN ORDINANCE PROVIDING FOR THE VACATION OF STREET RIGHT-OF-WAY IN
EXCESS OF FORTY FEET (401) ON THE EAST SIDE OF CHANNEL ROAD FROM GLEN AVENUE TO
THE NORTH LINE OF MOUNT BARBARA ADDITION TO THE CITY OF SALINA, SALINE COUNTY,
KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That a portion of the street right-of-way in the City of
Salina, Saline County, Kansas, described as follows:
Tract Number 1.
A tract of land in the Northeast Quarter (NE/4) of
Section Eighteen (18), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian in Saline County,
Kansas and more particularly described as follows:
Beginning at the southwest corner of Lot 20,
Block 1, Millview Addition to the City of Salina,
Kansas, thence west along the south line of said
Lot 20 extended a distance of one and ten hundredths
feet (1.10') to a point on the new east right-of-way
line of Channel Road; thence northerly one hundred
fifty-six and thirty-three hundredths feet (156.33')
along said right-of-way line to its intersection with
the north line of said Lot 20 extended; thence east
along the north line extended a distance of two and
ten hundredths feet (2.10') to the northwest corner
of said Lot 20; thence southerly along the west line
of said Lot 20 to the point of beginning and containing
0.01 acres more or less.
Tract Number 2.
A tract of land in the Northeast Quarter (NE/4) of
Section Eighteen (18) Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian in Saline County,
Kansas and more particularly described as follows:
Beginning at the southwest corner of Lot 13
Block 2, Millview Addition to the City of Salina,
Kansas; thence west along the south line of said Lot 13
extended, a distance of ten and three tenths feet (10.3')
to a point on the new east right-of-way line of Channel
Road; thence northerly along said right-of-way line
which is a four degree and sixteen minute (4°16') curve
to the right with a radius of one thousand three hundred
forty and eighty-one hundredths feet (1,340.81') a distance
of one hundred thirty and fifty-eight hundredths feet
(130.58') to the intersection of the north line of said
Lot 13 extended; thence east along the north line extended,
a distance of twenty-eight and forty hundredths feet (28.409
to the northwest corner of said Lot 13; thence southwesterly
along the west line of said Lot 13 to the point of beginning
and containing 0.06 acres more or less.
Tract Number 3.
A tract of land in the Northeast Quarter (NE/4) of
Section Eighteen (18), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian in Saline County,
Kansas and more particularly described as follows:
Beginning at the southwest corner of Lot 1, Block 2,
Millview Addition to the City of Salina, Kansas; thence
west along the south line of said Lot 1 extended a
distance of twenty-eight and four tenths feet (28.4')
to a point on the new east right-of-way line of Channel
Road; thence northerly one hundred thirty-four and
twenty-seven hundredths feet (134.27') along said
right-of-way line which is a four degree sixteen
minute (4°16') curve to the right with a radius of One
thousand three hundred forty and eighty one hundredths
feet (1,340.81') to the intersection of the north line
of said Lot 1 extended; thence east along the north line
extended a distance of thirty-two and fifteen hundredths
feet (32.15') to the northwest corner of said Lot 1;
thence southwesterly along the west line of said Lot 1
to the point of beginning and containing 0.09 acres more
or less.
Tract Number 4.
A tract of land in the Northeast Quarter (NE/4) of
Section Eighteen (18), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian in Saline County,
Kansas and more particularly described as follows:
Beginning at the southwest corner of Lot 1,
Block 1, Millview Addition to the City of Salina, Kansas;
Thence west along the south line of said Lot 1 extended
a distance of twenty-eight and fifty-five hundredths
feet (28.55') to a point on the new east right-of-way
line of Channel Road; thence northerly forty-one feet
(41.0') along said right-of-way line which is a four
degree sixteen minute (4°16') curve to the right with
a radius of one thousand three hundred forty and
eighty-one hundredths feet (1,340.81') to the point
of tangent of said curve; thence northeasterly along
the said right-of-way a distance of one hundred seven
and forty-nine hundredths feet (107.49') to the
intersection of the north line of said Lot 1 extended;
thence east along the north line extended a distance
of fourteen and seventy hundredths feet (14.7O')to the
northwest corner of said Lot 1; thence southwesterly
along the west line of said Lot 1 to the point of
beginning and containing 0.06 acres more or less.
Tract Number 5.
A tract of land in the Northeast Quarter (NE/4) of
Section Eighteen (18), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian in Saline County,
Kansas and more particularly described as follows:
Beginning at the southwest corner of Lot 17,
Mount Barbara Addition to the City of Salina, Kansas;
thence west along the south line of said Lot 17 extended
a distance of fourteen and seventy hundredths feet (14.70')
to a point on the new east right-of-way line of Channel
Road; thence northeasterly one hundred seventy-two and
nine tenths feet (172.9') along said right-of-way line
to its intersection with the north line of said Lot 17
extended; thence east along the north line extended a
distance of twenty-six and fifty hundredths feet (26.50')
to the northwest corner of said Lot 17; thence southwesterly
along the west line of said Lot 17 to the point of beginning
and containing 0.07 acres more or less.
Tract Number 6.
A tract of land in the Northeast Quarter (NE/4) of
Section Eighteen (18), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian in Saline County,
Kansas and more particularly described as follows:
Beginning at the southwest corner of Lot 1,
Mount Barbara Addition to the City of Salina, Kansas;
thence west along the south line of said Lot 1 extended
a distance of thirty and ninety hundredths feet (30.90')
to a point on the new east right-of-way line of Channel
Road; thence northeasterly seventeen and forty-nine
hundredths feet (17.49') to the point of curvature of
Channel Road; thence northeasterly one hundred forty-
eight and forty-one hundredths feet (148.41') along
said right-of-way line which is a two degree and twenty
minute (2°20') curve to the right with a radius of two
thousand four hundred ninety-two and thirty hundredths
feet (2,492.30') to the intersection with the north line
of said Lot 1 extended; thence east twenty-eight and
ten hundredths feet (28.10') along the north line
extended to the northwest corner of said Lot 1; thence
southwesterly along the west line of said Lot 1 to the
point of beginning and containing 0.11 acres more or less.
be and the same is hereby vacated.
Section 2. That portion of the street right-of-way hereby vacated
shall revert to the adjacent property owners in accordance with K.S.A. 13-443.
Section 3. This ordinance shall be in full force and effect from and
after its adoption and publication in the official city newspaper.
