CITY OF SALINA, KANSAS
REGULAR MEETING OF THE BOARD OF COMMISSIONERS
November 8, 2004
4:00 p.m.
The City Commission convened at 2:30 p.m. in a Study Session for a Landscape Regulations and
Bicentennial Center C.I.P follow-up report. The Regular Meeting of the Board of Commissioners was
called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the
Pledge of Allegiance and a moment of silence.
There were present:

Commissioner Paul G. Webb
comprising a quorum of the Board, also present:

PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME

CONSENT AGENDA
(6.1) Approve the minutes of November 1, 2004.
(6.2) Authorize the reimbursement of $10,500 to Triplett, Inc. for pavement demolition of the
North Ninth Street Frontage Road.
Moved by Commissioner Divine, seconded by Commissioner Jilka, to approve the consent
agenda as presented. Aye: (5). Nay: (0). Motion carried.

DEVELOPMENT BUSINESS
ADMINISTRATION
(8.1) Second reading Ordinance No. 04-10242 establishing a capital cost recovery charge for the
purpose of paying a portion of the cost of a water distribution system in the vicinity of Schilling Road
and Ohio Street.
Dennis Kissinger, City Manager, commented on the second reading of the ordinance prior
to completion of the project.
Mayor Shadwick noted that Ordinance No. 04-10242 was passed on first reading on
November 1, 2004 and since that time no comments have been received.

Moved by Commissioner Jilka, seconded by Commissioner Marrs, to adopt Ordinance No.
04-10242 on second reading. A roll call vote was taken. Aye: (5) Divine, Jilka, Marrs, Webb,
Shadwick. Nay: (0). Motion carried.
(8.2) Second reading Ordinance No. 04-10246 providing a change in zoning district
classification from R-3 (Multi -Family Residential) to PDD (R-3) Planned Development District and
approval of a preliminary development plan on property addressed as 210 W. Mulberry.
Mayor Shadwick noted that Ordinance No. 04-10246 was passed on first reading on
November 1, 2004 and since that time no comments have been received.
Moved by Commissioner Webb, seconded by Commissioner Divine, to adopt Ordinance
No. 04-10246 on second reading. A roll call vote was taken. Aye: (5) Divine, Jilka, Marrs, Webb,
Shadwick. Nay: (0). Motion carried.
(8.3) Second reading Ordinance No. 04-10247 providing a change in zoning district
classification from R-1 (Single -Family Residential) and MH -P (Manufactured Home Park) to C-1 on
property located at 409 W. Cloud Street.
Mayor Shadwick noted that Ordinance No. 04-10247 was passed on first reading on
November 1, 2004 and since that time no comments have been received.
Moved by Commissioner Divine, seconded by Commissioner Webb, to adopt Ordinance
No. 04-10247 on second reading. A roll call vote was taken. Aye: (5) Divine, Jilka, Marrs, Webb,
Shadwick. Nay: (0). Motion carried.
(8.4) Second reading Ordinance No. 04-10248 levying Salina BID #1 service fees for 2005.
Mayor Shadwick noted that Ordinance No. 04-10248 was passed on first reading on
November 1, 2004 and no increase in service fee rates for 2005 are planned.
Moved by Commissioner Webb, seconded by Commissioner Divine, to adopt Ordinance
No. 04-10248 on second reading. A roll call vote was taken. Aye: (5) Divine, Jilka, Marrs, Webb,
Shadwick. Nay: (0). Motion carried.
(8.5) Award contract for replacement of outdoor marquee at the Salina Bicentennial Center
(Project No. 04-1505).
Keith Rawlings, Bicentennial Center Director, explained the project, quotes received, and
project funding.
A discussion followed between Commissioner Marrs and Mr. Rawlings pertaining to the
possible maintenance agreement of the marquee, operation of the sign, advertising revenue, and
messaging software.
Moved by Commissioner Divine, seconded by Commissioner Jilka, to award contract for
replacement of the outdoor marquee at the Salina Bicentennial Center, Project No. 04-1505 to
Daktronics, Inc. for a color unit at a price of $52,000 and authorize an additional $3,000 to cover the
responsibilities of the Bicentennial Center, including a computer to run the messaging software. Aye:
(5). Nay: (0). Motion carried.
(8.6) Request for executive session (legal).
Moved by Commissioner Marrs, seconded by Commissioner Jilka, to recess into executive
session for 45 minutes to discuss with the City Attorney matters subject to attorney-client privilege
for the reason the public discussion of the matters would waive the privilege and adversely affect the
City's interest in the matter; and reconvene at 5:03 p.m. Aye: (5). Nay: (0). Motion carried.
