AN ORDINANCE LEVYING SPECIAL ASSESSMENTS AGAINST CERTAIN PROPERTY TO
PAY THE COST OF CONSTRUCTING CERTAIN SIDEWALKS IN THE PARKING ABUTTING THE
FOLLOWING PROPERTY TO -WIT:
A concrete sidewalk installed at the curb line on the north side of
Otto Avenue from the east line of Tulane Avenue to the west line of
Ninth Street, adjacent to Lots 1, 6, 7, Block 1, Waters Subdivision to
the City of Salina, Saline County, Kansas.
WHEREAS, the Board of Commissioners has, by Resolution Number 80-3493,
caused to be notified the owners of the property hereinafter described, to cause
their respective portion of said sidewalks to be constructed at their own expense
and have fulfilled all conditions precedent to the construction of said sidewalks
WHEREAS, the owners of the property hereinafter described did not
within 30 days, as required by Resolution Number 80-3493, cause said sidewalk to
be constructed and the City caused said sidewalks to be constructed pursuant to
K.S.A. Chapter 12, Article 18, and the cost thereof has been ascertained.
WHEREAS, the Board of Commissioners has determined that the total cost
of such improvements is Nine Hundred Seventy-five and 36/100 Dollars and that
98.833 percent, in the amount of Nine Hundred Sixty-three and 98/100 Dollars
($963.98) is to be assessed the improvement district and 1.167 percent in the
amount of Eleven and 38/100 Dollars is to be assessed against the City -at -large,
SO NOW, THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
the cost of constructing said sidewalks, taxable against the following described
lots in the amount set opposite said lots:
WATERS SUBDIVISION
Block 1
Lot 6 - - - - - - - - - - - - - - - - - - - - - - - - - $963.98
Section 2. That the owner or owners of the property above described
shall have thirty days (30) days after the publication of this ordinance within
which to make full payment.
Section 3. That the City Clerk is directed to mail a notice not less
than fifteen days prior to the end of the thirty (30) days to the owners of the
property as shown on the records of the Office of the Register of Deeds.
Section 4. That if full payment of the assessment made in Section 1
of this ordinance is not made within thirty days after the publication of this
ordinance, the City Clerk is hereby directed and authorized to certify said
assessments to the County Clerk of Saline County, Kansas, to be placed on the
tax roll for collection in four installments, starting with the year 1981, and
subject to the same penalties and collected in like manner as other taxes.
