The Clerk replied yes. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p .m. in Room 107, City-County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. Those present and comprising a quorum: Mayor Davis (presiding), Michael L. Hoppock, Greg Lenkiewicz, Bill Longbine and Karl Ryan. Also present: Mike Schrage, City Manager; Jacob Wood, Deputy City Manager; Shawn Henessee, Assistant City Manager; Greg Bengtson, City Attorney; and Jo Vonna A. Rutherford, City Clerk. AWARDS AND PROCLAMATIONS Mayor Davis read a congratulatory letter to Virginia Garrelts, a Salina citizen, who reached a milestone 1001h birthday recently. Mayor Davis also provided details and suggestions for demeanor for the December 14, 2022, public forum on homelessness in the city. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (5.1) Approve the minutes of December 5, 2022. (5.2) Approve Resolution No. 22-8094 adopting Financial Policies for the City of Salina. (5.3) Award the contract for project number 22032, Markley Rd Trail Berkley Family Recreational Area to T&R Construction, Inc. of Salina in the amount of $61,805.33 with a 5% ($3,090.27) construction contingency for a total project authorization not to exceed $64 ,895.60 and authorizing the City Manager to execute a contract with T &R Construction, Inc. of Salina upon fulfillment of all prerequisites under the bid documents. Commissioner Longbine requested Item 5.3 be removed from the Consent Agenda. Moved by Commissioner Ryan, seconded by Commissioner Hoppock, to approve Item 5.1 and Item 5.2 of the consent agenda. Aye: (5). Nay (0). Motion carried. In relation to Item 5.3, Commissioner Longbine questioned where the trail would end. Dan Stack, City Engineer explained it would meet the runway and there would be continuous concrete to Crawford Street. Brenda Stoss, Municipal Court Judge, explained the request, fiscal impact, and action options. A brief discussion followed related to renewal of the agreement, past fulfillment of obligations by Smart Security, training and education of security guards and details provided in proposals received. Moved by Commissioner Longbine, seconded by Commissioner Ryan, to approve Resolution No. 22-8097 awarding the contract for security services at Municipal Court to 1st Choice Security, LLC. Aye: (5). (6.2) Approve Resolution No. 22-8098 authorizing the City Manager to execute an agreement with Julie Effenbeck to provide indigent counsel services for the Salina Municipal Court. Aye: (5). Nay (0). Motion carried. L DEVELOPMENT BUSINESS (7.1) Approve Ordinance No. 22-11138, on first reading, annexing a 20-foot strip of land in Schilling Subdivision No. 5. Dean Andrew, Planning & Zoning Administrator, explained the request, fiscal impact and action options. 22-0343 Moved by Commissioner Longbine, seconded by Commissioner Ryan, to approve Ordinance No. 22-11138, on first reading, annexing a 20-ft wide strip of land in Schilling Subdivision No. 5 into the city. (7.2) Approve Ordinance No. 22-11139, on first reading, changing the zoning district classification from C-1 (Restricted Business) to PC-2 (Planned Neighborhood Shopping) for property located at 1001 Schippel Drive to allow a former veterinary clinic to be converted to a beauty salon. Motion carried . 11111 (7.3) Special Event Permits (7.3a) Approve Ordinance No . 22-11141, on first reading, amending Chapter 6 of the City Code by adding an article to be numbered Article V regarding the authorization and regulation of special event activities; integrating the subject matter of related existing code provisions regarding specific types of special events, including carnivals, circuses and tent shows, and special event use of city-owned public parking lots; and repealing those related existing code sections previously required to regulate special events, including Section 06- 16, Section 06-17, and Sections 35-256.1through35-256.4. (7.3b) Approve Resolution No. 22-8099 establishing fees for special event permits pursuant to Chapter 6, Article V . Lauren Driscoll, Director of Community and Development Services, explained the request, fiscal impact and action options. A lengthy discussion ensued which included flexibility, community investment, application availability on website, beta testing, reservations, cancellations, costs, expenses, fees, staffing, customer service, user education, user manual, timeline, staff effort and update on city website. 22-0345 Moved by Commissioner Ryan, seconded by Commissioner Longbine, to approve Ordinance No. 22-11141, on first reading, amending Chapter 6 of the City Code by establishing Chapter 6, adding an article to be numbered Article V, regarding the authorization and regulation of special event activities and repealing those related existing code sections, previously required to regulate special events. (7.4) Approve Ordinance No. 22-11140, on first reading, amending Salina Code Sections 6-115, 6-116, 6-186, 6-188, 6-233, and 6-234 pertaining to the permitting and regulation of horse-drawn vehicles, outdoor merchandise areas and minor sidewalk dining areas in the Downtown Arts, Commerce And Entertainment District in the City of Salina, Kansas, repealing the existing sections, and repealing Salina Code Section 35-40.2 pertaining to use of public sidewalk in the C-4 Central Business District for placement of certain objects. (7.5) Approve Resolution No. 22-8100 authorizing the submission of an application by the city of Salina to the Kansas Department of Commerce for the issuance of a non- competitive sub-award for the city to administer the Economic Expansion Rural Housing Grants (EERHG); authorizing the reservation of funds by the city necessary to meet the required match for the first disbursement of grant funds ; and authorizing the City Manager to execute a grant award agreement and to take any actions necessary regarding distribution of grant funds and administration of the grant award agreement. Jon Blanchard, Salina, Kansas , provided his thoughts on the request for proposal proces s and current housing needs in Salina. Moved by Commissioner Ryan , seconded by Commissioner Hoppock, to approve Resolution No. 22-8100 . Aye: (5). Nay (0). Motion carried. (7.6) Housing Request For Proposal Process Overview Discussion . Mike Schrage, City Manager , explained the request and stated that Matt Webster with Stifel Financial was online to assist in answering questions. A lengthy discussion developed comprised of process timeline, number of units, requirement versus preference for number of units, parcel size limitations, number of projects, multi- level buildings, comparable properties, limitations to investors and developers , flexibility in proposal , different market products , tenant base , breakdown of unit layouts , building trends in Kansas City and Wichita, free market , deadline and distribution of request for proposal. Norman Mannel , Salina, Kansas , shared his thoughts on development of land and the effects on wildlife. Jon Blanchard, Salina, Kansas , provided his opinion on methods of distributing the request for proposal , number of units and funding being used locally. Ken Reitz, Salina, Kansas , stated smaller units are easier to handle and offer a larger variety of styles compared to development in the last 20 years that has been identical. Page 4 "' "' 22-0349 OTHER BUSINESS Commissioner Longbine stated that progress is being made in Bill Burke Park but there is still a lot to do. Commissioner Ryan announced his intention not to seek nomination for Mayor in 2023 as is usual practice for a Vice Mayor. A discussion followed related to organizational issues, practice versus policy, voting at the organizational meeting on January 9, 2023, procedure and placing the matter on the agenda for future consideration amongst the Governing Body. Shawn Henessee, Assistant City Manager, confirmed the link distributed for the citizen forum was correct. CITIZENS FORUM Norman Mannel, Salina, Kansas, shared his thoughts on protection of substations and misleading photos of the pond at Lakewood Park. Jon Blanchard, Salina, Kansas, provided comment on the moderator for the citizen forum, existence of a drug task force, staffing at the Salina Police Department and organization issues. EXECUTIVE SESSION 22-0350 Moved by Commissioner Longbine, seconded by Commissioner Ryan, to recess into executive session for 25 minutes, after a 5-minute break, to discuss the City Manager's evaluation based upon the need to discuss personnel matters of non-elected personnel pursuant to K.S.A. 75-4319(b)(l). The open meeting will resume in this room at 7:15 p.m. Aye (5). Nay (0). Motion carried. The City Commission recessed into executive session at 6:50 p.m. and reconvened at 7:15 p.m. There was no one else present in the executive session and no action was taken.
