AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE
SAME BEING CHAPTER 36 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN
AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN
THE CITY AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain land therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT "C-2 - P.D.D.", NEIGHBORHOOD SHOPPING -
PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of
Salina, Kansas, hereto duly adopted and published as a part of Ordinance Number
8526, the same being Chapter 36 of the Salina Code, be and it is hereby amended
so that the following described property be rezoned as follows, to -wit:
The West 85 feet of the East 210 feet of Lot 4, Block 6, Oakdale
Addition to the City of Salina, Saline County, Kansas
shall become a part of District "C-2 - P.D.D.", NEIGHBORHOOD SHOPPING - PLANNED
DEVELOPMENT DISTRICT. That the use of said described property shall be subject
to all the conditions, restrictions and limitations as made and provided for in
Ordinance Number 8526, the same being Chapter 36 of the Salina Code, with referenc
to the NEIGHBORHOOD SHOPPING - PLANNED DEVELOPMENT DISTRICT, and in addition
thereto shall be subject to the following conditions, to -wit:
A. That the only permitted uses on said property shall be as follows:
(1) Apparel stores,
(2) Barber shop,
(3) Beauty shop,
(4) Business and Professional offices,
(5) Florist shop,
(6) Gift shop and variety store,
(7) Medical and dental clinic,
(8) Package liquor store,
(9) Pharmacies,
(10) Any other similar retail business not specifically listed
in any section if it complies with the conditions and
restrictions contained in Section 36-609(5).

B. That the only conditional use on said property shall be as
follows:
(1) Multi -family dwelling provided it shall be governed by the
R-3, Multiple -Family Residential District requirements.
Such requirements shall include yard, off-street parking,
lot coverage, and all other requirements for multi -family
developments as required in the R-3 District, except
maximum number of units shall be nine (9).
C. Maximum gross floor area of main structure - 4,800 square feet.
D. Maximum percentage of lot area occupied by structures - less
than 30%.
E. Off-street parking requirements - The Building Inspector has
determined that nine off-street parking spaces will be required.
The site plan Indicates 16 parking spaces, 14 in the rear and 2
in front, which exceeds the Building Inspection requirements.
F. Landscaping as shown is existing; any changes or replacemtns will
be similar type.
G. Sign shall be ground type - not exceeding 8 feet in height;
maximum size, 36 square feet.
H. Any future additions to the main structure will be accomplished
in such a manner as to preserve the present architectural styling.
Section 2. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
