8562 Levy AssessmentsORDINANCE NUMBER 8562 (Published in The Salina Journal] 1977) AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES AND PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS, FOR THE PURPOSE OF PAYING A PORTION OF THE COST OF: Construction and installation of Lateral Sanitary Sewer 554 WHEREAS, pursuant to proceedings regularly had according to law, contracts have been let for the following improvements in the City of Salina, Kansas: Construction and installation of Lateral Sanitary Sewer 554 and such contracts have been duly performed, and WHEREAS, the Board of Commissioners has determined that the total cost of such improvements is Eleven Thousand Seven Hundred Eleven and 70/100 Dollars ($11,711.70) and that 100 percent, in the amount of Eleven Thousand Seven Hundred Eleven and 70/100 Dollars ($11,711.70) is to be assessed against the improvement district and no assessment against the City -at -large, and WHEREAS, the Board of Commissioners has, after due notice, met and determined the amount of special assessments, SO NOW, THEREFORE BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Special assessments to pay the cost of such improvements, with accrued interest, be and the same are hereby levied against the several lots, pieces and parcels of land liable for special assessments for said improvements, as follows: The East 90 feet of the South 338.9 feet of the West 404 feet of the Southwest Quarter of Section 36, Township 13 South, Range 3 West of the Sixth Principal Meridian ------------------- $1,019.10 A part of the Southwest Quarter of Section 36, Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, described as follows: Commencing at a point 404 feet east of the southwest corner of said Section 36; thence east along the south line of said quarter section 118 feet; thence notth and parallel with the west line of said quarter section 233 feet; thence east and parallel with the south line of said quarter section 110 feet to the approximate center of the old channel of Mulberry Creek; thence in a northerly and westerly direction along the center of the old channel of Mulberry Creek to a point 404 feet east of the west line of said quarter section; thence south and parallel with the west line of said quarter section 950 feet, more or less, to the place of beginning. (Assuming the south line of said Southwest Quarter of the Southwest Quarter of Section 36, to be 1,325 feet long.)-------------- 1,336.15 Part of the Southwest Quarter of the Southwest Quarter of Section 36, Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, described as follows: Commencing at a point 522 feet east of the southwest corner of said Section 36; thence east along the south line of said section 80 feet; thence north and parallel with the west line of said section 233 feet; thence west and parallel with the south line of said section 80 feet; thence south and parallel with the west line of said section 233 feet to the point of beginning. ------------------------------ 905.86 Part of the Southwest Quarter of the Southwest Quarter of Section 36, Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, described as follows: Commencing at a point 602 feet east of the southwest corner of the Southwest Quarter of said Section 36; thence east along the south line of said section 80 feet; thence north and parallel with the west line of said section to the center of the old channel of Mulberry Creek; thence up the center of the old channel of Mulberry Creek to a point 233 feet north of the south line of said section 36 feet; thence west 30 feet; thence south 233 feet to the point of beginning. ------------------ 905.86 Part of the Southwest Quarter of the Southwest Quarter of Section 36; Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, described as follows: Commencing at a point 682 feet east of the southwest corner of the Southwest Quarter of said Section 36; thence east along the south line of said section 90 feet; thence north and parallel with the west line of said section to the center of the old channel of Mulberry Creek; thence up the center of the old channel of Mulberry Creek to a point due north of the point of beginning; thence south parallel with the west line of said section to the point of beginning. -------------------------------------- 1,019.10 East 104 feet of the West 876 feet south of Mulberry Creek of the Southwest Quarter of the Southwest Quarter of Section 36, Township 13 South, Range 3 West of the Sixth Principal Meridian ---- 1,177.63 $11,711.70 A tract of land in the Northwest Quarter of the Northwest Quarter of Section 1, Township 14 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, described as follows: Beginning at a point 30 feet south and 452 feet west of the Northeast corner of the Northwest Quarter of the Northwest Quarter of said Section 1; thence south and parallel to the east line of the Northwest Quarter of the Northwest Quarter of said Section l a distance of 319.5 feet; thence west and parallel to the north line of the Northwest Quarter of said Section 1, a distance of 270.8 feet; thence south and parallel to the east line of the Northwest Quarter of the Northwest Quarter of said Section 1 to the center line of Dry Creek; thence northwesterly along the center line of Dry Creek to a point 924.3 feet west of the east line of the Northwest Quarter of the Northwest Quarter of said Section 1, thence north and parallel to the east line of the Northwest Quarter of the Northwest Quarter of said Section 1 to a point 30 feet south of the north line of the Northwest Quarter of said Section 1; thence east and parallel to the north line of said Section 1 a distance of 472.3 feet to the point of beginning. -------- 5,348.00 $11,711.70 Section 2. Said amounts so levied, apportioned and assessed as aforesaid will be due and collectible in ten equal installments, the first becoming due with the taxes levied for the year 1977, and one of said installmen falling due each and every year thereafter until all are paid and all to be collected with interest as in this ordinance provided, HOWEVER, that the owner of any piece or parcel of property liable for any such assessments may redeem his property from such liability by paying to the City Treasurer the entire amount chargeable against the same, as in this ordinance provided, at any time within thirty days after the publication of this ordinance and before the issuanc of bonds of said City in payment of the balance of the cost of said improvements, the property so paid on shall not thereafter be liable for any further assessment for the cost of said improvements nor for any part of said bonds. Section 3. There is hereby levied further and assessed against such lots and pieces of ground described in this ordinance, interest at such rate per annum as shall be borne by bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements to be hereafter determined and fixed by ordinance when such bonds are issued on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof, as by law provided, to the time of the collection of the installments as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued; however, such interest rate shall not exceed 7 percent per annum, it shall be the duty of the City Clerk of said City to annually, at the same time other taxes are certified, and until all of said assessments so apportioned and levied have been certified to the County Clerk of Saline County, Kansas, certify a full list of all property liable for assessments and taxation for such work and improvements, except such property, on which the special assessments aforesaid have been paid in full, as hereinbefore provided, together with the respective amounts due on each of said lots and pieces of ground, which amounts shall include the annual installments of special assessments together with the interest for one year at the rate to be fixed as provided for in the ordinance, on all unpaid balances of such assessments, such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, and collected as other taxes are collected.
