AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES AND PARCELS
OF GROUND IN THE CITY OF SALINA, KANSAS, FOR THE PURPOSE OF PAYING A PORTION OF
THE COST OF:
Curbing, guttering, paving and grading of IRENE STREET from the west
line of Lot 7, Block 34, Key Acres 2nd Addition to Ray Avenue.
Curbing, guttering, paving and grading of SCOTT AVENUE from the south
line of Lot 29, Block 32, to the south line of Lot 1, Block 36, Key
Acres 2nd Addition.
Curbing, guttering, paving and grading of RAY AVENUE from the south
line of Scott Avenue to the south line of Lot 13, Block 36, Key Acres
2nd Addition.
Lateral Sanitary Sewer 532 - an 8" sewer pipe beginning at an existing
manhole located at the northwest corner of Lot 29, Block 32, Key
Acres 2nd Addition; thence running southwest along the rear of Lots
29 through 32, Block 32, and continuing southwest along the rear of
Lots 7 and 8, Block 34, Key Acres 2nd Addition, where a manhole will
be constructed which will be the terminus of Lateral 532.
Lateral Sanitary Sewer 533 - an 8" sewer pipe beginning at an existing
manhole located at the northeast corner of Lot 1, Block 35, Key Acres
2nd Addition; thence running southwest along the rear of said Lot 1 to
the northeast corner of Lot 22, Block 35, Key Acres 2nd Addition,
where a manhole will be constructed which will be the terminus of
Lateral 533.
Lateral Sanitary Sewer 534 - an 8" sewer pipe beginning at a wet well
that will be constructed and located at the intersection of Gail
Drive and Ray Avenue; thence running north in Ray Avenue to the
northwest corner of Lot 2, Block 38, Key Acres 2nd Addition; thence
running west in the utility easement through Block 36, Key Acres 2nd
Addition to the southeast corner of Lot 2, Block 36; thence southwest
along the rear of Lot 1, Block 36 to the southeast corner of Lot 1,
Block 36, Key Acres 2nd Addition, where a manhole will be built which
will be the terminus of Lateral 534.
Water main and service lines to serve Lots 30, 31, 32, Block 32, Lots
7 and 8, Block 34; Lot 1 and Lots 12 through 22, Block 35; Lots 1
through 13, Block 36, Key Acres 2nd Addition.
Sanitary sewer pump station and force main to be constructed at the
intersection of Gail Drive and Ray Avenue to serve Lots 1 through 17,
Block 30; Lots 1 through 16, Block 31; Lots 1 through 15, Block 33;
Lots 1, 2, 3, and Lots 9 through 21, Block 34; Lots 1 through 25,
Block 36; Lots 1 through 27, Block 37; Lots 2 through 17, Block 38;

Acres 2nd Addition
Curbing, guttering, paving and grading of PROSPECT AVENUE from the
east line of Ohio Street to the east line of Lot 18, Block 1, Cloverdale
Addition.
Water main and service lines to serve the East 50 feet of Lot 20 and
the South Half of Lots 18 and 19, Block 1, Cloverdale Addition and
the West 11 feet of Lot 10 and all of Lots 11, 12, and 13, Cloverdale
Annex Addition to the City of Salina, Kansas.
Lateral Sanitary Sewer 535 - an 8" clay sewer pipe beginning at an
existing manhole located 10 feet south of the center line of Reed
Avenue at the northeast corner of Lot 1, Block 8, Key Acres Addition
to the City of Salina, Kansas; thence running south along the rear of
Lots 1, 2, and 15, of said Block 8; thence running east along the
rear of Lots 3 through 8 of said Block 8, where a manhole will be
constructed which will be the terminus of Lateral 535.
Water main and service lines to serve Lots 1 through 7 and the West
30 feet of Lot 8, and Lots 15 through 20, and the West 18 feet of Lot
21, Block 8, Key Acres Addition

Lateral Sanitary Sewer 532 - an 8" sewer pipe beginning at an existing
manhole located at the northwest corner of Lot 29, Block 32, Key
Acres 2nd Addition; thence running southwest along the rear of Lots
29 through 32, Block 32, and continuing southwest along the rear of
Lots 7 and 8, Block 34, Key Acres 2nd Addition, where a manhole will
be constructed which will be the terminus of Lateral 532.
Lateral Sanitary Sewer 533 - an 8" sewer pipe beginning at an existing
manhole located at the northeast corner of Lot 1, Block 35, Key Acres
2nd Addition; thence running southwest along the rear of said Lot 1
to the northeast corner of Lot 22, Block 35, Key Acres 2nd Addition,
where a manhole will be constructed which will be the terminus of
Lateral 533.
Lateral Sanitary Sewer 534 - an 8" sewer pipe beginning at a wet well
that will be constructed and located at the intersection of Gail
Drive and Ray Avenue; thence running north in Ray Avenue to the
northwest corner of Lot 2, Block 38, Key Acres 2nd Addition; thence
running west in the utility easement through Block 36, Key Acres 2nd
Addition to the southeast corner of Lot 2, Block 36; thence southwest
along the rear of Lot 1, Block 36 to the southeast corner of Lot 1,
Block 36, Key Acres 2nd Addition, where a manhole will be built which
will be the terminus of Lateral 534.
Water main and service lines to serve Lots 30, 31, 32, Block 32, Lots
7 and 8, Block 34; Lot 1 and Lots 12 through 22, Block 35; Lots 1
through 13, Block 36, Key Acres 2nd Addition.
Sanitary sewer pump station and force main to be constructed at the
intersection of Gail Drive and Ray Avenue to serve Lots 1 through 17,
Block 30; Lots 1 through 16, Block 31; Lots 1 through 15, Block 33;
Lots 1, 2, 3, and Lots 9 through 21, Block 34; Lots 1 through 25,
Block 36; Lots 1 through 27, Block 37; Lots 2 through 17, Block 38;
Lots 1 through 14, Block 39; Lots 1 through 6, Block 40, all in Key
Acres 2nd Addition.

where a manhole will be constructed which will be the terminus of

Lateral Sanitary Sewer 535 - an 8" clay sewer pipe beginning at an
existing manhole located 10 feet south of the center line of Reed
Avenue at the northeast corner of Lot 1, Block 8, Key Acres Addition
to the City of Salina, Kansas; thence running south along the rear of
Lots 1, 2, and 15, of said Block 8; thence running east along the
rear of Lots 3 through 8 of said Block 8, where a manhole will be
constructed which will be the terminus of Lateral 535.

Water main and service lines to serve Lots 1 through 7 and the West
30 feet of Lot 8, and Lots 15 through 20, and the West 18 feet of Lot
21, Block 8, Key Acres Addition
and such contracts have been duly performed, and
WHEREAS, the Board of Commissioners has determined that the total
cost of such improvement is Two Hundred Four Thousand Nine Hundred Nine and
78/100 Dollars ($204,909.78) and that 70.158 percent, in the amount of One
Hundred Forty-three Thousand Seven Hundred Sixty and 67/100 Dollars ($143,760.67)
is to be assessed against the improvement district and 29.842 percent, in the
amount of Sixty-one Thousand One Hundred Forty-nine and 11/100 Dollars ($61,149.11
is to be assessed against the City -at -large, and
WHEREAS, in accordance with the provisions of Resolution Numbers 3113
and 3119, the petitioners are required to pay fifty percent (50%) of the
assessment for improvement. The total assessment paid by the petitioners is
Forty-one Thousand Seven Hundred Five and 48/100 Dollars ($41,705.48) leaving a
balance of One Hundred Two Thousand Fifty-five and 19/100 Dollars ($102,055.19)
to be levied against the lots and pieces of ground described herein, and
WHEREAS, the Board of Commissioners has, after due notice, met and
determined the amount of special assessments, SO NOW, THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Special assessments to pay the cost of such improvements,
with accrued interest, be and the same are hereby levied against the several
lots, pieces and parcels of land liable for special assessments for said
improvements, as follows:

Section 2. Said amounts so levied, apportioned and assessed as
aforesaid will be due and collectible in ten equal installments, the first
becoming due with the taxes levied for the year 1977, and one of said installments
falling due each and every year thereafter until all are paid and all to be
collected with interest as in this ordinance provided, HOWEVER, that the owner
of any piece or parcel of property liable for any such assessments may redeem
his property from such liability by paying to the City Treasurer the entire
amount chargeable against the same, as in this ordinance provided, at any time
within thirty days after the publication of this ordinance and before the
issuance of bonds of said City in payment of the balance of the cost of said
improvements, the property so paid on shall not thereafter be liable for any
further assessments for the cost of said improvements nor for any part of said
bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate
per annum as shall be borne by bonds hereafter to be issued for the payment of
the remaining unpaid cost of such improvements to be hereafter determined and
fixed by ordinance, when such bonds are issued on all of said installments
mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified in the preceding section
hereof, as by law provided, to the time of the collection of the installments
as provided by law, which said interest shall be collected annually at the same
time and in the same manner as said installments are collected and after the
taking effect of this ordinance and the fixing of said interest rate when such
bonds are authorized and issued; however, such interest rate shall not exceed 7
percent per annum, it shall be the duty of the City Clerk of said City to
annually, at the same time other taxes are certified, and until all of said
assessments so apportioned and levied have been
certified to the County Clerk
of Saline County, Kansas, certify a full
list of
all property liable to assessmen
and taxation for such work improvements,
except
such property, on which the
special assessments aforesaid have been
paid in
full, as hereinbefore provided,
together with the respective amounts due
on each
of said lots and pieces of
ground, which amounts shall include the
annual installments
of special assessment
together with the interest for one year at the rate to be fixed as provided for
in the ordinance, on all unpaid balances of such assessments, such amounts so
certified as herein provided shall be placed upon the tax roll by the County
Clerk of Saline County, Kansas, and collected as other taxes are collected.
Section 4. This ordinance shall take effect and be in full force
from and after its adoption and publication in the official city newspaper.
