04-10246 Zone School Park(Published in the Salina Journal on November -A, 2004) 1 C[1511lI-.55.11x --- - . 1 1 ORDINANCE NUMBER 04-10246 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF AND AMENDING THE COMPREHENSIVE PLAN. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. COMPREHENSIVE PLAN. That the Salina Land Use Map (Fig. 11, P. 107) of the Comprehensive Plan of the City of Salina be and is hereby amended to show the South 625 feet of the block bounded by Walnut Street on the north, Seventh Street on the east, Mulberry Street on the south and Eighth Street on the west as High Density Residential. Section 2. AMENDMENT. DISTRICT "PDD". PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: School Park in the middle of the block and Lots 6 — 10 in the School Park in the Original Townsite of the City of Salina, Saline County, Kansas. shall become a part of District "PDD" PLANNED DEVELOPMENT DISTRICT. Section 3. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT, except that building setbacks shall be as shown on the approved site plan. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions to -wit: Development limitations shall be as follows: a) Development on the site shall be limited to multi -family residential apartments for the elderly containing up to 62 dwelling units and customary accessory uses servicing residents. b) Development on the site shall be subject to the bulk regulations of the R-3 (Multi -Family Residential) District except that a loft. front yard setback shall be permitted on Seventh Street and Eighth Street for the Roosevelt Building, a 20 ft. front yard setback shall be permitted on Seventh Street and Eighth Street for the Lincoln Building and a 5 ft. side yard setback shall be permitted from the north property line. c) A total of 58 off-street parking spaces including handicapped accessible spaces shall be provided on site. 2. The approved preliminary development plan shall serve as the final site development plan for the project. Development of the site shall substantially conform with the approved preliminary development plan, landscape plan, and elevation drawings. Plans for signage and site lighting shall be submitted and approved prior to issuance of a building permit. 3. Any substantial modifications to the approved preliminary development plan, landscape plan or building elevations must be reviewed and approved by the board of commissioners. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
