80-8792 GO Bonds P-224ORDINANCE NUMBER 80-8792 (Published in The Salina Journal rY-VAkt. 23 , 1980) AN ORDINANCE AUTHORIZING THE ISSUANCE OF INTERNAL IMPROVEMENT BONDS OF THE CITY OF SALINA, KANSAS, IN THE SUM OF $1,450,000.00, TO PAY THE COST OF CURBING, GUTTERING, PAVING, GRADING, SANITARY SEWER, STORM SEWER, WATER MAIN AND SERVICE IMPROVEMENTS IN THE CITY, TO BE DESIGNATED AS SERIES P-224. WHEREAS, the cost of curbing, guttering, paving, grading, and sanitary sewer improvements authorized by Resolution Numbers 3384 and 3385, and Ordinance Number 8762, has been determined to be $164,563.62; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and services, sanitary sewer and storm drainage improvements authorized by Resolution Numbers 3359 and 3360, and Ordinance Number 8759, has been determined to be $319,104.17; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and sanitary sewer improvements, authorized by Resolution Numbers 3364 and 3365, and Ordinance Number 8763, has been determined to be $157,289.99; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and services and sanitary sewer improvements authorized by Resolution Numbers 3373 and 3376, and Ordinance Number 8764, has been determined to be $315,396.74; and WHEREAS, the cost of curbing, guttering, paving, grading, water main and services, sanitary sewer and storm sewer improvements authorized by Resolution Numbers 3407 and 3408 and Ordinance Number 80-8781, has been determined to be $580,834.72; and WHEREAS, the cost of water main improvements authorized by Resolution Numbers 3409 and 3412, and Ordinance Number 80-8776, has been determined to be $284,362.05; and WHEREAS, the cost of curbing, guttering, paving, grading, sanitary sewer, storm drainage, water main improvements authorized by Resolution Numbers 3435 and 3437, and Ordinance Number 80-8777, has been determined to be $210,525.31 and WHEREAS, the total cost of curbing, guttering, paving, grading, sanitary sewer, storm sewer, water main and service improvements has been ascertained and the portion thereof, in the amount of $404,400.78, less $219,356.10 paid by the Water and Sewerage Fund leaving a balance of $185,044.68 to be apportioned to the City -at -large to be paid by general taxes to be levied upon all taxable property within the City for the improvement of squares and areas formed by the crossing of streets and alleys for the improvement of any of said streets, where the same is through or adjacent to property of the City for which the City is liable, for which bonds are to be issued; and WHEREAS, the total cost of curbing, guttering, paving, grading, sanita sewer, storm sewer, water main and services improvements, which are to be paid by special assessments and to be levied upon lots and pieces of ground for the payment of said streets and grading in said streets, and sewers and water mains, has been ascertained and has been hereby found and determined to be the sum of $1,627,675.82, less $353,419.76 which has been paid by petitioners as required by Resolution Numbers 3113 and 3119, leaving a balance of $1,274,256.06 which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in ordinances of the City of Salina, Kansas, relating thereto, duly passed and approved, of which amount the sum of $9,300.74 has been duly paid by the property owners liable therefor, leaving a balance of $1,264,955.32, for which bonds are to be issued; and WHEREAS, bonds in the aggregate amount of $1,450,000.00 are to be issued to pay the actual cost thereof, SO NOW, THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby adopted as a part of this ordinance and that for the purpose of providing funds to pay the cost of improvements hereinabove referred to and described in the ordinances and resolutions of said City as hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $1,450,000.00 which shall consist of 290 bonds numbered I to 290, inclusive all dated June 1, 1980, shall bear interest as follows: bonds numbered 1 to 87, inclusive, shall bear interest at the rate of 6.75 percent per annum; bonds numbered 88 to 174, inclusive, shall bear interest at the rate of 5.70 percent per annum; bonds numbered 175 to 203, inclusive, shall bear interest at the rate of 5.75 percent per annum; bonds numbered 204 to 232, inclusive, shall bear interest at the rate of 5.80 percent per annum; bonds numbered 233 to 290, inclusive, shall bear interest at the rate of 5.90 percent per annum from and after said date until the respective maturities of said bonds, payable June 1, 1981 and thereafter semi-annually on June 1 and December 1, each year, said interest to be evidenced by interest coupons as hereinafter provided. Said bonds shall be executed for and on behalf of the City by the facsimile signature of the Mayor and the facsimile signature of the City Clerk and the corporate seal of the City shall be affixed thereto or imprinted thereon. Said bonds shall have interest coupons attached thereto representing the interest on said bonds, and said interest coupons shall bear the facsimile signatures of the Mayor and City Clerk of said City, and said bonds and interest coupons shall be regiatered in the Office of the City Clerk and in the Office of the State Treasurer, as required by law. Section 3. Said bonds shall be designated as Series P-224 and shall be in the form and shall contain recitals substantially as follows, to -wit: 1 1 1 No. UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND SERIES P-224 $5,000.00 KNOW ALL MEN BY THESE PRESENTS that the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted, and for value received hereby promises to pay to the bearer, on the first day of December, 19_, the principal sum of FIVE THOUSAND DOLLARS in lawful money of the United States of America, with interest thereon from the date hereof at the rate of percent ( °o) per annum payable June 1, 1981 and thereafter semi-annually June 1 and December 1, in each year, upon presentation and surrender of the interest coupons hereto attached, as said coupons severally become due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the State of Kansas in the City of Topeka, Kansas and said City of Salina, Kansas, is held and firmly bound by these presents, and the full faith, credit and resources of said city are hereby irrevocably pledged for the prompt payment of said principal and interest at maturity. This bond is one of a series of 290 bonds of like date, denomination and tenor, excepting number, interest rate and maturity, aggregating the principal sum of $1,450,000.00, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain curbing, guttering, paving, grading, sanitary sewer, storm sewer, water main and service improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the Constitution and laws of the State of Kansas, including K.S.A. 10-101 to 10-127; 12-601 to 12-608; 12-617 to 12-620; 12-626 to 12-629; 13-1011; 13-1017; and 12-6a01 to 12-6al8 and amendments thereto, and all other provisions of the laws of said State applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the Constitution and Statutes of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and when duly registered to deliver said bonds to the purchaser or purchasers thereof. The proceeds of said bonds shall be placed in the City Treasury and shall be applied solely for the purpose of providing funds to pay the cost of the improvements hereinbefore described. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be, and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon, as the same mature. The governin body of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest of said bonds as they severally become due by levying taxes and assessments on property liable therefor, as provided by law.
