AN ORDINANCE RELEASING AND VACATING A PORTION OF THE "CLEAR ZONE
EASEMENT" ACQUIRED BY THE CITY OF SALINA, KANSAS, IN CASE NUMBER 21,538 IN THE
DISTRICT COURT OF SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That it is hereby determined that the "Clear Zone Easement"
acquired by the City of Salina, Kansas, over and above the real estate hereinafter
described is no longer necessary or required for the operation of a municipal
airport by said city.
Section 2. That the City of Salina does hereby release and vacate
that certain "Clear Zone Easement" acquired by it in Case Number 21,538 in the
District Court of Saline County, Kansas, over and above the following described
real estate, to -wit:
Commencing at a point on a line common to Sections Twenty (20)
and Twenty-nine (29), Township Fourteen (14) South, Range Two
(2) West of the 6th Principal Meridian, Saline County, Kansas,
to which has been assigned a bearing of due East four hundred
twenty-one feet (421') easterly from the quarter corner common
to Sections Twenty (20) and Twenty-nine (29); thence South
zero degrees twenty-five minutes West (S 0°25' W) one thousand
five hundred feet (1,500') to the point of beginning.
Beginning at this point, thence South zero degrees twenty-five
minutes West (S 0°25' W) one thousand one hundred twenty-seven
feet (1,127'), more or less, to the East-West quarter line of
Section Twenty-nine (29); thence east along the East-West
quarter line one thousand feet (1,000'); thence North zero
degrees twenty-five minutes East (N 0°25' E) one thousand one
hundred twenty-seven feet (1,127'), more or less; thence west
one thousand feet (1,000') to the point of beginning, containing
25.9 acres, more or less.
Section 3. The release of this "Clear Zone Easement" is subject to
Oliver L. Hagg executing a quit claim deed to the City of Salina, Kansas, to the
following described real estate, to -wit:
A tract of land in the Northeast Quarter (NE/4) of Section
Twenty-nine (29), Township Fourteen (14) South, Range Two (2)
West of the Sixth Principal Meridian, described as follows:
Beginning at a point on the line common to Sections Twenty
(20) and Twenty-nine (29), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian, Saline County,
Kansas, to which has been assigned a bearing of due East, four
hundred twenty-one feet (421') east of the quarter corner
common to Sections Twenty (20) and Twenty-nine (29); thence
South zero degrees twenty-five minutes West (S 0°25' W) one
thousand five hundred feet (1,500'); thence due East one
thouand feet (1,000'); thence North zero degrees twenty-five
minutes East (N 0°25' E) one thousand five hundred feet (1,500')
to the section line; thence due ;Jest along section line one
thousand feet (1,000') to the point of beginning, containing
34.4 acres, more or less.
Subject however, to the retention by the said Oliver L. Hagg of the oil, gas and
other minerals under said land, however, without right of ingress or egress
thereon, or use of any of the surface thereof.
Section 4. That the City of Salina, Kansas, shall execute such
instruments as may be necessary to assure Oliver L. Hagg of the reservation of
the oil, gas and other minerals under said land, however, without right of
ingress or egress thereon, or use of any of the surface thereof.
Section 5. That the Mayor and City Clerk are authorized to execute
any instruments which may be necessary or requisite in order to carry out the
intent of this ordinance.
Section 6. This ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
