8714 GO Bonds P-222ORDINANCE NUMBER 8714 (Published in The Salina Journal M(A\30 1979) I AN ORDINANCE AUTHORIZING THE ISSUANCE OF INTERNAL IMPROVEMENT BONDS OF THE CITY OF SALINA, KANSAS, IN THE SUM OF $1,286,000.00, TO PAY THE COST OF CURBING, GUTTERING, PAVING, GRADING, SANITARY SEWER, STORM SE14ER, WATER MAIN, SEWAGE PUMP STATION AND FORCE MAIN IMPROVEMENTS IPJ THE CITY, TO BE DESIGNATED AS SERIES P-222. WHEREAS, the cost of curbing, guttering, paving, grading, water main and services, and sanitary sewer improvements, as per Resolution Numbers 3308 and 3309, and Ordinance Number 8690, has been determined to be $366,008.57; and WHEREAS, the cost of water main and services, main sanitary sewer and pump station and sanitary sewer improvements, as per Resolution Numbers 3331 and 3335, and Ordinance Number 8665, has been determined to be $162,415.44; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and services and sanitary sewer improvements, as per Resolution Numbers 3329 and 3330, and Ordinance Number 8686, has been determined to be $489,017.01; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and services, and sanitary sewer improvements, as per Resolution Numbers 3332 and 3336, and Ordinance Number 8687, has been determined to be $103,806.02; and WHEREAS, the cost of curbing, guttering, paving and grading, water main and service lines and sanitary sewer improvements, as per Resolution Numbers 3344 and 3345, and Ordinance Number 8669, has been determined to be $182,776.59; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and services, and sanitary sewer improvements, as per Resolution Numbers 3355 and 3358, and Ordinance Number 8691, has been determined to be $150,918.39; and WHEREAS, the cost of curbing, guttering, paving, grading, storm sewer, water main, sanitary sewer and sewage pump station and force main improvements, as per Resolution Numbers 3366 and 3368, and Ordinance Number 8705, has been determined to be $330,765.79; and WHEREAS, the cost of water main and service line improvements, as per Resolution Numbers 3388 and 3389, and Ordinance Number 8706, has been determined to be $14,317.17; and WHEREAS, the total cost of curbing, guttering, paving, grading, sanitary sewer, storm sewer, water main, sewage pump station and force main improvements has been ascertained and the portion thereof, in the amount of $170,003.97 is to be apportioned to the City -at -large to be paid by general taxes to be levied upon all taxable property within the said City for the improvement of squares and areas formed by the crossing of streets and alleys for the improvement of any of said streets, where the same is through or adjacent to property of the City, for which the City is liable, for which bonds are to be issued; and WHEREAS, the total cost of curbing, guttering, paving, grading, sanitary sewer, storm sewer, water main, sewage pump station and force main improvements, which are to be paid by special assessments and to be levied upon lots and pieces of ground for the payment of said streets and grading in said streets, and sewers and water mains, has been ascertained and has been hereby found and determined to be the sum of $1,630,021.01, less $509,864.58 which has been paid by petitioners as required by Resolution Numbers 3113 and 3119 leaving a balance of $1,120,156.43, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in ordinances of the City of Salina, Kansas, relating thereto, duly passed and approved, of which amount the sum of $4,160.40 has been duly paid by the property owners liable therefor, leaving a balance of $1,115,996.03, for which bonds are to be issued; and WHEREAS, bonds in the aggregate amount of $1,286,000.00 are to be issued to pay the actual cost thereof, SO NOW, THEREFORE BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby adopted as a part of this ordinance and that for the purpose of providing funds to pay the cost of improvements hereinabove referred to and described in the ordinances and resolutions of said City as hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $1,286,000.00 which shall consist of 258 bonds numbered 1 to 258, inclusive, all dated June 1, 1979, shall bear interest as follows: bonds numbered 1 to 102, inclusive, shall bear interest at the rate of 6 percent per annum; bonds numbered 103 to 128, inclusive, shall bear interest at the rate of 5.75 percent per annum; bonds numbered 129 to 154, inclusive, shall bear interest at the rate of 5.375 percent per annum; bonds numbered 155 to 258, inclusive, shall bear interest at the rate of 5.40 percent per annum from and after said date until the respective maturities of said bonds, payable June 1, 1980 and thereafter semi-annually on June 1 and December 1, each year, said interest to be evidenced by interest coupons as hereinafter provided. Said bonds shall be executed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the city shall be affixed thereto. Said bonds shall have interest coupons attached thereto representing the interest thereon, and said interest coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signatures of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the Office of the City Clerk and in the Office of the State Treasurer, as required by law. Section 3. Said bonds shall be designated as Series P-222 and shall Pe in the form and shall contain recitals substantially as follows, to -wit: n 1 M UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND SERIES P-222 $5,000.00 KNOW ALL MEN BY THESE PRESENTS that the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted, and for value received hereby promises to pay to the bearer, on the first day of December, 19 , the principal sum of FIVE THOUSAND DOLLARS in lawful money of the United States of America, with interest thereon from the date hereof at the rate of percent ( %) per annum payable June 1, 1980 and thereafter semi-annually June 1 and December 1, in each year, upon presentation and surrender of the interest coupons hereto attached, as said coupons severally become due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the State of Kansas in the City of Topeka, Kansas and said City of Salina, Kansas, is held and firmly bound by these presents, and the full faith, credit and resources of said city are hereby irrevocably pledged for the prompt payment of said principal and interest at maturity. This bond is one of a series of 258 bonds of like date and tenor, excepting denomination, number, interest rate and maturity, aggregating the principal sum of $1,286,000.00, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain curbing, guttering, paving, grading, sanitary sewer, storm sewer, water main, sewage pump station and force main improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the Constitution and laws of the State of Kansas, including K.S.A. 10-101 to 10-127; 12-601 to 12-608; 12-617 to 12-620; 12-626 to 12-629; 13-1011; 13-1017; and 12-6a01 to 12-6a18 and amendments thereto, and all other provisions of the laws of said State applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and Statutes of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation. The full faith, credit and resources of the City of Salina, Kansas, shall be, and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon, as the same mature. The governing body of said City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest of said bonds as they severally become due by levying taxes and assessments on property liable therefor, as provided by law.
