8642 Unclaimed Water DepositsORDINANCE NUMBER 8642 (Published in The Salina Journal Qf'Q 1978) I AN ORDINANCE PROVIDING FOR THE FORFEITURE OF UNCLAIMED DEPOSITS OF WATER CUSTOMERS; AMENDING SECTION 35-29 OF THE SALINA CODE; AND REPEALING THE EXISTING SECTION. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Section 35-29 of the Salina Code is hereby amended to read as follows: ''Section 35-29. Forfeiture of unclaimed deposits. Any amount of security deposit and the accrued interest thereon remaining in the account of any customer in accordance with this article who has discontinued service with the department shall be placed in the operating fund of the Water and Sewerage Department upon the following conditions: (a). Such money has remained on deposit with the Water and Sewerage Department for a period of more than three (3) years from the date service was discontinued; (b). No demand for such money has been made at any time during the three (3) year period; (c). The whereabouts of the person to whose account the money is credited is unknown and a reasonable effort has been made to determine the same; and, (d). Following the expiration of the three (3) year period the Water and Sewerage Department has published once a week for two (2) consecutive weeks in the official newspaper of the city a notice listing the person whose deposit remains on account and that a demand for such money must be made within sixty (60) days. Sixty (60) days after the last publication of such notice, any security deposit remaining in the account of such customer shall be placed in the operating fund of the Water and Sewerage Department.'' Section 2. That the existing Section 35-29 of the Salina Code is hereby repealed. Section 3. This ordinance shall be in full force and effect after its adoption and publication in the official city newspaper.
