03-20-2023 Minutes"' "' CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS March 20, 2023 4:00 p.m. Mayor Hoppock asked the Clerk for verification that notice had been sent for today 's City Commission meeting. The Clerk replied yes . The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m . in Room 107 , City-County Building. A roll call was taken. Mayor Hoppock took a moment to acknowledge the passing of Salina Fire Department Battalion Chief John Goertzen. This was followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Michael L. Hoppock (presiding), Trent W. Davis , M.D., Greg Lenkiewicz, Bill Longbine and Karl Ryan. Also present: Mike Schrage , City Manager; Jacob Wood , Deputy City Manager; Shawn Henessee , Assistant City Manager , Greg Bengtson, City Attorney; and Nikki Goding , Deputy City Clerk. AWARDS AND PROCLAMATIONS (3.1) Recognition of the day of March 19 , 2023 , as Major Dennis Pugh Remembrance Day in the City of Salina. Jason Mcintire, Commander of the Sons of the American Legion , read the proclamation and discussed related activities. Major Pugh 's younger brother, Dale Pugh , attended via Zoom to express his appreciation for the recognition. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (5.1) Approve the minutes of March 13 , 2023. (5.2) Award the bid for project number 23013 , 2023 Chip Seal , to APAC-Kansas , Inc ., Shears Division of Emporia in the amount of $278 ,891.53 with a 5% ($13 ,944 .58) construction contingency for a total project authorization not to exceed $292 ,836.11 and authorize the City Manager to execute a contract with APAC-Kansas , Inc ., Shears Division of Emporia upon fulfillment of all prerequisites under the bid documents . 23-0077 Moved by Commissioner Davis , seconded by Commissioner Ryan , to approve the consent agenda as presented. Page 1 "' "' ADMINISTRATION (6.1) Approve Ordinance No. 23-11146 , on second reading , changing the zoning district classification of the west half of the property located at 509 E . Elm Street from I-2 (Light Industrial) to C-1 (Restricted Business) to unify the zoning of the CKF campus and to allow addiction treatment housing on property CKF is acquiring from Saint Francis Community Services , Inc. Mayor Hoppock stated Ordinance No . 23-11146 was passed on first reading on March 13 , 2023. Since that time , no comments have been received. Commissioner Davis inquired whether the zoning change would affect the historical designation of the Dunbar School building located on the property. Dean Andrew, Planning & Zoning Administrator, advised any changes in ownership and/or zoning would not affect the historical designation of the building. 23-0078 Moved by Commissioner Longbine , seconded by Commissioner Lenkiewicz, to approve Ordinance No. 23-11146 , on second reading. A roll call vote was taken. Aye: (5). Nay (0). Motion carried. (6.2) Award the bid for project number 21025, Centennial Rd . Improvements , Water Well to Arnold, for $2 ,188 ,388.51witha5% ($109,420.00) construction contingency for a total project authorization not to exceed $2,297 ,808.51 and authorize the City Manager to execute a contract with TRR, Inc., dba T &R Construction of Salina upon fulfillment of all prerequisites under the bid documents . Dan Stack, City Engineer, explained the request, fiscal impact, and action options. Commissioner Longbine asked if the road would remain open during the construction work. Mr. Stack said that it would not and traffic would be detoured onto Scanlan A venue. A short discussion followed about funding, deadlines, and conflicts with the completion of the new Schwan 's distribution center. Mr. Stack advised that the city has been in contact with Schwan's and they are aware of the truck rerouting that will need to occur. 23-0079 Moved by Commissioner Lenkiewicz , seconded by Commissioner Longbine , to award the bid for Project Number 21025 , Centennial Rd . Improvements , Water Well to Arnold , to TRR, Inc., a Kansas corporation, d/b/a T &R Construction of Salina. Aye: (5). Nay (0). Motion carried. (6.3) Approve Resolution 23-8114 declaring the eligibility of the City to submit an implementation grant application to the Pathways to a Healthy Kansas, a Blue Cross Blue Shield of Kansas grant program, in partnership with Live Well Saline County, and authorize the City Manager to submit the application. Dan Stack, City Engineer, explained the request, fiscal impact, and action options. Inquiries followed regarding the size of the new sidewalks, the need for care of the established sidewalks to which the new ones would connect, and potential issues with insufficient setbacks of some properties adjacent to these new pathways. "' "' z a.. w "' (6.4) Authorize the City Manager to execute a purchase agreement with Foley Equipment Company, a Kansas corporation, d/b/a Foley Caterpillar to purchase a new landfill compactor in the amount of $978 ,000.00. ·°' 0 Jim Kowach , Public Works Operations Manager, explained the request , fiscal impact, and * action options. "2 5i c: 8 A thorough discussion followed centering primarily on fire suppression and concerns largely due to two previous compactor units being lost to fires. Discussions on life spans of compactors , warranties , differences in cost between a new compactor versus a rebuilt one , and the lack of availability of any compactors for purchase at all were also had. 23-0081 Moved by Commissioner Davis, seconded by Commissioner Ryan, to execute a purchase agreement with Foley Equipment Company, a Kansas corporation, d/b/a Foley Caterpillar for a new landfill compactor. (6 .5) Schwan's Soil Transfer (6.5a) Authorize the City Manager to execute an agreement with TRR, Inc., a Kansas corporation, d/b/a T &R Construction in the amount of $523 ,380 .00 to load , haul , stockpile or place soils from the Schwan 's detention pond to the City of Salina Municipal Solid Waste Landfill (MSWLF) located at 4292 S . Burma Road , the Old City Dump site located at 1960 State Street, and Jerry Ivey Pond within Jerry Ivey Memorial Park located at 2465 Edward Street as specified in the agreement. (6.5b) Authorize the City Manager to execute a 30-day equipment rental agreement for a dozer and excavator with Foley Equipment Company , a Kansas corporation , d/b/a Foley Caterpillar in the amount of $21,042.00 to prepare the Old City Dump site located at 1960 State Street for cover soil remediation work . Jim Kowach, Public Works Operations Manager, explained the request, fiscal impact , and action options. Discussions were had regarding the logistics of landfill cells , storage of dirt before it is needed, and whether or not the soil will be tested before being used specifically at Jerry Ivey Park. Ben Windholz, Salina, Kansas , asked if the City had considered using soil excavated during construction of new subdivisions for this purpose . Norman Mannel , Salina, Kansas , shared some insight about OSHA regulations , similar work being performed by the Army Corps of Engineers, and non-burning hydraulic oil. Page 3 .. - .. "' "' z 0.. w "' -~ "iii (/) ~ :g g c: 0 u Jon Blanchard, Salina, Kansas, commented on the need for soil testing and asked that no soil dug up from drainage ditches be used in Jerry Ivey Park . Commissioner Davis inquired about the need for language in the contract stating that time is of the essence when there is no definitive timeline for the need or use of the soil. City Attorney Greg Bengtson advised that it is preferable to leave the language in rather than omit it so that both parties know that the work should be performed as expeditiously as possible. Mr. Bengtson requested 3 minutes to confer with City Manager Mike Schrage and Mr. Kowach. The Commission recessed for a short break at 5:41 and reconvened at 5:44. There were no additional comments nor action to be taken after this brief meeting. 23-0082 Moved by Commissioner Longbine, seconded by Commissioner Ryan, to authorize the City Manager to execute an agreement with TRR, Inc., a Kansas corporation, d/b/a T &R Construction to load, haul, stockpile, or place soils as specified in the agreement. Aye: (5). Nay (0). Motion carried. DEVELOPMENT BUSINESS None. OTHER BUSINESS Mayor Hoppock asked about the holes in the rights-of-way brought up by Ben Windholz at last week's City Commission meeting. Jim Teutsch, Director of Public Works, stated he has been in touch with the construction manager of Clearwave, Jack Dwyer, regarding the holes. Mr. Teutsch also said that a city inspector has been assigned, on a full-time basis, to work with and educate the Clearwave crews on safety and proper filling of the holes, to which Clearwave has been receptive. Mr. Teutsch added that Clearwave encouraged citizens to contact them with any questions and concerns at (913) 586-8008. There were also some concerns about who would be responsible if damage happens to a sprinkler system since the crews are working in front yards and rights-of-way rather than easements. Commissioner Davis asked about the upcoming strategic planning session and the need to mention how aggressive our current property code enforcement is. City Manager Mike Schrage said he is working on it. Commissioner Longbine highlighted the Kansas EquiFest that took place over the previous weekend. Mr. Longbine pointed out that a farm show would be held during the upcoming weekend and he was happy to see these kinds of tourist attractions bringing money into the city . Page4 CITIZENS FORUM Normal Mannel, Salina, Kansas , shared information and concerns about dead battery contents at the landfill. Jon Blanchard, Salina, Kansas, read from an article on new, more stringent levels of allowable PF AS in the water supply while expressing his concern over whether the city tests for PF AS. Mr. Schrage assured him that the city does test to the current standards . Ben Windholz, Salina, Kansas, talked about a truck parked unsafely by Clearwave after a tire blew and also shared thoughts on the tennis complex naming item, as he feared he would not have enough time to express his opinions when the item returns to the Commission at the March 27, 2023, meeting. Ken Reitz, Salina, Kansas, shared his concerns about lead contamination of soil and water.
