AN ORDINANCE LEVYING SPECIAL ASSESSMENTS AGAINST CERTAIN PROPERTY TO
PAY THE COST OF CONSTRUCTING CERTAIN SIDEWALKS IN THE PARKING ABUTTING THE
FOLLOWING PROPERTY TO -WIT:
A concrete sidewalk on the north side of Wayne Avenue
from Norton Street East 138 feet, adjacent to the
South line of Lot 28, Block 3, South Field Addition.
A concrete sidewalk on the north side of Wayne Avenue
from Roach Street West 138 feet, adjacent to the
South line of Lot 14, Block 4, South Field Addition.
A concrete sidewalk on the north and east sides of
Key Avenue from Belmont Boulevard to Neal Avenue,
adjacent to Lots 15, 16, 17, 18, 19, 20, 21, 22,
23, 24, 25, Block 24, Key Acres Addition.
A concrete sidewalk on the south side of Hartland
Avenue, adjacent to Lot 8, Block 25, Key Acres Addition.
A concrete sidewalk installed at the curb line on the
north side of Wayne Avenue and adjacent to Lot 14,
Block 6; and Lot 12, Block 11, Gebhart Manor Addition.
A concrete sidewalk installed at the curb line on
the south side of Wayne Avenue and adjacent to Lots 1,
2, and 3, Block 2; and Block 3, Meadowlark Acres Addition.
A concrete sidewalk on the north side of Kirwin Avenue
and adjacent to Lot 14, and the South 5 feet of Lot 12,
Kirwin Avenue, Grounds of Kansas Wesleyan University.
A concrete sidewalk on the Southeast side of Edward
Street and adjacent to Lot 16 except the southeast
5 feet; and Lot 17 and the Southeast 5 feet of Lot 16,
Block 13, Belmont Addition.
WHEREAS, the Board of Commissioners has, by Resolution Numbers 3162,
3170, 3184, caused to be notified the owners of the property hereinafter
described, to cause their respective portion of said sidewalks to be constructed
at their own expense and have fulfilled all conditions precedent to the
construction of said sidewalks.
WHEREAS, the owners of the property hereinafter described did not
within forty-five days, sixty days, and thirty days, as required by Resolution
Numbers 3162, 3170, 3184, cause said sidewalks to be constructed and the City
caused said sidewalks to be constructed pursuant to K.S.A. Chapter 12, Article
and the cost thereof has been ascertained.
WHEREAS, the Board of Commissioners has determined that the total cost
of such improvements is Eighteen Thousand One Hundred Twenty-four and 53/100
Dollars ($18,124.53) and that 61.6745 percent, in the amount of Eleven Thousand
One Hundred Seventy-eight and 22/100 Dollars ($11,178.22) be assessed against th
improvement district and 38.3254 percent, in the amount of Six Thousand Nine
Hundred Forty-six and 31/100 Dollars ($6,946.31) be assessed against the City -
at -large, and SO NOW, THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

Section 1. That there be and there is hereby levied and assessed
against the lots hereinafter described, an assessment for the purpose of paying
the cost of constructing said sidewalks, taxable against the following described
lots in the amount set opposite said lots:

Section 2. That the owner or owners of the property above described
shall have thirty (30) days after the publication of this ordinance within which
to make full payment.
Section 3. That the City Clerk is directed to mail a notice nor less
than fifteen days prior to the end of the thirty (30) days to the owners of the
property as shown on the records of the Office of the Register of Deeds.
Section 4. That if full payment of the assessment made in Section 1
of this ordinance is not made within thirty days after the publication of this
ordinance, the City Clerk is hereby directed and authorized to certify said
assessments to the County Clerk of Saline County, Kansas, to be placed on the
tax roll for collection in four installments, starting with the year 1976, and
subject to the same penalties and collected in like manner as other taxes.
Section 5. This ordinance shall take effect and be in full force
from and after its adoption and publication once in the official city newspaper.
