AN ORDINANCE AUTHORIZING THE ISSUANCE OF PARK IMPROVEMENT BONDS, SERIES
PK -220, OF THE CITY OF SALINA, KANSAS, IN THE AGGREGATE AMOUNT OF $250,000.00 TO
PAY THE COST OF IMPROVING THE PUBLIC PARKS IN SAID CITY.
WHEREAS, the Governing Body of the City of Salina, Kansas, has heretofor
determined that it is necessary, expedient and in the public interest to improve
the public parks in said City, and
WHEREAS, all legal requirements have been complied with including a
determination of the cost of said improvements by the City Engineer which is on
file in the office of the City Clerk, and
WHEREAS, it has been further determined that there is no cash available
for said improvements and it is necessary, expedient and in the public interest
to issue general obligation bonds in the amount of $250,000.00, pursuant to the
authority of Charter Ordinance Number 13 of the City of Salina, Kansas, NOW
THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That the City of Salina, Kansas, is authorized to issue up
to $250,000 principal amount of general obligation bonds in any calendar year
for park improvements pursuant to the authority of Charter Ordinance Number 13
of the City of Salina, Kansas, and no such bonds or temporary notes have been
issued pursuant to said authority during the year 1977.
Section 2. There is hereby authorized the issuance of $250,000.00
principal amount of Park Improvement Bonds, Series PK -220. Said bonds shall be
dated December 15, 1977, shall consist of 50 bonds numbered 1 to 50, inclusive,
shall be in the denomination of $5,000 each and shall become due in the amount
of $25,000 on March 1 in each of the years 1979 to 1988, inclusive. Bonds
Numbered 1 through 15, inclusive, shall bear interest at the rate of 4.75 percent
per annum; Bonds Numbered 16 through 35, inclusive, shall bear interest at the
rate of 4-3/8 percent per annum; Bonds Numbered 36 through 40, inclusive, shall
bear interest at the rate of 4.40 percent per annum; and Bonds Numbered 41
through 50, inclusive, shall bear interest at the rate of 4.50 percent per annum
and said interest shall be payable March 1 and September 1 in each year except
that the first coupon shall become due on March 1, 1979. Both the principal of
and interest on said bonds shall be payable at the Office of the State Treasurer
of the State of Kansas in the City of Topeka, Kansas, and said bonds shall
become due as follows:

Section 3. Said bonds shall be executed by the Mayor and shall be
attested by the City Clerk and the corporate seal of the City shall be affixed
thereto. Said bonds shall have interest coupons attached thereto representing
the interest on said bonds, and said interest coupons shall bear the facsimile
signatures of the Mayor and City Clerk of said City.
Section 4. Said bonds and the interest coupons and the certificates
to appear on said bonds shall be in substantially the following form:

KNOW ALL MEN BY THESE PRESENTS: That the City of Salina, in the
County of Saline, State of Kansas, acknowledges itself to be indebted, and for
value received hereby promises to pay to the bearer, on the first day of March,
19 , the principal sum of
FIVE THOUSAND DOLLARS
in lawful money of the United States of America, with interest thereon from the
date hereof at the rate of percent (_%) per annum
payable March 1 and September 1 in each year, until said principal sum shall
have been paid, upon presentation and surrender of the interest coupons hereto
attached, as said coupons severally become due, both principal of and interest
on this bond being payable at the Office of the State Treasurer in the City of
Topeka, Kansas. And said City of Salina, in the State of Kansas, is held and
firmly bound by these presents, and the full faith, credit and resources of said
City are hereby irrevocably pledged for the prompt payment of said principal and
interest at maturity.
This bond is one of a series of 50 bonds of like date, denomination
and tenor, except number and maturity, numbered 1 to 50, inclusive, aggregating
the principal amount of $250,000.00, issued by the City of Salina, Kansas, for
the purpose of providing funds to pay the cost of improving the public parks in
said City, pursuant to the authority of Charter Ordinance Number 13 of the City
of Salina, Kansas, and this bond and all other bonds of said series, and all
interest thereof are to be paid by said City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and
things required to be done and to exist precedent to and in the issuance of this
bond have been properly done and performed and do exist in due and regular form
and manner as required by the Constitution and statutes of the State of Kansas,
and that the total indebtedness of said City, including this series of bonds,
does not exceed any constitutional or statutory limitation.
IN WITNESS WHEREOF, the said City of Salina, in the State of Kansas,
by its governing body, has caused this bond to be signed by its Mayor and its
corporate seal to be hereto affixed, attested by its City Clerk, and the coupons
hereto attached to be signed with the facsimile signatures of said officers, and
this bond to be dated the Fifteenth day of December, 1977.

Section 5. The Mayor and City Clerk are hereby authorized and directed
to prepare and exeute the bonds hereinbefore described and to procure the
proper registration thereof, and to deliver said bonds to the purchasers thereof
on payment of the purchase price therefor. The proceeds of said bonds shall be
placed in the city treasury and shall be applied solely for the purpose of
providing funds to pay the cost of improving the public parks in said City,
pursuant to the authority of Charter Ordinance Number 13 of the City of Salina,
Kansas.
Section 6. The full faith, credit and resources of the City of
Salina, Kansas, shall be, and the same are hereby pledged for the prompt payment
of said bonds and all interest thereon, as the same mature. The governing body
of said City of Salina, Kansas, shall annually make provisions for the payment
of the principal and interest of said bonds as the same become due, by levying
and collecting the necessary taxes therefor in the manner provided by law.
Section 7. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
