ORDINANCE NUMBER 23-11148
AN ORDINANCE ESTABLISHING THE "TURF MAINTENANCE AND
REPLACEMENT" FUND PURSUANT TO K.S.A.12-1,118.
WHEREAS , K.S.A. 12-1, 118 authorizes the governing body of any city which has formally
approved a multi-year capital improvement plan setting forth the public improvement and
infrastructure needs of the city on a prioritized basis to establish by ordinance separate, non-
budgeted capital improvements funds in anticipation of receiving moneys budgeted and transferred
to such funds for that purpose in order to account for receipt, investment, and authorized
expenditure of funds in accordance with that purpose; and
WHEREAS, the Governing Body entered into an agreement on August 3, 2020, with Salina
Athletic Partners (the "Agreement"); and
WHEREAS, Section 4.5.3 of the Agreement requires the City to establish a dedicated fund
for use in accumulating funds solely for use in maintaining, repairing and replacing turfed surfaces
at the Dean Evans Stadium, SO NOW, THEREFORE;
BE IT ORDAINED by the Governing Body of Salina, Kansas:
Section 1. Creation of Fund. A separate, non-budgeted reserve fund titled "Turf
Maintenance and Replacement Fund", shall be created and maintained on the City's financial
system to account for all funds and investment proceeds received and authorized expenditures made
pursuant to the Agreement as it exists or may be amended by the City of Salina and Salina Athletic
Partners.
Section 2. Effective. This ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper by the following summary:
